The only contact 15-year-old Wayne Treacy had ever had with 8th grader Josie Lou Ratley before allegedly beating her nearly to death Wednesday was a brief flurry of text messages earlier that day, Florida police say.

Broward County Sheriff Al Lamberti told ABC News that eyewitnesses report Treacy didn't utter a word as he kicked the 15-year-old girl repeatedly with his steel-toed boots, "in the head, soccer style," until a teacher eventually pried him off.

"I think this is probably the first case of 'text rage' we've ever seen. We've had road rage before, but never text rage," said Lamberti.

Ratley was hospitalized with severe head injuries, and Treacy, who confessed the beating to police, has been charged with premeditated attempted murder. A hearing in Fort Lauderdale today will determine whether or not to try Treacy as an adult.

DEERFIELD BEACH, FL (WFLX) - Police arrested a second teen in the brutal beating of a middle school student outside of her school.

Investigators said a "texting war" between two teens sparked the vicious assault.

A 13-year-old girl and a 15-year-old boy have been charged.

Attorney Betsy Benson confirmed Thursday that her client, 15-year-old, Wayne Treacy, was being held after a judge determined there was probable cause to hold him on a charge of attempted murder. Treacy's next court date is March 26.

The Broward Sheriff's Office says Josie Lou Ratley was in critical condition.

Authorities say Treacy, who attends a nearby high school, came looking for her at Deerfield Beach Middle School Wednesday. He had been texting with a friend through Ratley's cell phone. The friend allegedly said something Treacy didn't like. He rode his bike five miles to the school to find her.

Authorities say Treacy punched the girl repeatedly, knocked her to the ground, kicked her and stomped on her face with steal toe boots. Ratley lost consciousness and could not defend herself. A teacher had to pull him away from her.

Josie's family launched a Facebook page for her.

That is totally disgusting. They need to lock that thug up and throw away the key. Does anybody think I need anger management given the fact that reading this story makes me want to put on a pair of steel toe boots and kick the hell out of Treacy?

No...J4A...I know exactly how you feel. Some days, while reading & adding to the site, I have to just take a break, play a game, listen to some music...ANYTHING but more reading. Today was/is...one of those days. I think Stricklands decision did me in, until I read this story. How horrible to just kick a girl to (almost) death! WTF is happening in our world? What's wrong with these kids? I just don't get it. Sad

DEERFIELD BEACH — As Josie Lou Ratley remained in a medically-induced coma Friday, stunned family members struggled to understand why someone she barely knew could become angry enough to allegedly try to beat her to death.

"She's not with us," said Ratley's aunt, Linda Sarmiento, describing the 15-year-old Ratley's condition at Broward General Medical Center. "She can't respond to us. She's in a coma."

Ratley was taken to the hospital Wednesday after Wayne Treacy, 15, a student at Deerfield Beach High School, attacked her at a Deerfield Beach Middle School campus bus stop, according to prosecutors. Treacy, accused of beating Ratley with his fists and stomping on her head repeatedly while wearing steel-toed boots, is in a juvenile detention center facing an attempted murder charge.

Ratley's mother, Hilda Gotay Ratley, scheduled a news conference Friday afternoon with the girl's aunt, the family's lawyer and doctors to discuss Ratley's condition. But she couldn't bear to leave her daughter's hospital room when the time came, the lawyer said.

"My baby should be home with me right now," she said through the lawyer, Rick Freedman. "Instead she is fighting for her life in a hospital bed."

Freedman and Emergency Room Pediatrician Mayra Dominguez described how doctors had to remove a part of Ratley's skull to allow her brain's swelling to go down. Dominguez said it's too soon to tell whether Ratley will suffer permanent brain damage and repeatedly declined to offer a prognosis.

Sarmiento said Ratley had recently moved from Crystal River and she didn't have a lot of friends. She is a gifted artist, although she has a slight learning disability, Sarmiento said, describing Ratley as a kind and protective girl who sometimes scolded family members for saying or doing "the wrong thing."

Because they haven't been able to speak to Ratley, family members can't confirm or explain news accounts about what led to the beating, Sarmiento said. According to the Broward Sheriff's Office, Ratley's cell phone was used by a 13-year-old friend to send text messages to Treacy, with whom the friend had a relationship.

But Ratley sent messages of her own to Treacy, expressing her disapproval of the relationship and making a "disparaging" reference to the October suicide of Treacy's brother, said Broward Sheriff Al Lamberti.

That remark incensed Treacy, who deliberately put on steel-toed boots, texted friends that he was going to kill Ratley, and rode his bicycle three miles from his home to Deerfield Middle to find Rately, the Sheriff's Office said. When he got to the campus, the 13-year-old friend pointed out Ratley, knowing Treacy intended to harm her, the Sheriff's Office said.

The friend was arrested Thursday on a count of accessory to attempted murder and was ordered held for 21 days in juvenile detention while prosecutors review the case. Her lawyer, Jonathon Marne, said the girl and Ratley were "best friends," and that her family wished Ratley a speedy recovery.

"It's news to us," Ratley's aunt said of the friendship. She knew nothing of the text messages other than what she read in media accounts, said it seemed out of character for Ratley to say something bad about someone else's suicide.

But Sarmiento did show some sympathy for Treacy's family, conceding that she thought of Treacy as a monster until she saw a television news account that pictured him and his weeping mother Thursday.

"Last night I felt sorry for him," she said. "I know his parents must be devastated themselves."

Freedman, speaking for Ratley's mother, urged South Florida families to use this incident as a "teachable moment" to discuss teen violence and prevention.

"Please say a prayer for Josie," he said. "And please have an age-appropriate discussion with your children about what happened to Josie. Speak to your children tonight. Communicate with them."

