I'm interested too, but I don't have much to add about this case. I hope all of the hearsay testimony is allowed into the trial. It's pretty obvious that Drew killed Kathleen and Stacy.

J4A, I'm hoping the judge will allow most of the hearsay testimony, too. I have never thought it was quite right when a person TELLS someone of their fears/experiences or WRITES their fears/experiences in a letter, and it isn't allowed in because it is considered hearsay. Obviously it has to be considered carefully to make sure others aren't just lying, but how else is a person supposed to tell their story when they have been murdered? It is their only way to testify...... I find when a person 'speaks from the grave" to be very valuable testimony....

I actually think this judge WILL allow at least some of the hearsay testimony in. After all, it is law in Illinois now that hearsay can be brought into trial.

JMO, of course.

I cant see how the judge will not excercise the brand new law, that allows hearsay...

I agree Snaz. I feel that if numerous people come forward after a person has died, and they have written notes from the deceased, of course it should be permitted in court. You can't just turn your head and look away. Thanks for all of the updates, Snaz!

Last summer I saw someone interview Drew Peterson on television. During the interview, Peterson stated that Kathy Savio was a “hellcat.” I once dated Kathy Savio. We went to the same high school in Hillside. I do not ever remember her being a “hellcat.” She was a beautiful, fun-loving person. She enjoyed being around people. She was energetic, kind and loved attention. Everyone liked being around her. Maybe she turned into a “hellcat” because she found herself running for her very life. How many times did she contact the Bolingbrook Police Department screaming for help? Was it at least 14 times? Someone correct me if I’m wrong. Kathy received no help. Again, correct me if I’m wrong. Peterson, in shackles, looked as if it was funny when he was being escorted to jail. Everyone who was watching saw that dopey look on his face as he boasted about having three square meals a day. What person in his right mind would have a stupid-looking grin on his face when going to jail, arrested on suspicion of murder? I can’t find anyone who believes any words he has spoken. Personally, I think he is a gutless coward. Come Judgment Day, the Lord Jesus will avenge Kathleen’s death. Whoever murdered her, whoever the spineless jellyfish is will be punished for all eternity. And then there’s Peterson, who constantly feeds on negative attention with the media. Hang it up, dude, nobody believes you.

JOLIET — The hearsay hearing set to start back up today will likely feature the testimony of a man who says Drew Peterson’s stepbrother shared details of covering up a murder.

Walter Martineck, the neighbor and long-time friend of Peterson’s stepbrother, Thomas Morphey, was subpoenaed by the defense to testify at this morning’s session of the ongoing hearsay hearing, two sources said Tuesday.

Martineck has already publicly told of Morphey showing up at his door and spilling a story of helping Peterson carry a blue barrel downstairs to Peterson’s waiting sport utility vehicle.

Morphey, who testified on Day 2 of what is now a 17-day hearing, went into great detail about helping Peterson allegedly move the body of his fourth wife, Stacy Peterson.

One of Peterson’s attorneys, George Lenard, tried to cast doubt on Morphey’s tale by pointing out that his account differed from the one Martineck gave police.

Lenard said Martineck told police that Morphey helped carry a square container down the stairs of Peterson’s house and to the SUV. Morphey was adamant that he and Peterson carried a blue barrel.

Morphey was the only source of all of Martineck’s information about Morphey supposedly helping Peterson carry a barrel containing Stacy’s body down the stairs and to the truck.

Peterson faces a murder charge for allegedly drowning his third wife, Kathleen Savio. During the hearsay hearing, prosecutors are trying to prove he also killed fourth wife Stacy to keep her from testifying against him.

The state called 68 witnesses ranging from a minister to a mistress in hopes of getting 15 hearsay statements against Peterson allowed at his murder trial. Peterson’s attorneys have about 20 witnesses on tap, but may call one or possibly none if they can hammer out a written deal with prosecutors about what their testimony would entail if they took the stand.

That lone defense witness to actually appear might end up being Martineck. When contacted Tuesday, Martineck would neither confirm nor deny if he was subpoenaed by the defense to testify today.

Joel Brodsky, the longest serving of Peterson’s four attorneys, whose role in the case appears to have shrunk as the hearing progresses, failed to return calls for comment on whether Martineck would testify today. Charles B. Pelkie, the spokesman for the state’s attorney’s office, declined to comment.

The hearing is expected to conclude this afternoon with both the state and Peterson’s defense team expected to present their closing arguments.

Drew Peterson, the former Bolingbrook police sergeant, likely killed his 23-year-old wife Stacy using a chokehold in their bedroom on the Sunday morning family and friends first noticed she disappeared, Will County's top prosecutor said Friday.

State's Attorney James Glasgow, who referred to Peterson as a "knucklehead" and "hideous B-movie stalker," laid out for the first time a theory of how Stacy, who disappeared in 2007, was killed.

Glasgow's comments came during closing arguments in a unique pretrial hearing on whether hearsay statements can be heard by a jury in Peterson's upcoming trial for the 2004 drowning death of his third wife, Kathleen Savio.

