Yippeeee...It's underway...Certainly hope Justice for Kathleen will come soon...and...even though it's considered hearsay I'd think that the pastors recollections would have credibility...

Sorry Estee. There must be an unwritten rule that says none of the trials in the cases we follow will start as scheduled.

Drew Peterson trial delayed

A last-minute appeal by Will County State's Attorney James Glasgow is expected to delay Thursday's scheduled start of the Drew Peterson murder trial, Glasgow said today in a statement.

The appeal comes after Judge Stephen White barred Will County prosecutors from offering some key hearsay testimony during the trial of the former Bolingbrook cop accused of drowning third wife Kathleen Savio.

Prosecutors had hoped to introduce more than a dozen hearsay statements--including some from Savio herself--that implicated Peterson in her 2004 bathtub drowning death.

In arguing that those statements be admitted, Glasgow cited a recent Appellate Court ruling upholding the use of such secondhand statements in criminal trials But White this week still ruled many of those statements would not be allowed at Peterson's trial.

"The people of the state of Illinois are entitled to a fair trial and I intend to see that they get one," Glasgow said in his statement. "As state's attorney, I am obligated to appeal the judge's ruling to ensure that every legally admissible statement may be presented at trial."

In this particular case, I am actually glad they have delayed it. Sounds to me like the prosecutor has more work to do to try to get the barred hearsay statements in.....

Is the same judge going to hear the appeal? I don't see him changing his mind if it is the same one.

Do they think the case isn't strong enough without the hearsay statements, or do you think they just don't want to leave any stone unturned?

J4A... I can't answer either of those questions with anything other than speculation and opinion.

If it is the same judge, maybe they plan to take it up the chain of appeals.

And whether or not they have a strong enough case without the hearsay, I guess only the prosecution really knows for sure. I'm leaning towards, like you said, they just don't want to leave any stone unturned. He got away with this murder for a while..... I think the prosecution wants to make sure he doesn't get away with it for good.

So far the defense has what they wanted...a postponement/delay/change of date for this trial...Let's just hope it isn't delayed for another year...The only good thing is that Drew will be behind bars and in isolation all that time...

Estee, unless I am misreading the article J4A posted, I believe it is the prosecution who requested the delay in the trial in order to appeal the judge's ruling of not allowing the previously barred hearsay.

JOLIET, Ill. | A judge has ruled that former Illinois police officer Drew Peterson should remain in jail pending an appeal by prosecutors in his murder case.

Defense attorneys had argued that keeping the former Bolingbrook officer behind bars while prosecutors appealed a judge's ruling denied Peterson his right to a speedy trial.

Will County Judge Stephen White said Thursday that "the court finds compelling reason" to keep Peterson in jail. He did not elaborate.

The judge on Wednesday ruled out certain hearsay statements prosecutors hoped to present during the trial.

Peterson has pleaded not guilty to first-degree murder in the death of his third wife, Kathleen Savio. He has denied involvement in the 2007 disappearance of his fourth wife, Stacy Peterson.

Good, he can sit and rotate and contemplate his fate... 8) ...By the way didn't he waiver his right to a speedy trial??? Isn't that one of the reasons things keep getting delayed??? So more arguments can be brought and more delays occur??? He should be grateful he isn't out as there are a lot of Drew Haters out there...At least the young women are safe from this romeo...

Attorneys on Thursday said they'd been confident Judge Stephen White would order Peterson released pending an appeal by prosecutors in Peterson's trial for the death of his third wife, Kathleen Savio. Lead defense attorney Joel Brodsky says Peterson is disappointed in the ruling but "isn't devastated."

The attorneys say the appellate court's decision on hearsay evidence may take six to nine months, but they suggested the appeal process may take far longer. That's because both sides may appeal various rulings to the U.S. Supreme Court, if necessary.

Prosecutor James Glasgow says the ruling to keep Peterson jailed is "in the best interest of justice."

That is an understatement.

The attorneys say the appellate court's decision on hearsay evidence may take six to nine months, but they suggested the appeal process may take far longer. That's because both sides may appeal various rulings to the U.S. Supreme Court, if necessary.
It's starting to look like Casey's trial might start before this one.