Ratley's family does not have health insurance, Freedman said. A directed trust account has been established at the Wachovia Bank in care of the Law Office of Gordon and Doner to benefit Josie Lou Ratley. Checks to the Josie Lou Ratley Fund can be dropped off at any Wachovia office or mailed to the Wachovia branch at 2989 PGA Blvd, Palm Beach Gardens, Fl, 33410.

I hope that Josie fully recovers from this savage attack.
The thug intended to inflict severe harm to Josie, and even deliberately put on steel-toed boots before going to find her. There should be additional charges filed against him. This was a planned attack, and he sent text messages to his friends saying he was going to kill this girl. If Josie dies, he should be convicted as an adult and sent to jail for life.

Medical personnel treating Josie Lou Ratley -- the 15-year-old Deerfield Beach girl beaten by a teen boy last week -- on Sunday removed her bandages, exposing rows of stitches from two surgeries to relieve pressure on the girl's brain.

She remained in critical condition and in a medically induced coma at Broward General Medical Center in Fort Lauderdale, according to Rick Freedman, her family's attorney.

Doctors are ``really feeling good about the strength of the rest of her body,' Freedman said. ``Now it's a matter of waiting.' Josie's family remains by her bedside.

She has undergone two craniotomies -- the first Wednesday night on the left side of her brain and the second Friday on the right side.

Her mother, Hilda Gotay Ratley, and aunt Linda Sarmiento are scheduled to appear on NBC's Today Show and CBS's The Early Show Monday morning, Freedman said.

Two teens, Wayne Treacy, 15, and Kayla Manson, 13, are being held in a juvenile detention center in connection with the attack last Wednesday at Deerfield Beach Middle School. The attack was prompted by an exchange of text messages.

The Broward Sheriff's Office said Treacy put on steel-toed boots, biked to the school and attacked Ratley in a bus area, kicking her in the head as many as seven times.

The boy, a ninth-grader at Deerfield Beach High School, had been messaging Ratley to try and reach his ex-girlfriend, Manson.

Ratley didn't approve of the relationship and had exchanged messages with Treacy, including a comment she made about Treacy's brother who had committed suicide in October. Treacy is charged with attempted murder. Manson is charged as a principal because she helped Treacy find Ratley, authorities say.

I hate how his attorney tries to "explain" why he did it. There is no excuse!

Has either of his parents spoke out yet? If he was the one to find his brother hanging from a tree he should have been in intensive counseling, that is very traumatic. I have to wonder what his home environment is like or if he has shown a violent nature in the past. It is still by no means any excuse for what he inflicted upon Josie. An intentional, extremely brutal attack. I continue to say prayers for Josie and her family. It's a miracle she is still alive.

Wayne Treacy took time to text friend in wake of horrific beating

Broward's top cop said accused text message beating suspect Wayne Treacy had time to coldly text a friend in the moments after he beat 15-year-old Josie Ratley within an inch of her life.

"In fact, he sent another text message to someone saying 'Hey, I think I'm going to prison, I think I just killed someone,' so it just was a matter of fact thing, like oh well, this is what it is," Sheriff Al Lamberti said during an appearance on this morning's "Today Show."

Appearing on the morning talk show, Lamberti spoke about the recent and disturbing wave of youth violence to hit South Florida and in particular the Deerfield Beach school attended by Treacy, Ratley and teen burn victim Michael Brewer.

"Just five months ago with the Michael Brewer case we thought we had seen everything," Lamberti said. "And here, five months later, we have another horrific event, we just can't explain it, we can't rationalize it."

The most recent event is the horrific attack last week, in which Treacy, 15, attacked Ratley over some text messages the two had exchanged.

Police said Ratley was punched, knocked to the ground and had her head repeatedly slammed on the concrete by Treacy, who stomped on the girl with his steel-toed boots.

Ratley remains in critical condition at Broward General Medical Center and in a medically induced coma as a result of the attack. She's undergone two surgeries to relieve pressure on her brain.

Photos released yesterday showed her laying in her hospital bed, her severely bruised and swollen face wrapped in bandages.

Treacy and his 13-year-old alleged accomplice, Kayla Manson, who police said pointed Ratley out to Treacy, are being held in a juvenile detention center.

Treacy will be charged with attempted murder.

"When I grew up, my dad told me you don't hit girls, and now, I called it a culture of callousness, because last time it was over a stolen bicycle and a video game, now it's over a text message with a person that he never even met, never saw," Lamberti said. "It seems like kids are not communicating like we used to. That art of communication isn't there."

Lamberti said that while law enforcement does all it can to prevent violence like this, people need to be proactive.

"Mr. Treacy is in custody, but that doesn't help Josie, it's what can we do before these problems occur, whether it's at home, school, churches," Lamberti said. "That's where we need to focus our efforts, by the time law enforcement gets involved, it's usually too late...we need to start early."

DEERFIELD BEACH, Fla. (CBS) The elementary school teacher who saved Josie Lou Ratley from a violent beating is speaking out about the shocking incident that left Ratley in a medically induced coma.

Walter Welsh says he was about 100 feet away from the bus stop when he noticed a commotion with a boy standing over a girl in the school bus area on campus.

"At first I thought they were playing," Welsh told CBS affiliate WFOR Monday. "His foot came down. Came down a second time. When I saw him cock his leg, he kicks her. I'm screaming, 'Stop!'"

Welsh says he ran over to Ratley and stopped Wayne Treacy before he was able to land the third kick. He realized that Ratley was gravely injured and told one of the other adults to call for an ambulance while he escorted Treacy to the school office.

Welsh told WFOR that he asked Treacy what he was thinking, and Treacy answered " 'She talked about my dead brother.'"

"What do you say to a 15-year-old who has that kind of hate?" Welsh asked. "I don't know."

Welsh says Treacy was crying when they got to the office, then he noticed Treacy's footwear.

"I said, 'Are those steel toed boots?' That's when he told me,'Yeah, they're steel toed boots,'" Welsh told the station. "I had to leave the room then, because I was a little bit disturbed."