A trial date will be set Tuesday, White said. White said he would issue a written ruling on the hearsay under seal, but it would be unsealed after jury selection.

Prosecutors said that in 2007 they found a red "alibi folder" in Peterson's home with unwrinkled receipts for cash purchases he made the day before Savio's body was found in a dry bathtub in her home.

The early hours of that Sunday are when prosecutors allege Savio was slain.

Peterson acted strangely the night Savio's body was discovered, sending four untrained neighbors into a home where an intruder could have been lurking instead of calling his fellow officers, Glasgow said. When Peterson heard a neighbor scream, he didn't run in with his gun drawn, as police are trained to do.

Though he was a trained evidence technician, Peterson touched Savio's body. And Glasgow alleged that after a neighbor wondered why there was no towel in the bathroom, Peterson planted one that later appeared in death scene photos.

In his closing argument, defense attorney Andrew Abood said prosecutors failed to show Savio's death, initially ruled accidental, was a murder or to link Peterson to her home at the time she died Abood said even if Judge Stephen White believes witnesses whose hearsay statements prosecutors hope to use, Savio herself had a history of lying.

He said a deposition Savio gave in 2003 for an insurance claim she filed alleging Peterson stole her wedding ring and jewelry contradicted her statements to several people that Peterson had threatened her the year before and told her he could kill her and make her death look accidental. Savio testified at the deposition that Peterson told her, "I could never hurt you," Abood said.

Drew Peterson's defense today tore into a prominent pathologist who declared that Peterson's third wife was killed, contending he was determined to reach the conclusion to please his bosses at Fox News.

During cross-examination, Michael Baden acknowledged that a producer for Fox News host Greta Van Susteren helped him with the autopsy on Kathleen Savio by taking photos and moving the body.

"One always needs an assistant during an autopsy and there was no one else available," Baden said under questioning by Peterson's attorney, Joel Brodsky.

Baden had testified earlier that he believes Savio was beaten up and then placed in the bathtub, where her attacker drowned her. Bruises to her body support his theory, Baden said.

The defense tried to downplay the bruises by suggesting they were the result of rough sex or clumsiness. While Baden conceded some could have been made that way, a few -- particularly a hemorrhage of the diaphragm -- was the result of blunt force trauma.

"You can get a lot of injuries from rough sex, but a hemorrhage of the diaphragm is not one of them," Baden said.

Under questioning by prosecutors, Baden had said it was highly unlikely for a healthy adult to drown in the bathtub. But when pressed by the defense, he conceded that it was equally rare for healthy adults to be killed in a bathtub.

"They're neck and neck," Baden said.

Savio's death was initially ruled an accident in 2004. After Peterson's fourth wife, Stacy, disappeared in 2007, Savio's body was exhumed. Baden was asked by her family to perform an autopsy.

In addition to Baden's testimony today, Will County Assistant State's Atty. John Connor testified that Drew Peterson killed Stacy to prevent her from testifying against him in divorce proceedings.

The testimonies from Baden and Connor were the culmination of three weeks of testimony in a hearsay hearing in Peterson's murder case. The hearing is to determine what hearsay evidence -- including statements prosecutors contend Savio made -- Judge Stephen White will allow a jury to hear.
Much of the testimony has been from nearly 70 witnesses witnesses called to bolster prosecutors' contention that Savio's death was a homicide and not an accident as it was originally ruled.

Peterson, a former Bolingbrook police sergeant, is charged with first-degree murder in connection with Savio's death. He is also a suspect in the disappearance of Stacy Peterson.

After his testimony, both sides are to give closing arguments.

Last week the Chicago Tribune reported that during Drew Peterson’s hearsay hearing, forensic pathologist Dr. Michael Baden testified about a somewhat unorthadox assistant at the autopsy of Peterson’s third wife, Kathleen Savio.

During cross-examination, Michael Baden acknowledged that a producer for Fox News host Greta Van Susteren helped him with the autopsy on Kathleen Savio by taking photos and moving the body. “One always needs an assistant during an autopsy and there was no one else available,” Baden said.

Steph Watts, now a freelance TV reporter and producer refuted this account of his participation on his blog yesterday stating:
It’s been interesting watching the media report the story of my alleged participation in the autopsy of former Bollingbrook police officer Drew Peterson’s third wife, Kathleen Savio.

For all of you who preferred to regurgitate inaccuracies, and didn’t take the time to simply call to check the facts, here they are:

It was through my work on Greta’s show, that we uncovered documents leading us to facts that questioned the original classification of Kathleen Savio’s death as an accident, and exposed egregious errors by the Bollingbrook Police Department, the original coroner and the coroner’s jury. Dr. Michael Baden agreed that the findings indicated Savio’s death was a homicide. After reviewing the same documents, the State Attorney’s office decided to exhume the body of Kathleen Savio and perform a second autopsy. The family of Kathleen Savio, weary of the State Attorney’s office, discussed with me having an additional private autopsy done, but knew they could never afford such an expensive endeavor. I took their interest to Dr. Michael Baden, and he volunteered his time. I was already in Chicago covering the case, and accompanied Dr. Baden on every endeavor while he was in town. I asked permission of the family to be in the room with Dr. Baden while the autopsy was performed, and they agreed. I agreed with the Savio family that I would only film Dr. Baden, and no images of the body would ever be filmed or aired. The family knew Dr. Baden would be reporting his findings, whichever way they concluded. During the autopsy, which lasted approximately 3 hours, I took extensive notes and shot video.
Watts states that he did not help move Kathleen Savio’s remains.