He's just going "stir crazy" and wants out so he can find another unsuspecting, naive girl to satisfy his sexual cravings...He's disappointed that he didn't get let out pending???? I'm disappointed that this trial has been delayed yet again...

Thanks for the updates.. I suspect it wuill be a lot longer also.. but I doubt he will make bail.. especially not with the missing persopn case of Stacey who has continued to speak volumes in this case..

Maybe her remains will be discovered while we wait for Kathleens justice..

JOLIET — Defense attorney Joel Brodsky bragged he'd have Drew Peterson on Chicago's Rush Street on Thursday night, scarfing down a steak dinner in Gibsons. Instead, Peterson was back in jail where they were serving beefaroni for supper.

"Drew is an innocent man. He's being held without sufficient evidence," Brodsky said of Peterson, whose trial on charges he murdered his third wife was set to start Thursday but was derailed by a last-minute appeal by State's Attorney James Glasgow.

Defense attorney Joseph "Shark" Lopez said they planned to appeal Judge Stephen White's refusal to let Peterson out of jail as soon as possible.

Glasgow took the case to the appellate court after White refused to reconsider his ruling on hearsay statements the prosecution wants to use against Peterson, who allegedly drowned third wife Kathleen Savio in March 2004. Peterson is also suspected of slaying his fourth wife, Stacy Peterson, who vanished in October 2007. He has not been charged with harming her.

Needed testimony

On Wednesday, Glasgow filed paperwork claiming he could not go through with the murder trial if evidence presented at a landmark hearsay hearing was suppressed. Specifically, Glasgow said he needs the testimony of Peterson's second wife, Victoria Connolly; Peterson's eldest son, Eric Peterson; and Savio's sister, Anna Doman.

During the hearing, Connolly testified that Peterson held her at gunpoint and threatened to kill her three or four times during their 10-year marriage. She also said Peterson stalked her after they divorced and that on one occasion, she woke in the middle of the night to find he had slipped into her home and was standing above her.

Eric Peterson, who is the son of Drew Peterson and his first wife, Carol Brown, recounted a savage tale of domestic abuse he says Drew Peterson perpetrated on Savio in 1993. He told of his father hauling Savio into the house by her hair and dragging her down to the basement, from which he heard a commotion he compared to a train running through the house.

Doman claimed Peterson battered her sister and threatened to kill her, and one time bound her hands and feet and threw her down a flight of stairs. Doman has also repeatedly said Savio predicted Peterson would kill her and make her death look accidental.

When Savio's body was found, state police determined she died in a freak bathtub accident. But after Stacy Peterson disappeared, they decided Peterson killed Savio.

Two-year delay?

Glasgow's appeal could take two years to sort out, said Lopez, and might make it all the way to the U.S. Supreme Court. He maintained that Peterson, who has already been locked up for a year and two months, should be freed while the appeal is pending.

White apparently disagreed. After hearing a brief argument from Glasgow on Thursday that lacked any critical reasons for keeping Peterson locked up, the judge ordered the accused wife-killer be returned to jail.

"The court finds compelling reason to keep Mr. Peterson detained," White said. "I'm not going to go into any specifics. It will be quite clear for the appellate court."

Brodsky was at a loss when asked what those compelling reasons might be.

"I don't know his reasons," Brodsky said. "I really thought he was getting out. I guess being Drew Peterson is an exceptional circumstance."

This delay disappointing yet the prosecutors have to take this route of hearsay due to the botched first investigation. They have little evidence to present otherwise. They have autopsy reports but that may not be enough to convict Drew P. of the murder-it just shows someone murdered Kathleen. Sigh...

Those are good points Sherry. It's better to have a delay than to see him acquitted, and it is good news that he has to stay behind bars during the appeal.

I hate to say it but I just can't trust he will be convicted of Kathleen's murder unless that hearsay comes in. The first investigation was botched because no evidence was collected and then the coronor ruled it an accidental death. I'm glad that Dr. Baden will be allowed to testify but he nearly had his whole report tossed thanks to FOXNews producer, Steph Watts, helping to turn her body and leaving unrelated notes on the autopsy report. Thankfully Dr. Blum's autopsy report says it was murder. Now, connecting Drew P. to her murder will be a tough go-even with the hearsay.

Ugh! I so want to see that evil man put away for life! I want the arrogance of Brodsky to be put down a few notches, too.