The Ratley's family and their attorney, Rick Freedman, have been critical of the security on the school campus.

But Welsh said a premeditated attack is difficult to stop. "How do you anticipate something as heinous and savage as that, that's premeditated?"

"I'm 56-years-old, and I never seen anything like it," he said. "If you see the girl, tell baby girl to open her eyes and smile one more time. Tell her mother I'll always be sorry I didn't get their faster. That's all I can say."

911 tapes released in brutal attack on Deerfield Beach girl

Authorities on Monday released the 911 tapes from the day a 15-year-old was attacked at Deerfield Beach Middle School.

The 911 call starts with a worried woman who urgently needs paramedics and police.

"I have a high school student that actually created injury to this child," she says.

The injured child is 15-year-old Josie Lou Ratley, a student at Deerfield Beach Middle School. The accused attacker, Wayne Treacy, 15, is with the unidentified woman in a school office.

The Broward Sheriff's Office released the 911 calls from the day of the attack on Monday.

The caller describes Treacy's clothing: black shirt, blue jeans, black gloves and a black hat.

At one point, she stops talking to the dispatcher to tell Treacy, "Put down your phone. Put down your phone now."

She asks for paramedics, then adds that she needs law enforcement as well.

BSO spokeswoman Veda Coleman-Wright said by that point, BSO deputies were there, including the school's resource deputy, and were responding to the scene outside.

Treacy is charged with attempted murder. He was a ninth-grader at Deerfield Beach High School.

Another middle school student, 13-year-old Kayla Manson, is charged as a principal because, investigators say, she led Treacy to Ratley.

Ratley is at Broward General Medical Center in Fort Lauderdale, where she is in critical condition after two craniotomies.

On Monday, her mother spoke for the first time.

Her voice shaking, Hilda Gotay Ratley told NBC's Today show, "All I know is my baby's in the hospital."

Ratley's family also released pictures of her in the hospital. They show the teenager swollen, bruised and hooked up to machines. Deep purple stitches run down two sides of her face.

Police: Friends knew of teen's plans to beat up Deerfield Beach girl, but no one warned her

Before viciously beating and kicking Josie Lou Ratley, the 15-year-old accused in the attack told friends his intentions.

"I'm coming over there and I'm gonna snap your neck,' Wayne Treacy wrote the victim, said Broward Sheriff Al Lamberti.

But as far as investigators can tell, no one sent in a warning about the Deerfield Beach Middle School student's being in danger, the Broward Sheriff's Office told reporters Tuesday.

"A handful of people knew about it,' BSO Sgt. Steve Feeley said, "and nobody did anything about it.'

Under its "Silence Hurts' campaign, the Broward school district allows students to submit anonymous tips -- by phone, text message or online -- about bullying, threats or anything else that makes them feel unsafe.

The phone line has received about 115 tips since August, said district spokesman Eddie Arnold.

School officials discussed procedures they have in place to protect students after a hastily called news conference to discuss safety in schools following another act of youth violence in Broward County on Tuesday.

Earlier in the day, while their school bus pulled into McNicol Middle School in Hollywood, boy, 14, punched his ex-girlfriend, 12, in the face several times and fractured her nose, according to Hollywood police.

The boy was arrested and charged with aggravated battery and obstruction without violence, police said. He has a prior history of violence on campus, according to the arrest report.

The Herald is withholding his name because of his age and the nature of the charge.

Tuesday's beating was the most recent in a string of savage attacks involving students in the school district.

Deerfield Beach beating victim Josie Lou Ratley, still in a medically induced coma a week after being attacked at a school bus stop, received a hospital visit recently from a former classmate who knows a few things about being a survivor.

Michael Brewer, who is recovering from being set on fire and who once shared a science class with Ratley at Deerfield Beach Middle School, visited Ratley on Tuesday at Broward General Medical Center.

“She’s my friend,” Brewer said, according to family spokeswoman Terri Lynn. The visit was a private meeting between families, Lynn said. “Their message was, ‘We’re here for you. We know what you’re going through.’ ”

Ratley, 15, was waiting for a school bus on campus March 17 when prosecutors say Wayne Treacy, 15, attacked her without warning, striking her and stomping on her head while wearing steel-toed boots. Ratley remains in critical condition.

Treacy faces a first-degree attempted murder charge and is being held in a juvenile detention center. Also being held is a 13-year-old who prosecutors say knew Treacy intended to harm Ratley and led him to the victim.

Last October, Brewer was set on fire by a group of schoolmates at an apartment complex near the school, authorities said.

Brewer suffered burns on over two-thirds of his body and, like Ratley, spent time in a medically induced coma.

The family and attorney for 13-year-old Kayla Manson spoke out for the first time on Thursday, telling NBC's "Today'' show that Manson had no idea Wayne Treacy was going to brutally beat her friend, Josie Ratley.

"We believe she absolutely had no idea this was going to happen," attorney Jonathon Marne said.

Police say Treacy attacked Ratley while Ratley stood in the bus area at Deerfield Beach Middle School on March 17. He kicked her in the head up to seven times while wearing steel-toe boots, according to the Broward Sheriff's Office.

Investigators charged Manson as a principal because, they said, she knew Treacy intended to hurt Ratley and pointed her out to him.

Marne said he believed there were inaccuracies with BSO's version of events, although he did not give specifics.

Manson's family described her as a good girl who was friends with Ratley. Throughout the interview, pictures of the two girls flashed on the screen. They showed the two laughing, smiling and posing for cellphone pictures together.

"The whole situation is just unbelievable for both girls,'' said Manson's grandmother, Lori Wiggins.

Manson lives with her aunt, Tristine Stott, and helps care for Stott's disabled son. Since the attack, Manson has worried about Ratley's condition, Stott said.

Ratley is at Broward General Medical Center in Fort Lauderdale, where she is in critical condition after two craniotomies.