I never had any physical contact with the body of Kathleen Savio, nor participated in “performing” the autopsy in any way. There were a least 6 Illinois State Police troopers in the room at any given time, and the entire experience was handled with the utmost respect to the Savio family, and most importantly to Kathleen.

There is no magic wizard behind the FOX News curtain, pulling strings to influence the findings by one of the country’s finest Forensic Pathologists. In conclusion, if Drew Peterson’s defense attorney is basing his case on the fact that I was in the autopsy room of a woman his client likely murdered, I would suggest he size Peterson up for a few more of those fancy orange jumpsuits he seems to like so much.

Pathologist: Kathleen Savio died accidentally

JOLIET — Drew Peterson's defense team trotted out a doctor of their own to provide several theories on how Kathleen Savio might have accidentally died in her bathtub.

Jeffrey Jentzen, a forensic pathologist and professor at the University of Michigan, took the stand Wednesday as the first defense witness and testified that he concluded Savio was not the victim of a homicide.

"It's my opinion that it's an accidental death," Jentzen said. He made this decision after reviewing reports from three autopsies conducted on Savio's remains, police and coroner reports, and crime scene and postmortem photographs.

Ruling to be sealed


Jentzen's testimony came on the 17th day of the pivotal hearing to determine what hearsay evidence will be allowed at Peterson's upcoming murder trial. Peterson is charged with killing Savio, who was his third wife, in March 2004.

The state police insisted Savio's death was accidental and clung to this notion until Peterson's fourth wife, Stacy Peterson, vanished in October 2007.

State police suspect Peterson may have killed Stacy as well but have not charged him with harming her. Prosecutors are still trying to prove he did do her in to keep her from testifying against him.

When the hearing finally ends, Judge Stephen White will determine if any of 15 hearsay statements can be used against Peterson during his murder trial. State's Attorney James Glasgow on Wednesday confirmed that White will keep his decision under seal until the start of the trial.

Prosecutors called 68 witnesses to make their case, and have another in store for Friday, when celebrity medical examiner Michael Baden is scheduled to take the stand.

Baden performed the second of two autopsies on Savio's body after it was exhumed from Hillside's Queen of Heaven Cemetery in November 2007. The autopsy was broadcast on the Fox News Channel, a network Baden frequently appears on.

Accident theories


On Wednesday, Jentzen concurred with the findings of three other forensic pathologists — including Baden — in figuring that Savio drowned.

But Jentzen then unveiled a theory in which he said Savio might actually have suffered a heart attack and inhaled bathwater into her sinuses after she was already dead.

He also speculated that she may have slipped, fallen, hit her head, passed out and drowned, or possibly fainted before falling and hitting her head.

Drew Peterson's lead attorney, Joel Brodsky, also had trouble maintaining consciousness during Wednesday's hearing, as he repeatedly nodded off while Jentzen testified.

Morphey's friend


After Jentzen, defense attorney George Lenard called Walter Martineck to the witness stand. Martineck is a long-time friend of Peterson's stepbrother, Thomas Morphey, the man who claims to have helped Peterson dispose of Stacy's body.

Morphey testified on the second day of the hearing that he gave Peterson a hand carrying a blue barrel containing Stacy's body out of the Peterson home and to a waiting sport utility vehicle.

On Wednesday, Martineck said he remembered Morphey telling him he carried a rectangular "tote" and not a barrel.

Martineck also said Morphey was intoxicated and upset the night he told of supposedly carrying a container with Stacy inside and called his friend "a damn good person."

Peterson trial set for June 14

JOLIET -- Will County Circuit Judge Stephen White today scheduled jury selection in the Drew Peterson case to begin June 14, the Will County state's attorney's office announced.

Peterson, a former Bolingbrook police sergeant, is accused of killing his third wife, Kathleen Savio, in 2004.

Savio was found dead in a bathtub. Her death was first ruled accidental.

After Peterson's fourth wife, Stacy, disappeared, the Savio case was reopened. Authorities then determined her death was a homicide.

Peterson has not been charged in Stacy's disappearance.

Let's hope that a jury can be found that will bring justice for Kathleen, and the outcome of this trial results in new charges against Droopy for the unlikely dissappearance of Stacy...I don't believe that she would leave her children and not try to find out how they were doing...

Also, I was disappointed with Dr Baden in his wording where he testifies that someone from the Greta show helped him with the autopsy...

The article above dosn quote him so we have to go on the journalists perception of what was said, however the article suggests that Baden told the court someone from the greta show assisted him with the autopsy, and that he questions their character....