Judge: Clock hasn't run out on Peterson's gun charge

OLIET -- Drew Peterson's murder trial is on hold, but the felony gun charge the cops arrested him on more than two years ago looks like it's finally on the fast track.

Judge Richard Schoenstedt tried to kick-start the trial into action Monday morning, but Peterson's attorney, Joel Brodsky, was not prepared.

Brodsky argued Monday that a speedy trial term had lapsed and that Peterson should skate on the charges.

Peterson was arrested in May 2008 for allegedly possessing an assault rifle with an illegally short barrel. Brodsky claimed Peterson was allowed to carry the gun since he was a Bolingbrook police sergeant.

Peterson bailed himself out of jail the same day he was arrested and had a right to go to trial within 160 days, not including time off the clock for delays his attorneys created.

But in November 2008, Schoenstedt dropped the charges when prosecutors refused to surrender internal communications to Peterson's lawyers. The appellate court determined Schoenstedt goofed and sent the case back last week.

In the meantime, Peterson returned to jail in May 2009 for allegedly killing his third wife, Kathleen Savio. His murder trial was set to start a week and a half ago, but a last minute appeal by State's Attorney James Glasgow put this case in limbo.

The way Brodsky had the days counted on the gun case deadline, the prosecution blew its chance to nail Peterson by two days. The judge didn't buy it, but to be on the safe side, offered to start the trial immediately. After a lengthy, private conference with Peterson, Brodsky backed off.

"If I had two more weeks, I could be ready to go to trial," Brodsky said. "I couldn't get ready in one day. That wouldn't be fair to Drew."

Familiar face returns

While Brodsky was the only one of Peterson's six current attorneys present in court Monday, a lawyer from the former cop's past turned up and stuck around all morning. Andrew Abood, who abandoned Peterson's murder case, showed up to quit the gun case too.

While Abood was filing a motion to withdraw, Brodsky filed a motion signed by Peterson to fire him. Schoenstedt accepted Abood's paper instead of Brodsky's.

Asked if he was subpoenaed to testify at Peterson's murder trial, Abood said, "I heard I might be on the list," and added, "I don't think I'll be called, I'll tell you that."

Abood, who jumped ship on the murder case after clashing with Brodsky, sat next to Peterson in the jury box prior to Monday's hearing. The two men spoke for more than 20 minutes, smiling and laughing throughout.

"Drew and I are fine. Drew's great," Abood said of their conversation. He also said he offered to buy Brodsky lunch.

"I can buy my own lunch," Brodsky said.

Constitutional issue?

Of the gun charge being back in court, Brodsky accused Glasgow of trampling on the constitutional rights of not only his client, but everyone in Will County.

"Will County residents don't have the right to a speedy trial, the right to confront witnesses, the right to bear arms," he said, pointing out that Peterson must remain in jail during what might prove a lengthy appeal process, that Glasgow is trying to get hearsay evidence allowed at Peterson's murder trial, and that Peterson was charged with possessing an assault rifle he supposedly was permitted to carry as a Bolingbrook cop.

"Does Mr. Glasgow think Will County residents have any constitutional rights?" Brodsky asked, making Peterson a symbolic victim of the state's attorney's tyranny.

"Drew just happens to be the poster boy, so to speak," Brodsky said. "If (the Constitution) doesn't apply to him, it doesn't apply to anybody. Everybody in Will County should be concerned."

Glasgow's spokesman, Charles B. Pelkie, took exception to Brodsky's criticism.

"These are comments that are not befitting of the profession that he's in," Pelkie said.

"Joel should argue these points in court," he said. "When he does argue these points in court, he's often wrong."

Peterson prosecution: If we missed deadline, time's still not up

Even if the hourglass ran out, Drew Peterson prosecutors argue their 11th-hour appeal regarding barred hearsay statements should be heard because a recent Illinois Supreme Court decision "markedly changed the law."

Will County State's Attorney James Glasgow is asking appellate justices to consider his appeal of Judge Stephen White's May 18 hearsay decision even if they find the defense is correct that prosecutors blew the 30-day deadline.

Glasgow cited a June 24 Illinois Supreme Court decision upholding the DuPage County death penalty conviction of Eric Hanson for the 2005 slayings of four relatives that the prosecutor said shows he is entitled to present additional hearsay evidence.

