DA Reopens Case of First Missing Child on Milk Carton

A new push is on to find out what happened to Etan Patz, who disappeared at age 6 more than three decades ago and became the first missing child to have his face featured on a milk carton.

On May 25, 1979, Etan vanished on his way to school in downtown Manhattan, sparking a national effort to find his abductors and changing the way missing child cases are investigated.

Manhattan district attorney Cyrus R. Vance agreed to reopen the case this week, making good on a campaign promise to try to bring suspect Jose Antonio Ramos justice. Ramos is suspected of abducting and murdering the child. Former district attorney Robert Morgenthau has said for years that the case lacked enough evidence to pursue. The body was never found.


Etan Patz was 6 when he disappeared on May 25, 1979.

Etan was declared legally dead in 2001, but his parents never gave up on pursuing the case.

"I'm very pleased to hear that he's publicly stating that he's willing to reopen the case and do some investigation -- this is a big change from the previous administration under Mr. Morgenthau," Etan's father, Stan Patz, told The Wall Street Journal.

Stan Patz, a professional photographer, used photos of his son to help in the search. In the months and even years after Etan's disappearance, images of the smiling, blond boy were everywhere, from "missing" posters in the Patzes' SoHo neighborhood to the sides of milk cartons in homes across the country. That tactic has worked in subsequent child-abduction cases but failed to bring Etan home.

But Etan's parents and investigators who have worked on the case think they know who killed him. Ramos, a convicted child molester, has long been the main suspect in the case. His girlfriend sometimes baby-sat for the Patz family.

"I'm quite pleased that the DA's office sees fit to reopen the investigation, and hopefully they'll also see fit to indict and convict Jose Antonio Ramos for the abduction and murder of Etan Patz," federal prosecutor Stuart GraBois told ABC.

A 2004 civil trial found Ramos guilty of Etan's abduction and murder, and a State Supreme Court judge ordered him to pay the Patz family $2 million. The family never received a penny, according to The Wall Street Journal.

In the 1980s, Ramos even made a partial confession to GraBois.

"How many times did you have sex with Etan Patz?" GraBois once asked Ramos point blank. GraBois said Ramos seemed ready to confess. "I'll tell you everything," he reportedly said at the time. But since then, Ramos has denied any role in Etan's abduction and murder. He is serving time in prison for molesting an 8-year-old in Pennsylvania.

Ramos is up for parole in 2012, but Stan Patz, who is 68 now, hopes reopening Etan's case will keep Ramos behind bars. "We're hoping to get a bunch of New Yorkers up in arms saying, 'Hang the bastard!' Patz told the New York Daily News this month. "Get the pitchforks out."

May 25, the date Etan disappeared, is now designated National Missing Children's Day. According to the National Center for Missing and Exploited Children, 800,000 children go missing every year in the United States.

The morning of May 25, 1979, was hectic at the New York City home of Stanley and Julie Patz. They lived in a converted loft in Manhattan's Soho district, pioneers in a section of the city that would later become the place-to-be for New York trendsetters. Soho had been Manhattan's manufacturing zone, characterized by block after block of 19th century, iron-fronted factories standing shoulder to shoulder. On overcast days it was easy to imagine the gloomy sweatshop conditions of old New York, but in the 1970s, a fair number of these buildings were dark and empty, and the streets were desolate and forbidding at night. Still, people were making their homes in the neighborhood, breathing new life into it. Artists were first drawn to the area, attracted to the large, open spaces and cheap rents. Stanley Patz, a photographer, and his wife Julie lived in a loft on Prince Street with their three children: Shira, then age 8; Etan, 6; and Ari, 2.