Of course this was alarming.. and looked like it suc have even been a mickey mouse autopsy, but Im glad Stpeh Watts explained himslef as being the photographer where he never touched the remains and only assisted. He noted that there were also 6 LE there for the entire time, which tells me he is telling the truth...
Also, his character is going to be irelevant as the pics and footage will not be something that can be twisted.... Its not like we wud have to take his word in anything. If the LE corroborate the story then I see nothing wrong with him helping the family for free, get this autopsy done where it is necessary to have someone filming...

JOLIET -- The break-up of Drew Peterson's legal team is starting to look almost as ugly as his messy divorce from the wife he allegedly murdered.

Andrew Abood, the Michigan attorney who bailed on Peterson Wednesday took some potshots at the Chicago lawyer who replaced him -- Joseph "the Shark" Lopez.

"Is that another self-proclaimed moniker?" Abood asked about Lopez's colorful nickname. Lopez insists that it is not.

"I had that name since I was a kid, even before I was a lawyer," said Lopez, who explained that it was his tenacious nature that earned him the handle.

Abood and co-counsel George Lenard pulled out of the Peterson defense team Wednesday. They cited "irreconcilable differences" with remaining lawyer Joel Brodsky. Lopez said Abood insisted on putting on an "alibi defense" when Brodsky wanted to claim Peterson's dead third wife perished in a freak bathtub accident.

"Brodsky knows exactly what to do in this case and they wouldn't listen to him," Lopez said.
Peterson case
Peterson faces murder charges for allegedly drowning his third wife, Kathleen Savio, in March 2004. The state police detectives charged with probing the case insisted Savio did indeed fall victim to an accident, but changed their tune when Peterson's next wife, Stacy Peterson, mysteriously vanished in October 2007.

When push came to shove, Peterson apparently stuck with Brodsky over Lenard and Abood.

"Drew and Joel are tied to the hip and very loyal," Abood said. He also thinks Brodsky and Lopez will make a good pair.

"I am sure Joel and Joe will get along really well and that is important," he said. "Thelma and Louise got along really well too -- and I hear Joe Lopez has a nice car."

"I do have a nice car," Lopez said of his Mercedes-Benz CL63 AMG. "It might cost more than Abood makes all year."

Abood pointed out that Lopez failed to acquit Peterson in a mock trial in which no evidence was presented (it ended in a hung jury), and insinuated that Lopez did not know his attorney registration number when he showed up to court. He also made reference to disclosing "to the press what likely would be considered privileged information" days after Lopez gave his first interviews about the Peterson case.

"He's a sissy, that's what he is," Lopez shot back. "He's a crybaby."

While there seems to be no love lost between Abood and "the Shark," Lopez said he "was sorry to see George go" and added that he and Brodsky are trying to lure a third lawyer onto their team.

"We'd like to bring in one other guy to balance it out," he said, declining to identify who that might be.

But even without another lawyer on board, the team has markedly improved in the experience department since he joined up, Lopez said.

"I've won more murder cases than (Abood's) got clients," he said.

"If he'd known what he was doing, he wouldn't have gotten booted."

JOLIET – Drew Peterson's substitute attorneys checked into the case Wednesday, with the number of lawyers working to keep him out of prison ballooning to six.

Steven Greenberg, Ralph Meczyk and Meczyk's partner, Darryl Goldberg, all filed to represent Peterson at his June murder trial.

Peterson is charged with killing his third wife, Kathleen Savio, in March 2004. He is also a suspect in the disappearance of his fourth wife, Stacy Peterson, who vanished in October 2007.

Peterson had been represented by Chicago attorney Joel Brodsky, local lawyer George Lenard and attorney Andrew Abood of East Lansing, Mich., until a few weeks ago, when Lenard and Abood jumped ship. Both attorneys cited irreconcilable differences with Brodsky, who insists he is Peterson's lead attorney despite taking a back seat to his two colleagues during a pivotal hearsay hearing earlier this year.

Chicago attorney Joseph "the Shark" Lopez replaced Abood and Lenard the same day they withdrew from the case. Brodsky's law partner, Reem Odeh, also is in on the case but has done next to no courtroom work on it in the near year since Peterson was arrested.

Joliet, Ill. - The way he's going, Drew Peterson's lawyers are going to outnumber the jury.

Another three attorneys filed Wednesday to represent accused wife killer Drew Peterson, doubling the size of his defense team.

The three newest members of Drew's crew are Steven Greenberg, Ralph Meczyk and Meczyk's partner, Darryl Goldberg, all of Chicago. Along with Peterson's self-proclaimed lead attorney, Joel Brodsky; Brodsky's partner, Reem Odeh; and flamboyant Chicago lawyer Joseph "the Shark" Lopez, they will attempt to fend off the murder charges facing Peterson at his June 14 trial.

Peterson allegedly drowned his third wife, Kathleen Savio, in March 2004. He is also a suspect in the disappearance of his fourth wife, Stacy Peterson, who vanished in October 2007.

When, following Stacy's disappearance, Peterson first fell under suspicion for murdering at least two wives, he hired Fred Morelli and Gary Johnson, who accompanied him to a November 2007 grand jury appearance.