In its unanimous opinion, the state high court found long-existing common law does not require them to weigh a hearsay statement's reliability for its admissibility.

"The people will argue that a material change in the law is akin to a material change in facts," Glasgow wrote in this week's appellate motion, "and the people will submit that (Hanson) marked a material change in the law."

In response, Peterson's attorneys said Glasgow is now admitting he missed the deadline. Last week, they asked the appellate court to dismiss Glasgow's appeal based on the timeliness issue and accused Glasgow of intentionally stalling the trial until after White retires in October.

Charles Pelkie, a Will County state's attorney spokesman, said prosecutors are confident their appeal is timely, but they also are prepared to argue the Hanson issue provides "a reasonable excuse" should the appellate court rule in the defense's favor. As for the 30-day deadline, prosecutors said, the clock didn't start running until subsequent hearsay filings after White's May 18 sealed ruling.

White barred the majority of more than a dozen hearsay statements the prosecution argues helps prove the retired Bolingbrook police sergeant killed third wife Kathleen Savio in 2004. The statements may prove crucial for the prosecution, which lacks forensics, a confession or concrete medical evidence implicating Peterson.

The defense, which also sought repeated trial delays, has filed its own appeal. They want Peterson freed from jail during the lengthy appellate process. White declared there is "compelling reason" to keep Peterson behind bars on a $20 million bond.

Glasgow argues Peterson faced "financial devastation" from the former couple's upcoming settlement as he tried to begin a new life with his bride, Stacy, about 30 years his junior, and their new baby.

Authorities initially called the 40-year-old Savio's bathtub drowning an accident, but they exhumed her body and ruled otherwise after suspicions grew about Peterson in light of the October 2007 disappearance of Stacy, 23, who still hasn't been found. Much of the barred hearsay testimony deals with Stacy.

Drew Peterson, 56, denies wrongdoing in both cases.

(CHICAGO) (WLS) -- A written ruling by Judge Stephen White apparently details the judge's reasons for disallowing hearsay evidence in the Drew Peterson murder trial.

Peterson's trial, for the murder of his third wife, Kathleen Savio, was to begin earlier this month but was delayed while the prosecution appealed.

The judge sealed his ruling on hearsay evidence back in May. However, ABC7's news partner, the Daily Herald, obtained a copy of that written ruling, and it details specific quotes about what Peterson's third and fourth wives told friends, family members and a church pastor.

Drew Peterson remained in custody Wednesday while prosecutors appealed a judge's ruling about what hearsay evidence can be used in his murder trial. That hearsay evidence includes comments that Kathleen Savio, whom Peterson is accused of killing, told others.

In the ruling, the judge barred eight of the 13 hearsay statements, but he did allow comments Savio allegedly told her sister and a college friend. In one of the statements, Savio allegedly told her sister, "Drew said he's going to kill me, and I would not make it to the divorce settlement. I will never get his pension or my children."

"I'm happy with the statements he wants to allow, but you need everything you can get in a murder trial in order to convict a person," said Nick Savio, Kathleen Savio's brother.

Nick Savio says he is pleased Judge White will allow five hearsay statements in the trial. But, he says, he strongly supports prosecutors who are trying to get all 13 statements into the courtroom.

"Let's hear everything. Why only five statements? Let's hear everything, let's bring it all out. This is the one shot you get to get him, and let's just bring out everything," Nick Savio said.

According to the judge's sealed ruling, Savio also told a college friend that Peterson "could kill her and no one would know." It goes on to say that in 2003, Peterson grabbed Savio and said, "Why don't you just die?"

"Those are incredibly powerful comments because they are words brought out from the dead, someone who is not there, who you feel sympathy for, and all of a sudden, you hear their words and it has resonance, it has meaning to the jurors," said legal expert Thomas Glasgow.

The judge also ruled that part of a conversation between Stacy Peterson, Drew Peterson's fourth wife who is missing, and her pastor would be allowed in the trial.

A spokesman for the Will County State's Attorney would not confirm any information about the leaked ruling but did say the office is "outraged" and considering all its legal options.

ABC7 Chicago also reached out to Peterson's attorney, but he did not return phone calls Wednesday.