Treacy and Manson are being held in a juvenile detention center.

Authorities say the attack was prompted by an exchange of text messages.

Treacy, a ninth-grader at Deerfield Beach High School, had been messaging Ratley to try and reach Manson.

Ratley didn't approve of the relationship and had exchanged messages with Treacy, including a comment she made about Treacy's brother, who committed suicide in October.

Treacy is charged with attempted murder.

Lawyers and the Broward Sheriff's Office have been barred, for now, from talking publicly about the case against Wayne Treacy, the Deerfield Beach High School student accused of trying to kill a girl over an insensitive text message.

Broward Circuit Judge Elijah Williams issued an order stopping prosecutors, the Broward Sheriff's Office, defense lawyers and a civil attorney from releasing details about the allegations against Treacy, 15, who is in a juvenile detention center facing an attempted murder charge.

Treacy's lawyer, Assistant Public Defender Betsy Benson, is seeking a permanent gag order after seeing "repeated, chronic and in-depth national and local coverage" of the case, which has been featured on NBC's Today Show and CNN's Larry King Live.

A hearing on Benson's request is scheduled for April 6.

In her motion, Benson expressed concern that too much potential evidence in the case has been made public, threatening Treacy's right to a fair trial. She specifically mentioned text messages allegedly sent by Treacy before and after the assault as well as photographs of the victim, Josie Lou Ratley, 15, a Deerfield Beach Middle School student who has been in a medically induced coma for more than a week.

Broward Sheriff Al Lamberti told The Today Show that after the attack, Treacy "sent another text message to someone saying 'Hey, I think I'm going to prison, I think I just killed someone.'"

Ratley's family released pictures taken of the bruised and comatose from her hospital bed at Broward General Medical Center. Family lawyer Rick Freedman said Ratley's mother wants people to use what happened as a "teachable moment" and to see the results of teen violence.

"Wayne Treacy's due process rights will be fundamentally compromised," Benson wrote in her motion. She said the released information would taint a jury pool and foster a "lynch mob type mentality in the community" against her client.

Also on Thursday, family members and a defense lawyer representing a 13-year-old girl accused of being Treacy's accomplice appeared on The Today Show, saying Treacy may have been able to identify Ratley without the 13-year-old's assistance.

Freedman said Thursday that the Ratley family is more concerned with her recovery and educating the public about teen violence. In an earlier interview, he and Ratley's mother declined to discuss text messages and other aspects of the case that have been made public.

According to the Sheriff's Office, Treacy became upset when Ratley sent him a text message with a "disparaging" reference to Treacy's dead brother.

"The Broward Sheriff's Office and Sheriff Lamberti have been no more, or less, open and responsive in this case than in any other," said Sheriff's Office spokesman Jim Leljedal. "We believe in the public's right to know and try to be as responsive as possible without jeopardizing our investigations. In this case we have declined more interviews than we granted."

Classmates at Deerfield Beach High School show sympathy for beating suspect

No justification for the assault or the texts that provoked it, say friends of Wayne Treacy

Deerfield Beach Wayne Treacy is a ninth-grader who takes his studies seriously, but his friends say has a sweet and funny side as well. Last fall, he went through a personal tragedy no one would want to endure, finding his older brother, who had committed suicide, dangling from a tree.

Now the 15-year-old Deerfield Beach High student is in juvenile detention, accused of stomping on a girl's head with his steel-toed boots with such brutal force that a week and a half later, she remains in critical condition in a medically inducted coma. And Treacy's friends are left to struggle with the question: Why?

Treacy is accused of trying to kill Deerfield Beach Middle School student Josie Lou Ratley, 15, after she sent him a series of text messages, at least one of which referred to Treacy's dead brother. Investigators have not released the contents of those messages, other than to say they were "disparaging."

Two of Treacy's friends, Kayla Williams, 14, and Perry Phillips, 15, said there was no justification for the assault on Ratley, but no justification either for the text messages that preceded it, which they believe provoked Treacy. Other friends, who did not want to be named for this article, made similar comments.

"Everyone has buttons that can be pushed," said Williams, who has known Ratley since the beginning of the school year last August. She called him "sweet, funny and nice," but acknowledged that he can sometimes take things "really seriously."

Phillips, who is in a Japanese class with Treacy, said he's a "funny guy" who does his work but is not consumed by it. Treacy, friends said, is in the school's International Baccalaureate magnet program, an accelerated learning curriculum that often allows its graduates to enroll at state-run universities as sophomores.

But he was also haunted, his lawyer said at one point, by the death of his brother, Michael Bell, 30, who hanged himself from a tree outside a Pompano Beach church around the time of Treacy's birthday last October. It was Treacy who found him.

Parry Aftab, an Internet safety expert and advocate against cyberbullying, said teenagers often feel safe communicating some feelings by text messages that they would never express to someone's face. Ratley, she said, may not have realized "how far she'd gone" in angering Treacy.

By then it was too late, investigators have said. Treacy is accused of beating Ratley to the ground and stomping on her head repeatedly. Ratley has been at Broward General Medical Center since the March 17 attack.

Members of Treacy's family have declined interview requests, and lawyers in the case are under a gag order.

Treacy's friends acknowledge he has anger management issues. Phillips said Treacy once stepped away from her to regain his composure after she playfully hit him. That exhibition of self-control led Phillips to say this week that she would not have thought Treacy was serious when he told others he wanted to kill Ratley, as investigators have alleged.

"I would think it was just something he was saying," Phillips said. "I'd be concerned for him, but I would not have taken it as a serious threat."

Aftab said cyberbullying is a real phenomenon, but not one that should justify attempted murder. "If somebody calls you names, you're not allowed to hit them," she said. "That excuse didn't work in kindergarten, and it's not going to work now."