But soon after his star turn in front of the grand jury, Peterson went on the "Today" show and begged for a lawyer to represent him on the cheap, saying, "Talking to lawyers Monday night, it could cost as much as a quarter million dollars to defend one of these cases. So, basically, I'm reaching out to attorneys of America for help. If anybody would like to take my case and help me out here, please call. Let me know what you can do for me. Help me out."

The man to lend Peterson a hand in his time of need turned out to be Brodsky who, according to sources with knowledge of Peterson's financial dealings, did indeed come at a bargain. Both sources said Brodsky agreed to take Peterson's case solely for the money they could generate through publicity.

Brodsky was later joined by attorney Andrew Abood of East Lansing, Mich. Local lawyer George Lenard, who also represents Craig Stebic, the husband of missing Plainfield mother Lisa Stebic, threw his hat in the Peterson ring in December.

Abood and Lenard bailed on Peterson earlier this month and blamed their departure on irreconcilable differences with Brodsky.

Despite insisting he was the lead attorney in the case, Brodsky's role on the defense team appeared to be overshadowed by that of Lenard and Abood during a pivotal hearing earlier this year to determine what hearsay evidence will be allowed at Peterson's trial. Odeh attended some of the month-long hearing but did not cross-examine a single witness.

Lopez filed to replace Lenard and Abood the same day they split from the case. He has called Brodsky the "coach" of Peterson's defense team.

JOLIET — For a man who had gotten in the habit of jetting to both coasts for TV appearances, entertaining offers to star in reality shows and welcoming media crews into his home for lavish photo shoots, Drew Peterson's last year has been a long, lonely one.

Locked up by himself for exactly 12 months today, about all the 56-year-old Peterson has to look forward to is his upcoming murder trial, slated to start June 14. And he does appear eager to see it start, said Pat Barry, spokesman for the Will County Sheriff's Department, which is the agency tasked with keeping Peterson in custody while he awaits his day in court.

"I think he figures he's going to get out," Barry said of Peterson's desire to see his case get under way.

The time Peterson has been doing has not been all that easy.

Since he was arrested for allegedly murdering his third wife, Kathleen Savio, Peterson has been held in the medical wing of the county jail. Sheriff Paul Kaupas' decision to stick Peterson in medical has nothing to do with any sort of ailment; the serial marrier and alleged wife killer was put there supposedly for his own safety.

Since he is in protective custody, Peterson spends his days in solitude but for the correctional officers whose job it is to guard him. Peterson sees no other prisoners, male or female, Barry said.

The loneliness seems to have worn Peterson down, as he has looked increasingly haggard when he has been brought to court for his numerous pretrial hearings in the year since he was arrested. But Barry said the jail's most famous inmate has not groused about his accommodations.

"To my understanding he's doing OK," Barry said. "He's not been complaining or anything."

Coping in prison

Joel Brodsky, one of the six attorneys defending Peterson against the murder charges, also said his client was quietly coping with his confinement.

"Drew's got no complaints," Brodsky said Thursday. "He's fairly content; he wishes he was home with his family, of course."

Peterson has his own toilet and shower, amenities Brodsky called "a luxury in jail." And while Peterson, whom Brodsky called "a very social person," is having a hard time in protective custody, his attorney understands why the jail administration wants him away from the general population.

"Jails house crazy people, so you never know," said Brodsky, who pointed out that Peterson's quasi-celebrity status might make him a target to other inmates. On top of that, as a former Bolingbrook cop, Peterson might not be the most popular man in the county jail, Brodsky said.

"There's some people out there who would consider it a notch on their belt, so to speak, to hit Drew," he said.

Though he is being held alone, Peterson can still have visitors, and was treated to the company of his former fiancee, Christina Raines, as well as that of another young woman in the early days of his incarceration, a source said. And more recently, five of Peterson's six lawyers, including Brodsky, dropped by Saturday to discuss legal strategy.

Trial date

Whether he has complaints about the county jail or not, Peterson has at least another month and a week to go in there before he gets in front of a jury, and possibly longer if either prosecutors or his own team of attorneys request and are granted a delay.

And both sides are still waiting for Judge Stephen White to rule on whether any of about a dozen hearsay statements will be allowed as evidence during Peterson's trial.

For their part, Joseph "Shark" Lopez, another of Peterson's lawyers, said he and his colleagues on the Drew Crew are primed to go.

"We'll be ready to rock and roll on this case," Lopez said.

Brodsky and Lopez declined to comment on the pending hearsay decision. So did Charles B. Pelkie, the spokesman for the state's attorney's office.

Pelkie did say that his office has received no official communications from the defense attorneys regarding postponing Peterson's date with justice and that prosecutors are gearing up as if everything is going according to schedule, saying, "We're moving forward with preparations for a June 14 trial."

JOLIET -- Prosecutors pushed to keep evidence in the Drew Peterson case under wraps. But after the way a batch of recently filed court papers were treated, the accused killer's lawyer wants to know why they bothered.