Julie ran a day-care center out of her home. On the morning of May 25, as was her routine, Julie got her own children ready for the day as she prepared for the 14 preschoolers she cared for. As Julie dished out breakfast for her family, little Etan started agitating to walk himself to the bus stop again. He'd been asking if he could for some time now. A six-week school bus strike had just ended; the buses were scheduled to resume service that day. During the strike, the Patzes had hired a woman to walk Etan to school, but now that the buses were back, Etan pleaded with his parents to let him walk the two blocks to the bus stop by himself. Etan was a good boy, and it was a close-knit neighborhood where the residents watched out for the children, so the Patzes gave in and told him he could walk to the bus stop like a big boy.Etan was elated. He was dressed all in blue that day—blue pants, blue corduroy jacket, and blue sneakers with distinctive fluorescent stripes along the sides. He carried a blue cloth bag with an elephant pattern on the fabric. And as usual he was wearing his black "Future Flight Captain" pilot's cap, which covered his straight, light-brown hair. He pulled it down low over his brow, shading his blue eyes. He wore his prized cap all the time, even to bed. He'd bought it at an outdoor flea market for 10 cents.

New York authorities are investigating the claims of a man who has told investigators that he had a role in the 1979 disappearance of Etan Patz, the 6-year-old boy who vanished in SoHo on his way to school and is believed to have been murdered, officials said on Thursday.

“An individual now in custody has made statements to N.Y.P.D. detectives implicating himself in the disappearance and death of Etan Patz 33 years ago,” Police Commissioner Raymond W. Kelly said in a statement issued early Thursday. “We expect to provide further details later today.

Etan's parents have never moved. Since they didn't find any evidence when they dug up that basement, I hope this Pedro Hernandez will bring some long awaited answers for his parents.

Man Claims He Strangled Patz and Put Body in Box, Police Say

Published: May 24, 2012

A man in custody in Manhattan has confessed to strangling Etan Patz, the 6-year-old boy who vanished in SoHo on his way to school in 1979, wrapping his body in a bag and putting it in a box, a law enforcement official said on Thursday.

The man, Pedro Hernandez, told investigators that he left the box at a location in Manhattan, but when he returned several days later the box was no longer there, the official said. Investigators recently took Mr. Hernandez to that location. A second official also said that Mr. Hernandez told the authorities he had strangled the boy and discarded his body.

Mr. Vance said in 2010 that he would reopen the case, which focused national attention 30 years ago on the problem of missing children and began a new era marked by children’s faces on milk cartons and made-for-television dramas about kidnapped children. President Ronald Reagan declared May 25, the day of Etan’s disappearance, as National Missing Children’s Day.

Etan (pronounced ay-tahn) vanished on his way to a school bus stop 33 years ago Friday. The case drew international attention and changed the way parents felt about letting their young children go off alone.

Police announced Thursday that Pedro Hernandez had told them he lured Etan into a bodega where he worked, near the boy's house, and attacked the child, choking him to death in the basement.

A former bodega stock clerk arrested for allegedly luring 6-year-old Etan Patz off a SoHo street and strangling him in a basement has been placed on suicide watch at a hospital as a precaution, NBC 4 New York has learned.

Pedro Hernandez, 51, was arraigned from Bellevue Hospital via video feed on a single charge of second-degree murder. The charge comes 33 years to the day that Patz disappeared off a SoHo street in a tragic case that mystified New York City for decades.

The anniversary of 6-year old Etan Patz’s disappearance from SoHo has fallen on the Friday of Memorial Day weekend before.

On that first Friday May 25, back in 1979, it was a cool, misty day. By early evening, more than 10 hours after Etan was last seen, hundreds of police officers were out in full force when the rain started. By the time bloodhounds were finally brought in Saturday morning, authorities were resigned to the fact the trail had probably gone cold, washed away down the neighborhood’s gutters.

Now, we are being told that if the dogs had followed the trail, it would have led to a bag containing Etan’s broken body, sitting mere blocks from the Patz loft.

Investigators find child's clothes, toy at Patz 'killer' home

MAPLE SHADE, N.J. -- – Detectives have found an old toy and worn clothing that are "age appropriate" for Etan Patz hidden in the New Jersey home of the boy's confessed killer.

NYPD investigators planned to test the items for DNA -- and hope they will serve as key evidence in the murder case against 51-year-old former SoHo bodega stockboy Pedro Hernández, sources told the Post.