DEERFIELD BEACH, Fla. -- Josie Ratley's family went to Broward General on Sunday hoping she would open her eyes.

Ratley, who police said was savagely beaten by 15-year-old Wayne Treacy, been in a medically-induced coma for almost two weeks.


Doctors were trying to bring the girl out of the coma when she began to run a high fever. As a result, they returned her to the fully-induced coma.

The family's attorney told Local 10 that loved ones are crushed.

"They were so hopeful that their beautiful Josie would be waking up by now," said Rick Freedman, the family's attorney. "They are now coming to the realization that this is going to be a marathon event."

Lawyer: Teen beating victim has brain damage

FORT LAUDERDALE — Deerfield Beach beating victim Josie Lou Ratley suffered brain damage, cannot breathe on her own, is fighting off pneumonia and likely will lose some use of the right side of her body, her family's lawyer said Wednesday.

Speaking at Broward General Medical Center, the Fort Lauderdale hospital where Ratley, 15, is being treated, attorney Rick Freedman said she suffered damage to the left side of her brain and is on life support.

Deerfield Beach High School student Wayne Treacy, 15, is charged with attempted murder in the March 17 assault on the campus of Deerfield Beach Middle School, where Ratley is an eighth-grader.

Investigators said Treacy attacked Ratley, stomping on her head with steel-toed boots. According to a search warrant obtained by the Sun Sentinel, Treacy told a Broward Sheriff's detective that "he committed this act of violence in retaliation for several text messages that the victim allegedly sent him earlier in the day in which she allegedly made fun of his deceased brother."

Treacy's brother committed suicide last October, and it was Treacy who found him hanging from a tree outside a Pompano Beach church.

Freedman also said at the Wednesday news conference that Ratley's family has been touched by the outpouring of support from the community. Residents across South Florida are organizing fundraisers to help Ratley's family with current and future medical bills, Freedman said.

Students at Deerfield Beach Middle School raised $1,000 by holding a car wash. A group of Miami students donated the proceeds of a Teen Violence Prevention Week bowling event. And a private school in Lighthouse Point offered to enroll Ratley at no charge.

The money is going into a restricted account, the Josie Lou Ratley Fund, maintained by Wachovia Bank. The funds can only be used for medical expenses or, if Ratley does not survive, her funeral expenses, Freedman said.

In prepared remarks, Freedman said Ratley was "violently assaulted" and that her family went through a period of "anger toward the suspect for what he is accused of having done to her." Otherwise, he steered clear of discussing the criminal allegations against Treacy. He did not mention Treacy by name and made no reference to the 13-year-old girl who is being held as an accomplice in the beating.

A gag order imposed last week bars lawyers and law enforcement from discussing the case. Treacy is being held in juvenile detention until prosecutors decide whether he should be tried as an adult.

Two fundraisers for Josie Lou Ratley are being planned for next weekend. The West Broward Community Church is holding a "wildlife adventure" on April 10 from 10 a.m. to 5 p.m. on the church grounds at 17950 Griffin Road, Southwest Ranches.

CJ's Drafthouse is holding a family event on April 11 from noon to 4 p.m. outside the restaurant at 1825 W. Hillsboro Blvd., Deerfield Beach.

"Even in lean times, you've got to give back to the community," said CJ's co-owner Chris Nettles. "We're fortunate enough to have an up-and-running business. These people don't even have health insurance."

I am so saddened to hear they have confirmed she has brain damage. The body can do amazing things and with the neurosurgery being so advanced, I was hoping she'd rebound from the surgeries. Hopefully she can fight off the pneumonia, get stronger and breathe on her own, miracles do happen.

School beating victim moves in bed.

Beating victim Josie Lou Ratley showed a sign of progress on Easter Sunday, her family's lawyer said.

The 15-year-old girl is starting to move "slightly" in her bed at Broward General Medical Center, Rick Freedman said in a news release. Also, doctors are trying to get Ratley to breathe on her own, though still with the aid of a ventilator.

Her mother, Hilda Gotay Ratley, was at her bedside with an Easter basket holding favorite things — a large stuffed bunny, art supplies, bling jewelry, a princess crown and chocolate.

Ratley has been in a medically induced coma for 18 days since she was attacked on the campus of Deerfield Beach Middle School.

Wayne Treacy, 15, is charged with attempted murder in the March 17 incident. He allegedly stomped on Ratley's head with steel-toed boots.

According to investigators, Treacy retaliated against Ratley over text messages she sent him about his brother, who committed suicide in October.

FORT LAUDERDALE, Fla. -- For weeks, the Ratley family has waited, watched and prayed for a miracle over their 15-year-old daughter, Josie Lou.

On Easter Sunday, they got one.


Josie and her mom love creating Easter baskets every year. This year, Hilda decided to fill up Josie's basket with a gigantic Easter bunny along with several art supplies including acrylic paints, paint brushes, markers, colored pencils, bling jewelry, a princess crown, and her favorite candy, Hershey's chocolate.

It's the first time her mother has smiled in weeks.

"It all just came together today," said family attorney Rick Freedman.

Freedman said doctor's are beginning to ween the teenager off coma-inducing drugs and Ratley is beginning the process of waking up.

"The left side of her body started moving -- the leg, the arm, and the hand. The eyes are open just a slit and the breathing is somewhat on her own," said Freedman.

The slight movement marks the first since mid-March.

Ratley was waiting at a school bus stop when according to detectives, 15-year-old Wayne Treacy threw her on the ground and kicked her head with steal toe boots. Investigators said the attack happened after a text messaging argument.

Treacy remains behind bars while Ratley struggles to regain consciousness.

The Ratley family wants to thank all those that have sent their best wishes and prayers for Josie's speedy recovery and wishes everyone in South Florida a Happy Easter.

Wayne Treacy, the Deerfield Beach High School student accused of trying to kill teenager Josie Lou Ratley over an insensitive text message last month, is "extremely concerned" about her condition and deeply regrets the incident, his lawyer said Tuesday.