"That's pretty stupid; that's pretty bad," attorney Joel Brodsky said of descriptions printed on the sealed envelopes of seven secret court motions he filed in the past few days.

"If that's the way they're going to handle it, perhaps we should open up the whole file and let everyone see everything," Brodsky said.

Last week and Monday, Brodsky filed motions to quash the warrants used to search Peterson's home in the days after his fourth wife, Stacy Peterson, vanished in October 2007, and to exhume the grave of his third wife, Kathleen Savio, who was found drowned in a dry bathtub in March 2004.

Peterson faces a murder charge in connection with Savio's death, but there was a gap of more than five years and three autopsies between her dying and his arrest.

Despite Peterson and Savio engaging in a bitter divorce that was about to wrap up with Savio claiming hundreds of thousands of dollars in the couple's assets, state police insisted that she was the victim of a freak bathtub accident. The state police abruptly changed their tune after Stacy mysteriously vanished, and a year and a half later arrested Peterson for allegedly murdering Savio.

State police also believe Peterson may have had a hand in doing in the missing Stacy, but have yet to charge him with harming her.

Sealed motions

Peterson's murder trial is slated to start June 14, and Brodsky's motions included a request that the trial not include "any evidence that Kathleen Savio was fearful for her life or expressed to anyone any fears regarding physical danger from Drew Peterson," according to writing on the sealed envelope containing the court papers.

Several witnesses testified during an evidentiary hearing earlier this year that Savio did indeed fear for her life and that Peterson threatened not only to kill her, but to make her death appear accidental.

Another motion filed by Brodsky seeks to stop prosecutors from "utilizing items recovered from Drew Peterson's household, including the items showing he was in Chicago" the weekend before Savio's body was found. From what was written on the sealed envelope containing the motion, prosecutors want to use these items "in an effort to show a 'false alibi.'"

Another motion asks prosecutors to cough up "all statements made by (celebrity medical examiner) Michael Baden regarding this case including statements made while appearing on broadcast media."

Baden performed an autopsy on Savio's exhumed remains that was later shown on the Fox News network. Baden also testified as an expert witness during the evidentiary hearing held earlier this year.

Who wrote on envelopes?

Charles B. Pelkie, the spokesman for the state's attorney's office, declined to comment on the motions. As far as Brodsky's contention that the writing on the motions' envelopes violated the court-ordered seal, Pelkie said, "I've not seen them so I can't comment."

Brodsky blamed the circuit clerk's office for detailing the contents of the sealed motions.

"That doesn't sound like the clerk is obeying the judge's rule on confidentiality," Brodsky said.

Charles Squires, the chief deputy circuit clerk, said he could not discuss the matter.

"It's an ongoing case and I'm not able to comment," Squires said.

Ongoing case or not, Brodsky had plenty to say about it.

"If I'd known they were going to do that, I would have filed (the motions) regularly," he said. "That's ridiculous."

AJ, they do not allow cameras in the Illinois courtrooms.....

Illinois prohibits cameras in the courtroom, at least for trials. The fact that other states do it has not yet persuaded Illinois judges to permit televised trials.

Peterson motion to remove judge denied

JOLIET -- A motion made by Drew Peterson's defense team to get Will County Judge Stephen White taken off of Peterson's murder trial was denied Friday.

The defense also wants to postpone trial, from the scheduled June 14 start date to Aug. 23. The state did not object, but the judge seemed to be against the idea.

Whit said Friday he would rule on the move for postponement on Wednesday, June 2.

Peterson, a former Bolingbrook police sergeant, is charged with the murder of his third wife, Kathleen Savio, who was found dead in her bathtub in 2004.

I'm sure this comes to no ones surprise as just about every trial set for this month in the cases we follow has been delayed.

Judge delays Drew Peterson trial until July

JOLIET, Ill. -- A judge agreed Wednesday to reschedule the start of former Bolingbrook police officer Drew Peterson's murder trial for July 8, but made it clear this would be the final delay to the proceedings.

Circuit Judge Stephen White reminded attorneys that the trial, delayed from June 14, had initially been set for August last year.

"It's been continued and continued on your motion," White told Peterson's lead defense attorney Joel Brodsky during a hearing at the Will County Courthouse.

Peterson has pleaded not guilty to first-degree murder in the 2004 drowning death of his third wife, Kathleen Savio. Peterson also has been named a suspect, but isn't charged, in the 2007 disappearance of his fourth wife, Stacy Peterson. Peterson denies any involvement in her disappearance.

White had called more than 240 potential jurors to the courtroom months ago and told attorneys on both sides that the group had been admonished to avoid all media coverage of the case for long enough.

Brodsky argued that defense attorneys needed extra time because they had recently learned prosecutors planned to call three new experts to testify, including a pathologist.

Brodsky said the legal team has changed over recent months, including the departure of some attorneys and the addition of others. He said the new team needs time to analyze evidence, including technical scientific findings.

Brodsky originally asked for a delay until Aug. 23.

After voicing his objection to the judge's order that the trial begin July 8, Brodsky told reporters he thought the judge's refusal to delay the trial gave the defense strong grounds for appeal if Peterson was convicted.