In one of the statements, Savio allegedly told her sister, "Drew said he's going to kill me, and I would not make it to the divorce settlement. I will never get his pension or my children."

He certainly made good on his promise above, didn't he?.......I hope they allow the rest of the statements. I realize hearsay won't hang him, but it will certainly draw the noose a little tighter around his smarmy neck.

He says he sleeps on a lawn-chair mattress in a cold cell, where he is being housed in isolation and is frequently strip searched.

Besides his lawyers, the only human contacts for Drew Peterson -- who is awaiting trial in the death of his third wife, Kathleen Savio -- are prison guards and an inmate who brings him meals, clean clothes and linen "passed through a chuckhole," Peterson says in a handwritten letter to Chicago Sun-Times columnist Michael Sneed.

In the 10-page letter received by Sneed last week, the 56-year-old Peterson describes in detail his life in the Will County Jail since his May 2009 arrest. Peterson -- a former Bolingbrook cop who has also been named a suspect in the disappearance of his fourth wife, Stacy -- is facing even more time in prison while prosecutors appeal a ruling that blocked them from using hearsay evidence in his upcoming trial.

"It almost took an act of God to get a second blanket and a thermal shirt,'' he writes. "I haven't figured out yet if I'm being protected from the other inmates or are they being protective from me."

Please don't tell me he expects anyone to feel sorry for him....... because I think he is RIGHT where he belongs, getting EXACTLY the treatment he deserves. His treatment is more humane than what he did to Kathleen and Stacy!!!

Jury selection was supposed to begin last month, but now because of the appeal, it's likely the trial will not begin until next year. But Sue says the outcome is worth the wait.

"I'm pretty disappointed it's going to be another year, possibly even more, but I'm pretty confident in the prosecution that they will come to a guilty verdict."

It's also expected that Peterson will have to remain in jail throughout the appeal process, since the judge ruled last month that there's "compelling" reasons to keep him behind bars.

That brings relief to Sue's husband, Mitchell Doman, "At least we know where he's at; he can't be out there hurting somebody else."

Drew Peterson’s cop son suspended

JOLIET, Ill. (STMW) - The Oak Brook cop son of accused wife-killer Drew Peterson was suspended from his job, possibly for his part in hiding an assault rifle from the state police.

Stephen Peterson, a 6-year veteran of the Oak Brook department, was put on paid administrative leave Friday. He declined to discuss the matter.

Stephen Peterson testified in court four days prior to his suspension and admitted to taking possession of an AR-15 and at least one other weapon his father did not want the state police to get their hands on.

From the witness stand Monday, Stephen Peterson recalled that on Oct. 30, 2007, Drew Peterson showed up at his son’s North Aurora home with two or three guns. The weapons were among his father’s “favorites,” Stephen Peterson said, and “he didn’t want anything to happen to them.”

Wow... I hadnt heard that Stephen P lost his job.. after reading an article from Chicago news, I can see how it was coming.. this is his 6th suspension where it appears it seems to be all about his dad... Its sad how Drew has done this to himself and now has ruined so many other lives.. I be;ieve that Stephen shud tell the truth and stop protecting his father, which he seems to do... As for comments from Brodsky woorried about the possibility the little will be stopped and ticketed if she jaywalks, is a little far fetched...

I believe society will be more than willing to protect his little ones from anything and pray for them...

As far as stephen, he is an adult and a police officer and will be help accountable as it wud only be right.. If he has probs I imagine he will be bringing them on all by himslef as a rult of his love foor his evil father...

Drew Peterson had a small gun, but his lawyers say there's nothing wrong with that.

Peterson's legal team summed up its arguments to have his felony gun case tossed before it goes to trial, but the judge presiding over it is waiting until next month before he hands down his decision.

A shackled Peterson, who also faces a murder charge in connection with the drowning of his third wife and is suspected of slaying his missing fourth wife as well, watched passively Tuesday as two of his six attorneys argued to have his gun case dismissed. Peterson was arrested in May 2008 and charged with possessing a semi-automatic assault rifle with a barrel short of the state-mandated 16 inches.