Private attorney Russell Williams, taking over the Treacy case from the Public Defender's Office, described his client as "devastated" and remorseful over the March 17 assault on the campus of Deerfield Beach Middle School. Prosecutors say Treacy bicycled three miles to find Ratley, 15, then beat her to the ground and stomped on her head with steel-toed boots.

Ratley remains in a medically induced coma at Broward General Medical Center.

Williams said his client was tearful at a court hearing Tuesday morning. Courtroom deputies stood in front of the 15-year-old suspect for much of the hearing, largely blocking him from the view of the public.

"He is, for lack of a better word, a mess," said Williams. He said Treacy wishes for Ratley's recovery and often asks how she's doing.

Rick Freedman, a civil attorney for Ratley, said he appreciated the words of goodwill from the suspect, though they might be difficult for Ratley's family to accept. Doctors are continuing to withdraw the coma-inducing drugs from Ratley and are hopeful she will be off them soon. At that point, Freedman said, waking up will be up to Ratley.

"The next 24 to 48 hours are crucial," Freedman said.

Prosecutors have until April 19 to decide whether Treacy will be charged as an adult or as a juvenile. The defense lawyer told Broward Circuit Judge Elijah Williams (no relation) that he is lining up mental health experts to evaluate Treacy.

Outside the courtroom, the attorney said Treacy did not remember everything about the beating of Ratley. While he did not say Treacy "blacked out" during the incident, he also did not dispute that characterization.

Investigators believe Treacy was angered by text messages he received from Ratley's phone that allegedly mocked the suicide of Treacy's older brother. Another girl, 13, is accused of helping Treacy find Ratley at a school bus stop.

Treacy's new lawyer also withdrew a motion asking for a gag order in the case.

FORT LAUDERDALE — Beating victim Josie Lou Ratley is moving and her eyes are opening, although she remains in a medically induced coma and doesn't respond to commands yet, her mother said Wednesday.

Hilda Gotay Ratley told NBC's "Today" show that her 15-year-old daughter is "doing great," but doctors at Broward General Medical Center won't know the extent of any long-term damage until she gets a little better.

Josie Ratley began breathing on her own Tuesday night and was taken off a ventilator, Ratley attorney Rick Freedman said.

Ratley was beaten at Deerfield Beach Middle School on March 17 while she waited for a bus.

Wayne Treacy, 15, is accused of kicking her in the head with steel-toed boots after she sent him a text message that enraged him, authorities said. He is charged with attempted murder.

Asked if she was concerned that her daughter wouldn't completely recover, Hilda Ratley said: "Sure I'm worried. I want my baby the way she was."

Ratley said she wasn't satisfied with a statement by Treacy's lawyer Russell Williams, who on Tuesday described his client as "devastated" and remorseful over the attack. She said she has not heard any apology from the boy's family.

"I mean, do they have any feelings?" she said. "Do they think about Josie?"

Freedman sat beside her during the television appearance. He repeated that the beating was a chance for parents to talk to their children about "the proper etiquette in terms of how to post on Facebook and how to send a text message."

Doctors were continuing to withdraw the coma-inducing drugs and hoped Ratley would be off them soon, Freedman said.

Prosecutors have until April 19 to decide whether Treacy, a Deerfield Beach High School student, will be charged as an adult or as a juvenile.

FORT LAUDERDALE — Awake since at least the weekend, beating victim Josie Lou Ratley was sitting in a wheelchair Wednesday morning, showing signs that she not only recognizes her mother, but also wants to cuddle with her, the teen's doctor and lawyer say.

Dr. David Lasko and attorney Rick Freedman told reporters at Broward General Medical Center that they were encouraged by Ratley's progress, but their enthusiasm is tempered by her latest brain scan, which shows severe injuries in an area that affects her ability to communicate and walk.

"Unfortunately, the results of that testing has confirmed their worst fears," Freedman said.

Lasko said Ratley, 15, has limited functioning in her right arm, hand and fingers, but has shown some physical responses whenever she recognizes her nurses and her mother.

The doctor said their voices seem to have a calming effect on the teenager.

"She has made a steady and slow and remarkable improvement," said Lasko. "She's a remarkable young woman."

Lasko avoided sounding too optimistic.

"In neurological injuries, it's very difficult to tell where the endpoint will be. The fact that she has made such a steady progress, especially in the last couple of weeks, gives us a lot of hope to where she can go to," he said. "Her potential for recovery is unlimited at this point, but we still don't know where the endpoint will be."

Ratley will have to undergo another major surgery to repair part of her skull. Family members were expected to start scouting recovery and therapy centers Wednesday.

Ratley has been in the hospital since March 17, when police say Wayne Treacy tracked her down at Deerfield Beach Middle School, knocked her to the ground and repeatedly stomped on her head with steel-toed boots.

Doctors put Ratley in a medically induced coma. Last week, she was weaned off the coma-inducing drugs and opened her eyes for the first time. A recent Facebook posting was the first indication that she is awake, and the first major step in what's likely to be a difficult recovery.

Doctors said two weeks ago that Ratley would likely suffer long-term brain damage as a result of the brutal beating, Freedman said. She underwent two surgeries to relieve brain swelling.

Lasko said it was difficult to explain when exactly Ratley came out of the coma, considering she had been under heavy sedation. He said she's now under few sedatives.

Treacy, 15, is facing an attempted murder charge. Prosecutors have until Monday to decide whether to try him as an adult or keep him in juvenile detention.

Investigators said Treacy was enraged when he received a text message from Ratley's phone that he said made fun of the death of Treacy's older brother, who committed suicide last October.

FORT LAUDERDALE — Wayne Treacy will be tried as an adult for the attempted murder of Deerfield Beach Middle School student Josie Lou Ratley, who was kicked in the head with steel-toe boots as she waited at a bus stop on campus, prosecutors said Friday.