"It's a constitutional issue, the Sixth Amendment right to counsel," Brodsky said.

Joe Lopez, one of Peterson's new attorneys, said he expects the trial to last two to three weeks. Both Lopez and Brodsky said no decision has been made on whether Peterson will testify.

Brodsky would also like to keep Peterson's television appearances (before his arrest) out of the trial proceedings.

That seems like a tall order, given the attention-seeking media sensationalist that Peterson is.

Judge denies delay request in Peterson case

une 24, 2010 (WLS) -- A Will County judge denied another motion to delay the start of Drew Peterson's murder trial.

The former Bolingbrook police officer is accused of killing his third wife, Kathleen Savio. Peterson is also a person of interest in the disappearance of his fourth wife, Stacey.

The judge will also meet with Illinois State Police to discuss what recently led them to search for Stacey's body in Peoria. He must decide if it is relevant to this case.

"If he finds it's relevant the state's going to be put to a position of one of two things. Either they can allow it to be released to us. Or if it's not released to us then they may have some trouble getting in evidence, certain evidence that may be relevant," said Joel Brodsky, Peterson's attorney.

Peterson's trial is scheduled to begin July 8th.

The judge overseeing the murder trial of Drew Peterson has agreed to allow a suburban pastor to testify about a conversation he had with Peterson’s fourth wife, Stacy.

His testimony is part of “Drew’s Law,” a ruling that allows some hearsay evidence to be presented at the trial, the Chicago Tribune reports.

The pastor, Neil Schori, will testify that Stacy Peterson, who has been missing since October 2007, told him that she provided a false alibi for her husband around the weekend when his third wife, Kathleen Savio, disappeared. But that’s all. Judge Stephen White won’t allow testimony about details of the night in question, when Drew allegedly broke into the home of Savio and held a knife to her throat.

Peterson is accused of killing Savio, but not Stacy Peterson, though he remains a suspect in her death as well.

Investigators originally labeled Savio’s death an accident. But subsequent autopsies helped rule her death a murder.

At least one of those autopsies has become a bone of contention in the trial.

Judge White says if a videotape of an autopsy on the body of Peterson's third wife isn't turned over to defense attorneys he may not allow the famous pathologist who conducted it to testify at Peterson's murder trial next month.

On Thursday, prosecutors told Judge White about the videotape, explaining it was made surreptitiously by television news producer Steph during Dr. Michael Baden's 2007 autopsy of Kathleen Savio Watts – and aired on Greta van Susteren’s Fox News show. The autopsy was conducted for Savio's family.

Not allowing Baden to testify could be significant because in February he testified that he believed Savio's death was a homicide and not an accident.

Two other pathologists testified. One agreed with Baden and the other backed the original finding that Savio's death was accidental.

(JOLIET) The celebrity medical examiner who prosecutors want to use as an expert witness chopped off Kathleen Savio's head and propped it on a table to be photographed during an autopsy, defense attorneys said Friday.

Joel Brodsky and Steven Greenberg -- two of the half-dozen lawyers representing accused wife-killer Drew Peterson -- presented pictures of Savio's severed head to witnesses during a Friday pretrial hearing and accused Fox News Channel medical examiner Michael Baden of decapitating her corpse for a photo opportunity.

A source familiar with the Savio case disputed this contention and explained that Savio's head came off on its own.

"Dr. Baden never removed the head during the autopsy," the source said. "There was very little connective tissue. There was massive decomposition."

Peterson's lawyers were trying without success to have Baden barred from testifying as an expert witness at Peterson's murder trial. Baden had performed a private autopsy on Savio, who was Peterson's third wife and one of two he is suspected of killing.

While state police believe Peterson also snuffed his fourth wife, Stacy Peterson, they have only charged him with murdering Savio.

He is set to go to trial in six days, and Baden, whose autopsy expenses were covered by Fox News, is cleared to testify.

Thanks for the update, J4A...can't wait for this to get underway...I just wish they could locate Stacy's remains...whatever is left of them...Maybe he'll cut a deal by telling them where he put Stacy if they will give him a lighter sentence in Kathleen's case...(that is of course if he's found guilty)...

At a pre-trial hearing this morning Judge Stephen White decided to allow pathologist, Dr. Michael Baden, to testify about the Fox News arranged autopsy of Kathleen Savio‘s remains at Drew Peterson‘s trial for murder.

Preliminary reports indicate that Steph Watts, a former producer who assisted Dr. Baden during the third autopsy, testified to some graphic details of the undertaking. Under questioning by Joel Brodsky, he denied that he was working on an HBO special about the autopsy. Watts also described how at one point Joel Brodsky approached him with a deal for a video package of Peterson at home with his fiancee, Christina Raines.

It’s been reported that the videotape shot by Watts has been produced for review.

Court was closed for arguments about a recent hearsay ruling that could make some of the barred hearsay statements admissible to the trial.

A celebrity pathologist who concluded Kathleen Savio was murdered in her bathtub can testify at Drew Peterson’s upcoming trial for the death of his third wife, a Will County judge ruled Friday.