Its been almost three years since my wife Stacy went missing with The Illinois State Police and The Will County States Attorney's Office launching probably the largest, most obsessive and expensive investigation in U. S. history. This investigation has thus far turned up rumors, gossip hearsay and out right lies and more recently the bodies of a lot of raccoons and possums all at the expense of the hard working Illinois tax payer. This investigation has threatened, harassed, pestered and hounded just about every loved one, friend, family member, fellow employee and love interest I have ever know. I have had friends who have lost jobs and had their businesses placed in jeopardy being harassed by the almighty State Police. Criminal charges have been trumped up against friends by the State Police in hopes of someone, anyone giving them any information against me. On several occasions my home and property have been searched and vandalized by these obsessive thugs with my little children being terrorized in the process. Our heroes. I was taken from my family without being able to say goodbye to my kids with my kids being also taken into custody and turned over to The Department of Children and family Services. This process would be scary for an adult much less a four and five year old.. My 31 year old son Stephen, an Oak Brook Police Officer, stepped up and took custody of my four kids just after having a child of his own. My son Stephen is a good man and a dedicated father and policeman. Stephen got his Bachelors degree in law enforcement at Western Illinois University just so he could fulfill his dream of becoming a policeman. My little girl Lacy Ann just started Kindergarten with her daddy unable to be at her first day of school. Anthony is now in 2nd grade full of life and love just happy to be a kid with his friends. Thomas is now a senior, number one in his class, and now the Vice President of the National Honor Society. He is an athlete and plays trumpet in his school and area church bands. Kristopher is also an athlete and an honor roll student now in his Junior year of high school. All my children are exceptional kids just wanting a happy childhood after their little worlds were turned upside down almost three years ago. Its not bad enough their father is in jail being held unlawfully after the state appealed a Will County Judges decision to not allow bad evidence at trial, but now my children's well being and security is now in jeopardy again. For the third time, in less than three years, my son Stephen is again being brought up on departmental charges of misconduct by Oak Brook Chief Sheehan stemming from trumped up gun charges I'm now facing in a Will County Court. The charges Stephen faced in the past were brought when he took a squad car to a Will County grand Jury while on duty under supeona for the case against me. The second charge was for the use of the departmental computer which were said to be unauthorized. Nothing could be more ridiculous. I have viewed Chief Sheehan as an idiotic moron (and I'm being kind) rumored to have the board who presides over these issues in his pocket. So as in the past I'm sure Stephen will be found guilty of these charges however I'm sure the charges will be again be overturned in the courts in front of a real judge. I have no doubt that the Illinois State Police and the Will County States

Attorney's Office are also involved in this action against my son in an attempt to get at me. If Chief Sheehan should have the balls to give an interview it will be interesting to see if he lies about it. During a prior action against my son Chief Sheehan referred to Stephen as "Drew" at least three times during the hearing so we know where his head is when its not up his ass. I'm not looking for any sympathy for me. I can handle myself. But I am asking the media to closely watch over these proceedings to help protect my son Stephen, being my children's caregiver, against the malicious prosecution he is now facing. What will it take to stop the madness being perpetrated against my family id-an attempt to get at me. I think my little girl Lacy Ann needs to be cautioned on how to walk home from school so she doesn't cross the street in the wrong place and get a citation from our heroes in the State Police for jaywalking. Someone somewhere has to stand up and say STOP. What you are doing is not right The citizens of Oak Brook need to know how Chief Sheehan is treating their policemen who would put their lives on the line to protect them. If I gave my life, which T would gladly do to protect my kids, would that stop the harassment against my family? Let me know Jim and I'll see what I can do for you. I'm devoting all my resources that I have available to fight this atrocity against my son.

October 1, 2010 (JOLIET, Ill.) (WLS) -- Former Bolingbrook police sergeant Drew Peterson had been accused of owning an assault rifle with an illegal short barrel, but a judge dropped those charges Friday.

Prosecutors argued Peterson was not allowed to own a short barrel rifle. He said he had an exception because he was a member of the swat team.

However, since a judge dropped the charges, Peterson and his attorneys will now focus on the upcoming murder trial stemming from the death of Peterson's third wife, Kathleen Savio. Peterson has denied any involvement in her death.

Judge who has overseen Drew Peterson case retires

Judge Stephen White has presided over Peterson's case since the accused wife-killer's legal team succeeded in having the second and third of three judges removed from the case in June 2009.