Treacy, 15, was formally charged with premeditated attempted murder Friday in the March 17 attack and will be arraigned Saturday, said Assistant State Attorney Maria Schneider. He is being moved from a juvenile detention center to a county jail.

The decision comes as no surprise to Treacy's lawyer, Russell Williams, who said two days earlier that he did not expect his client's case to remain in the juvenile court system.

Treacy faces a maximum prison term of life in prison if convicted.

Ratley, 15, had been in a medically induced coma at Broward General Medical Center. She recently regained consciousness but has suffered brain damage. She is unable to speak.

Authorities said Treacy was reportedly incensed by a text message sent from Ratley's cell phone.

Williams admits his client's role in the incident, and Treacy's parents have apologized to the Ratley family on national television. They said Treacy snapped when he received a text message referring to his brother, who committed suicide last October, and they want him examined by mental health experts.

Earlier Friday, Kayla Manson, the 13-year-old girl charged as an accomplice in the attack, was charged as a juvenile and released from custody.

Her lawyer, Daniel Callahan, declined to discuss the case against Manson, who is accused of pointing Ratley out to Treacy, who went on to beat Ratley and repeatedly kick her in the head.

"The only thing we want to convey on behalf of her and her family is our deepest sympathy and prayers for Josie," Callahan said.

Manson formally pleaded not guilty to a charge of principal to attempted murder on Friday.

Prosecutors said she is too young under Florida law to be charged as an adult for anything less than a capital crime. In this case, that could only happen if Ratley does not survive.Staff writer Tonya Alanez contributed to this report.

this brought tears to my eyes.

i pray for josie and her family. i am relieved to know that they are charging this little monster as an adult.

dont tell me he didnt know right from wrong, he lost his brother, that is sad, but he knows what it feels like to have someone ripped from your life, and he commenced in trying to beat a poor defenseless girl to death.

Wayne Treacy, the 15-year-old accused of severely beating another teen at a Deerfield Beach school bus stop, was denied bond Saturday.

County Court Judge Jill Levy arraigned Treacy in the brief hearing via video. Treacy, wearing an orange jumpsuit, was in the adult jail. His lawyer, Russell Williams, told him to remain quiet.

Treacy was charged as an adult Friday with attempted murder in the March 17 attack of Deerfield Beach Middle School student Josie Lou Ratley.

If convicted, Treacy faces a maximum of life in prison.

Ratley, 15, had been in a medically induced coma at Broward General Medical Center. She recently regained consciousness but suffered brain damage and is unable to speak.

"The first time I saw [Treacy] smile was when I told him [Ratley] was sitting up in a chair and out of bed," Williams said outside court Saturday.

Authorities said Treacy was incensed by a text message sent from Ratley's cell phone.

Williams conceded his client was at the scene of the crime, and Treacy's parents have apologized to the Ratley family on national television. They said Treacy snapped when he received a text message referring to his brother, who committed suicide last October, and they want him examined by mental health experts.

"You had a rational 15-year old who at some point after his brother's death became irrational," Williams said. "Something snapped in his head."

Treacy should be arraigned in 30 to 45 days and will plead not guilty, his lawyer said.

Josie Ratley Scheduled For Surgery On Monday

FT. LAUDERDALE (CBS4) ― A Deerfield Beach teen severely beaten by another teen near a bus stop at her middle school is scheduled for surgery on Monday.

Doctors removed part of 15-year-old Josie Ratley's skull after the March 17th attack to help relieve pressure caused by the swelling of her brain. Monday afternoon doctors will perform surgery to repair part of her skull that was damaged in the attack. After more than three weeks of being kept in a medically induced coma to aid her recovery, Ratley woke last Sunday.

In a picture released by her attorney Rick Freedman, Josie is seen in a wheelchair with her mother by her side. Doctors say while she has made slow and steady progress Josie is unable to speak, walk and must use a feeding tube because she can't swallow.

"Josie is now awake and doctors have conducted a series of exams and tests on her. Unfortunately, the results of that testing have confirmed their worst fears. Josie has experienced a traumatic brain injury. The area of the brain that has been most damaged is to the area that includes the ability to communicate. Josie cannot speak, Josie cannot walk and Josie has limited function in her right arm, right hand and right fingers," said Freedman at a news conference last Wednesday.

Pediatric surgeon Dr. David Lasko said Josie has made slow but steady and remarkable improvement since the beginning of her stay her, and described her as a "remarkable young woman."

Wayne Treacy, the 15-year-old teen accused of attacking Rately, has been charged as an adult with attempted first degree murder; on Saturday he was denied bond.

After Treacy received the text message from Ratley which upset him, he allegedly sent a text message to a friend saying he was going to kill her, according to BSO. He then rode his bike to Deerfield Beach Middle School wearing steel-toed boots and asked 13-year-old Kayla Manson to point her out to him.

When she did, BSO investigators say he assaulted Ratley at a bus stop, kicked her in the head and beat her unconscious before a teacher pulled him off.

Manson has been charged in connection with the beating. She entered a not guilty plea to a charge of principal to attempted murder on Friday morning and will be released from custody. Manson will be prosecuted as a juvenile.

I know this is a terrible thing, but I think Ratley is also partly to blame. Wayne is only 15 years old, and I'm sure losing his brother to suicide has affected him mentally also. Kids are very cruel, and Josie should not have texted anything to him regarding his brother.

I raised my 2 grandchildren after their daddy murdered their mom. When the oldest one was in the 7th grade, kids were always saying things to him like, 'son of a murderer' and he became very upset and would try to beat up everyone who said anything. Naturally, he was the one that got in trouble, because he was fighting, and nothing is ever done for the 'words' that were said to him.