Peterson’s attorneys had sought to block the testimony from Dr. Michael Baden, contending his work for Fox News swayed his medical opinion that Savio’s 2004 drowning death was a homicide.

So did having a Fox TV producer take notes for him during the autopsy--notes that also included a telephone number for media mogul Joe Francis, who produced the “Girls Gone Wild” videos, defense attorneys argued.

Judge Stephen White didn’t agree, telling prosecutors they can call Baden--a frequent Fox News contributor--to describe the autopsy he performed on Savio after her remains were exhumed in 2007.

“There’s no reason to bar this testimony,” White said as he made his ruling.

Baden autopsied Savio’s remains on Nov. 16, 2007, at the behest of her family. On a Fox News TV program later that day, he announced his conclusion that she had been murdered.

Two weeks before he performed the autopsy, Baden said on the same Fox program that it appeared that her death was a homicide, rather than an accident, as Will County officials initially had ruled.

After his ruling, White turned over to Peterson’s legal team DVDs from Fox News containing Baden’s TV interviews on the case.

Peterson’s attorneys had sought to bar Baden’s testimony as unreliable, contending in part that he had reached a conclusion before even conducting the autopsy. They also argued that his work for Fox TV left in question any medical opinion he offered about her death.

Former Fox TV producer Stephen Watts testified that he took notes for Baden during the autopsy, but disputed that he assisted Baden in shifting Savio’s body during the procedure or that he took pictures during the autopsy. Baden, during a pre-trial ruling earlier this year, testified Watts had given him that help during the autopsy.

“Dr. Baden was mistaken, absolutely,” Watts said Friday.

Watts also said he had Joe Francis’ phone number on the autopsy notes because he earlier had interviewed him about legal problems Francis was facing. Watts said he believes he jotted down Francis’ number after the autopsy while checking his voice mail.

Savio’s drowning initially had been ruled an accident, but authorities reopened their investigation into her death after Peterson’s fourth wife, Stacy, vanished in October 2007.

That led to Savio’s remains being exhumed, her death being reclassified as a murder and ultimately to Peterson, a former Bolingbrook police officer, being charged last year with her slaying.

After Friday’s hearing, defense attorneys downplayed the significance of Baden’s testimony, contending they could convince jurors his work was “not a scientific autopsy.”

“The jury will be able to figure out this was not a scientific autopsy. It was for a TV show,” defense attorney Joel Brodsky said.

Peterson, who has been jailed since his arrest in May 2009, is in “good spirits” with his murder trial scheduled to start on Thursday.

“He’s really looking forward to the start of this trial,” Brodsky said.

Do we know if Drew's trial still starts this Thursday, July 8?? I can't seem to find anything current confirming the trial start date.

Should be a doozy.

Judge Allows Savio Autopsy in Drew Peterson Trial

Drew Peterson's defense team was dealt a setback in court Friday when a judge denied their request to prevent a key prosecution witness from testifying.

Renowned pathologist Dr. Michael Baden was the first person to publicly declare that Peterson's third wife Kathleen Savio did not die accidentally but was in fact murdered. He conducted a private autopsy for the family after her body was exhumed in November 2007.

Defense attorneys questioned the credibility of Baden's findings because he allowed a Fox News Channel producer to take notes for him and video tape him in the autopsy room.

Savio's death was originally ruled an accident after she was found dead in a dry bathtub in 2004. Authorities reopened the case after Peterson's fourth wife Stacy disappeared.

"Dr. Baden goes there and he decides ahead of time what he thinks happens in this case and then he goes there and confirms his own findings. Now he's not gonna look very good if he goes on TV and says I was wrong before and this was an accident, so it's a self fulfilling prophecy," said Steven Greenberg, one of Peterson's lawyers.

Stephen Watts, the producer who formerly worked for On the Record with Greta Van Susteren testified that he never video taped Savio's remains and never touched them. Watts also made it clear that he only videotaped Baden during a break in the autopsy, and that Baden agreed to reveal his findings on Van Susteren's show, regardless of what they showed.

"As much as the defense would like to make something of it, because they allegedly have no case, my being in that room had absolutely no influence on the outcome, and as I've said before if the defense is hinging it's case on the fact that I was in the autopsy room, they better suit up Drew Peterson for those orange jumpsuits he seems to fancy so much," Watts said after the hearing was over.

Baden's conclusion that Savio's death was murder was corroborated by another pathologist who performed the official autopsy for prosecutors a day before Baden.

Peterson's attorney Joel Brodsky said he will have three or four of his own experts testify that the original autopsy was correct in classifying Savio's death as an accident.

Peterson was arrested for Savio's murder in 2009. His trial begins July 8th.

He has denied any involvement in her death or in the disappearance of his fourth wife Stacy Peterson.

Fysty, Illinois does not allow cameras in their courtrooms, so my guess would be no. That's why so many of the cases on truTV are from Florida. They are one of the few states who do allow cameras.

I guess we will just have to rely on some good reporting...