Cops were stunned by the discovery on Wednesday as they executed a search warrant at Hernández's home in Maple Shade, near Camden.

This is such a sad case. My daughter just started 1st grade that year and we didn't hear many cases like that then. All of us young mom's were scared. I hope the Patz family will finally know for sure what happened. I am concerned of course about prosecution because of Hernandez's mental health. I also have wondered if this confession is true is there only one child abduction and murder ? I would like to hear an experts opinion. Hernandez lives about 15 miles from me in NJ. Creeps me out. Peace to the Patz's.

Suspect In Etan Patz Case Transfers Jails

The man accused in the killing of Etan Patz has been transferred from Rikers Island to the Manhattan Detention Complex.

Pedro Hernandez was being held at Rikers Island since June 27 after previously being held at Bellevue Hospital's psychiatric ward.

Investigators returned to the lower Manhattan basement today where first-grader Etan Patz was allegedly murdered in 1979, the latest attempt to find clues in a case that has gripped and haunted New York City for 33 years.

Police removed several large bags of material from the site where Patz's accused killer told investigators earlier this year that he killed the boy.

Police in May arrested Pedro Hernandez, 51, a former bodega stock clerk who claimed he killed the blond 6-year-old. He told cops he lured the boy into the store's basement, steps from the Patz family home, and strangled him.

Hernandez has an IQ of just 70 and a mental disorder similar to schizophrenia that leaves him unable to differentiate between fact and fantasy, the lawyer said.

Prosecutors also lack any forensic evidence to corroborate Hernandez’s admission, according to the defense attorney.

“There is no evidence, you know,” said Fishbein.

“What there is are these words, a story as told by Pedro Hernandez...it’s inconsistent and it’s unreliable.” ...."

It was the summer of 1975, and she was a photo intern at The Village Voice, working under the brilliant and fearsome Fred McDarrah. “I wasn’t one of those people who shot tons of film — I never owned a motor drive — and I do remember a lot of what I shot. I was standing at the corner of Houston and LaGuardia, and I remember this bunch of happy kids, with the woman pushing the stroller, the way they were holding hands.” She says she thought it was a nice photograph but nothing extraordinary, and the negative went into a file, where it sat for 36 years.

A ratty-looking Jose Ramos is seen on tape volunteering to a Bronx prosecutor in 1982 that he was closely connected to the missing-child case while being questioned after allegedly trying to lure two young boys into the drainpipe he was living in.

He was also found to have a series of photos of young boys in his creepy dwelling, including one of an Etan lookalike....."

The convicted pedophile who was a longtime suspect in the Etan Patz case told FBI investigators he was with a boy named “Jimmy” the day Etan went missing, a top agent testified Friday.

Retired agent Mary Galligan said Jose Ramos made the wacky claims on May 31, 1991, when she visited him in prison.

Ramos, serving time for molesting a child, referred to his former bad self as “old Jose,” Galligan said.

It was the “other” Jose who was in Washington Square Park with “Jimmy” the day Etan disappeared.

He conceded it could have been Etan and told investigators he put the boy on a train for Washington Heights, Galligan said.

Galligan said she and her colleagues did not buy his story — and suspected he was responsible for whatever happened to Etan.

Jury in Etan Patz Trial Tells Judge It Is Deadlocked

".....Justice Maxwell Wiley of State Supreme Court directed the jury of seven men and five women to keep deliberating and to try harder to reach a verdict, saying he did not believe another jury would do better and noting it was not uncommon for juries to become deadlocked in complex trials.

“Given the nature of this case, I don’t think you have considered this case long enough to conclude you cannot reach a verdict,” Justice Wiley said, as the weary, sober-faced jurors listened.

Lawyers for the defendant, Pedro Hernandez, 54, moved for a mistrial, arguing that the jury had clearly reached an impasse and that the judges’s instruction to keep trying amounted to coercion. Justice Wiley denied the motion.