I feel sorry for Josie as her life will never be the same, but I also feel sorry for Wayne, as his life will never be the same either. Someone should be held responsible for the harmful words that were texted to him. I don't think he should be tried as an adult either. Maybe I am wrong, and from everyone's comments I must be, but I have a soft spot in my heart for Wayne and his family.

Sitemama, I agree that what Josie said was wrong, but I don't think any words justify what happened to her. I doubt that your grandson would want to do anything more than beat up the kids that were teasing him. It probably didn't cross his mind to really try to kill somebody. Wayne made his intention to kill Josie clear to his friends through text messages, then put on steel-toe boots and rode his bike several miles, punched her down to the ground and proceeded to bash her head into the concrete and kick her in the head several times with his steel-toe boots.

I was probably too harsh in my comments earlier in this thread, but it was the viciousness of the attack that made me angry. I wish Josie had been more sensitive and not mentioned the suicide of Wayne's brother. I don't even know what kids that young are doing with cell phones, especially in school and with text messaging enabled. This is just a senseless tragedy that never would have happened if any of the players in this case would have exercised common sense.

Just hours before daughter Josie Lou Ratley was scheduled to undergo yet another brain surgery, the mother of the Deerfield Beach teen beating victim said she's staying positive that her daughter will get back to normal.

Hilda Gotay Ratley, mother of 15-year-old Josie, appeared on the "Today Show" Monday morning, accompanied by a new video that shows her daughter awake and moving.

"It was fantastic, it just took my breath away when she was able to actually look at me and took her left hand to reach me to hug me," Hilda Ratley said, talking about the moment Josie awoke from her medically induced coma last week. "It was a great, great feeling."

The brain surgery, scheduled for later Monday, is just the latest for the teen who has been in the intensive care unit of Broward General Medical Center since the brutal March 17 attack that nearly killed her.

Doctors said last week that Josie Ratley had suffered extensive and traumatic injury to her brain, and that they have no idea how much she'll improve long term.

"They say she's a good candidate, that it's going to take a long haul," Hilda Ratley said. "Little by little, we don't really know what she's going to be capable of yet.

"It's all been positive thinking."

Hilda Ratley said Josie still can't walk or speak and she's been crying a lot in the hospital and may not remember the attack.

"She's confused and she does not know why she's there, that's why the crying comes in," Hilda Gotay said. "She has a lot of headaches, too."

On Friday, 15-year-old Wayne Treacy, accused of beating Josie Ratley, appeared in court where he was charged with attempted murder as an adult.

Treacy, who had spent the days since the attack at a juvenile detention center was transferred to a Broward County jail.

Treacy is accused of attacking Ratley at a bus stop outside of Deerfield Beach Middle School, slamming her head on a concrete sidewalk and repeatedly stomping and kicking her while wearing steel-toed boots. He became enraged, police said, after Ratley sent him a text message.

Ratley's friend, 13-year-old Kayla Manson, was charged as an accomplice in the attack, but she will be tried as a juvenile. She allegedly pointed Ratley out to Treacy, who had never met the girl before.

Ratley attorney Rick Freedman, who also appeared on "Today" Monday morning, said he agrees with the prosecutors' decision to charge Treacy as an adult.

"So far, I think they've made the right decisions in terms of charging," Freedman said. "We're sure that they're gonna make the right decisions and ultimately that Wayne Treacy gets what he deserves."

Hilda Ratley said she's focused on her daughter's recovery.

"It's in God's hands, and so far, so good," she said.

Josie seems to be coming along pretty well. I am so happy for her & her family. I didn't think she was going to make it when it first happened. I certainly hope that justice gets served in this case.

The 15-year-old boy charged with attempted murder in the beating of a 15-year-old Josie Lou Ratley outside a South Florida middle school entered his plea Wednesday.

Wayne Treacy pleaded not guilty to the adult charge of attempted murder.

Treacy is accused of attacking Ratley outside Deerfield Beach Middle School on March 17 and kicking her in the head with steel-toed boots. He is being held without bond in the Broward County Jail.

Ratley remains in the pediatric intensive care unit at Broward General Medical Center.

She suffered brain damage and has undergone several surgeries. Recently she was taken out of a medically induced coma, however on Monday she endured another operation to reattach a portion of her skull.

A 13-year-old girl accused of being an accomplice in the attack has been released to the care of her mother. She is being charged as a juvenile and is expected back in court on May 17.

Search Warrant Executed at Home of Deerfield Beach Beating Suspect
Treacy's attorney believes some evidence taken could help his defense.

Deputies carried out a search warrant at the trailer where 15-year-old Wayne Treacy lived with his mother and stepfather, seeking computer equipment and finding a document described only as what has been described as a "will".

Broward Sheriff's spokesman Jim Leljedal confirmed that deputies served the warrant at 8 a.m. Friday.

Treacy's lawyer, Russell Williams, knew not of the warrent, but insists that evidence may have been siezed that could help his client's defense.

Treacy is accused of trying to kill 15-year-old Josie Lou Ratley, over a alleged text message exchange in which Ratley allegedly made a reference to Treacy's dead brother. Investigators already have a warrant for the content of those text messages and evidence that Treacy bicycled three miles on March 17 from his home to Deerfield Beach Middle School, where he found Ratley and beat her so badly that she suffered brain damage and remains hospitalized and heavily sedated at Broward General Medical Center.

Treacy's activities that day included texting others with his intention, investigators have said.

Williams said he was troubled by the warrant in part because deputies removed a computer that contained privileged communications between himself and Treacy's parents. Although Treacy is the client and has been charged as an adult, he is legally a minor and his parents are his custodians.

Williams also wants to see the "letter/will" that was taken from the house. A will written by Treacy could serve as an indication of the teen's mental state, Williams said. Williams has signaled a mental health defense for his client, who formally pleaded not guilty to a charge of first degree attempted murder earlier this week.

He is being held without bond in the main Broward County jail in Fort Lauderdale.