“They have reached a dead end,” the lead defense lawyer, Harvey Fishbein, said outside court. “The fact they can’t render a verdict at this point tells me they can’t do it, and to try to coerce them into it after 10 days is wrong.”

The jury’s note was the latest twist in protracted and complex deliberations, during which the jurors asked to rehear days of testimony from several witnesses. They also requested a spreadsheet program to help organize jurors’ thoughts about more than 50 witnesses and 200 pieces of evidence.

Earlier Wednesday, in a signal of how much difficulty the panel was experiencing, the jury sent another note to Justice Wiley asking the court reporters to read back to them the closing statements of both sides. Each statement took a full day to deliver.

The judge told the jury he was willing to let them hear the closing arguments again if they believed it would help them reach a decision. Under court rulings, the judge has the discretion to let the panel hear the statements a second time, even though they are not considered legal evidence, like the testimony of witnesses. “That’s something that can be done,” he said.

The central question facing jurors is simple: Did Mr. Hernandez tell the truth when he confessed in May 2012 after a daylong interview with the police to having throttled Etan in the basement of a SoHo store more than three decades earlier?...."

Jury deliberations to resume Thursday in New York child murder trial

On its 11th day of deliberations on Wednesday, the jury in state Supreme Court in Manhattan sent a note to Justice Maxwell Wiley asking to rehear the lawyers' summations. But before the judge could answer, the panel sent a second note saying it was deadlocked.

"We the jury after 10 days of deliberation, want the court to know that we are unable to reach a unanimous decision," the note read.

Wiley ordered the panel to keep working, and agreed to allow the reading of closing arguments, which took lawyers two days to deliver during the trial.

The defense, hearing that the jury had said it was deadlocked, moved for a mistrial. The judge denied the motion.

Hernandez's defense attorneys have put the blame for the boy's disappearance on Jose Ramos, who dated a Patz family babysitter and was long considered the prime suspect.

Ramos is serving a prison term after being convicted of sexually abusing boys.

During closing arguments, prosecutors used PowerPoint slides to show jurors quotes from witness testimony, as well as photographs of the alleged crime scene.

Defense lawyers also presented exhibits from the trial, including photographs of the store where Hernandez worked, police documents from the 1979 search for Patz and excerpts of the video confession made by Hernandez.

If the jury stalemate holds and a mistrial is declared, the prosecution will have to decide whether to retry the case.

The ruling came after 18 days of deliberations when one of 12 jurors said he was not unquestionably convinced Pedro Hernandez was the killer.

Hernandez confessed to killing Etan Patz, the New York City boy whose 1979 disappearance changed the way the US handles reports of missing and abducted children....."

The boy went limp, but was still alive when he disposed of the body, he said.

'He was still gasping,' Hernandez said.

Three members of the church prayer group testified against Hernandez, recounting his tearful confession at the end of a daylong summer religious retreat in 1979.

The defense had tried to put blame on Jose Ramos, who dated a Patz family babysitter and was long considered the prime suspect. Ramos is serving a prison term after being convicted of sexually abusing boys.

A judge found Ramos legally responsible for the death of Patz in a 2004 civil suit brought by the Patz family....."

Missing child case which has gripped America for 37 years is finally solved as killer is convicted of murdering six-year-old boy as he walked to school for the first time


".... Pedro Hernandez has been found guilty for the murder and kidnapping of Etan Patz.

The verdict was handed down by a jury around noon Tuesday, nine days after the began deliberations in the case.

Hernandez, 56, was convicted of felony murder and acquitted of intentional second-degree murder by the jury, meaning that the jury believed he did mean to kill the boy.

The convicted killer, who is now facing a possible sentence of life in prison, showed no signs of emotion as the jury read out their verdict on Tuesday.

Etan, 6, vanished while walking alone to school for the very first time on May 25, 1979 and his face was one of the first on milk cartons. ...."

He was found guilty of killing the boy in February in a retrial after his first trial in 2015 ended in deadlock.  ..."
