Kansas, Aug 25, (THAINDIAN NEWS) Alicia DeBolt, a teenage girl of Great Bend has been missing since last Saturday. The police of Great Bend has left no stones unturned to find the missing girl, but she has not returned home yet. Fourteen year old Alicia DeBolt is 5 feet 4 inches tall and weighs 118 pounds, her family says. The Kansas Bureau of Investigation has released a missing child poster yesterday seeking information about her.

The friends and family of the girl reports that she was last seen on Saturday, around 11 p.m. Great Bend Police Chief Dean Akings said that five agencies are involved in the search and the investigators have conducted a minimum of 50 interviews since last Sunday. The Police Chief said that he is worried because of the length of the time she has been missing. Holly DeBolt, Alicia DeBolt’s sister in law said that she left her house to go a party in southeast Great Bend with a 19-year-old male friend. Her mother Tammy DeBolt said that Alicia DeBolt told her plans before leaving home. However, after that she did not meet her friend. Great Bend Police Detective David Bailey said that her family filed a missing report on Sunday morning.

The case of the missing girl took an unexpected turn when police found a dead body outside of Great Bend. However, Police says that the body is undefinable so they will perform an autopsy for the identification. Alicia DeBolt’s father said that on Saturday night while leaving home she left her purse so the missing girl did not have anything that would help to identify her. However, the family of the missing girl said that Alicia DeBolt is not a runaway.

Police, KBI looking for missing teen

Local authorities have enlisted the help of the Kansas Bureau of Investigation in locating a teenage Great Bend girl missing since Saturday night.

Alicia DeBolt, 14, was last seen at about 11 p.m. Saturday when she left her house to go to a party in southeast Great Bend with a 19-year-old male friend, said Holly DeBolt, Alicia’s sister-in-law. Alicia had outlined her plans with her mother Tammy DeBolt before leaving their home at 910 Stone.

Shortly after, she failed to meet a friend of hers at a convenience store on east 10th Street, Holly said.

According to Great Bend Police Detective David Bailey, the family reported Alicia missing late Sunday morning. The Great Bend Police Department is following up on several leads, but "we are having some problems locating her."

The case didn’t qualify for an Amber Alert since Alicia willingly got into the vehicle. However, Bailey said the GBPD contacted the KBI which issued a state-wide media alert.

Alicia Danielle DeBolt is five-foot-four, weighs 115 pounds, and has brown hair and blue eyes. She was wearing blue jeans shorts, a white T-shirt with the word "Haters" on it over a teal tank top, and white high-top sneakers with neon colors on the sides.

Monday would have been Alicia’s first day at Great Bend High School as a freshman. She was a cheerleader and missed a GBHS Panther Booster Club dinner Sunday night, an event that was very important to her, Holly said.

Update: Breaking News! Just moments ago the man reportedly named a person of interest in the case of murdered cheerleader Alicia DeBolt has been found after a statewide alert was issued. We are awaiting details.

News is flying fast out of Great Bend, Kansas, as the investigation gears up into who murdered 14-year-old cheerleader Alicia DeBolt. Law enforcement has reportedly just named 36 -year-old Adam Longoria a person of interest in her murder, warning the public of a “danger concerning his behavior.” Just last night, law enforcement served a search warrant on Longoria’s home and reportedly seized a vehicle belonging to his wife.

Hours later police issued a statewide alert for Longoria, saying he stole a vehicle sometime after 2 A.M. from the Venture Corporation, the company that owns the asphalt plant where Alicia’s body was found badly burned. Police describe Longoria as 5’7” 160lbs, with brown hair and brown eyes. He’s believed to be driving a 2002 Ford Explorer with a “Venture Corporation” logo on the doors in red lettering. Police ask anyone with information to call the Kansas Bureau of Investigation at 1-800-KS-CRIME or, if you are in close proximity, dial 911.

GREAT BEND, Kan. (CBS/KWCH) The Kansas Highway Patrol says a statewide alert has been issued for a man who they believe has connections to Alicia DeBolt, the Kansas14-year-old whose body was found Tuesday.

Authorities believe 36-year-old Adam Longoria stole a 2002 white Ford Explorer.

The vehicle has Kansas plate number UGJ 366. The word "Venture" is written on both doors in red lettering.

The vehicle was taken from the Venture Company some time Friday morning.

Longoria told CBS affiliate KWCH that he was questioned in the DeBolt case and a search warrant was executed at his home Thursday evening.

DeBolt was found dead in Great Bend days after she went missing. Her body was severely charred.

Anyone with information on her disappearance is urged to contact the Great Bend Police Department at 620-793-4120.

GREAT BEND, Kan. (CBS/KWCH) Adam Joseph Longoria was taken into custody Friday morning; he is described as a "person of interest" in the death of Kansas 14-year-old Alicia DeBolt.

Longoria, also known as "Rocco," was caught by the Kansas Highway Patrol on I-70 near Salina, about 80 miles away from Great Bend, according to CBS affiliate KWCH.

Longoria was allegedly driving a 2002 white Ford Explorer which was reported stolen from Venture Corporation near Great Bend early Friday morning.

Longoria is currently being held in Barton County on a warrant for the stolen vehicle.

DeBolt went missing Saturday, August 21. Her parents said that she left their Great Bend home around 11:00 pm to go to a party, but did not come home at her midnight curfew. Her body was found burned just outside town days later.

Thursday, authorities served a search warrant on Longoria's home. In an interview, he told KWCH that he was taken in for questioning, but allowed to go home once the police search was complete.

A statewide alert was issued for law enforcement to be on the lookout for Longoria Friday morning.

GREAT BEND - Kansas Attorney General Steve Six confirmed Thursday that the body found Tuesday near Great Bend is that of 14-year-old Alicia DeBolt.

Six said that the body had been burned.

"The case is being treated as a homicide," he said.

So far, the investigation indicates that the death is "not a random act of violence,'' Six said. He wouldn’t elaborate or discuss the cause of death.

Alicia, an incoming freshman at Great Bend High School, left her home about 11 p.m. Saturday with a 19-year-old male friend to attend a party, according to initial reports. She was supposed to return by midnight.

A relative notified authorities about 1 p.m. Sunday that she was missing, Six said.

You say where are the parents, I say at least her daughter told her truth about where she was going and didnt lie. If your curfew is midnight on the weekends like MANY other high school freshmen, you are allowed to leave before midnight but have to be back at midnight. Why are you pointing fingers at the mother, Tammy, who JUST lost her ONLY biological daughter and by the way raised TWO step children successfully through the TEEN years. They used reside in Hays KS where I was friends with their older daughter. Its the NAIVE who cry where was her mom, well at least Alicia didnt have to lie to go out and was truthful and didnt say I am going with so and so to a late movie who knows what would have happened then.

Tragic, Alicia died a horrible death. My thoughts and prayers go out to her family.

He states he only met her once and it was mistakenly rumored the party was to take place at his house. Notice he puts blame on her, saying she had been texting him for rides. He seemed pretty calm in the interview.........crazy. Sounds like they pretty much had him pegged from the get go.

GREAT BEND — The world now knows 36-year-old Adam Longoria as a "person of interest" in the killing of 14-year-old Alicia DeBolt.

But a 31-year-old Great Bend woman who was making a life with Longoria at the time of the teen's death says she saw a person with promise when she first became acquainted with him about 11 months ago.

"He seemed like a pretty good guy," the woman said Sunday.

Her assessment of him has changed since Alicia's burned body was found Tuesday, more than two days after she disappeared, at the asphalt plant outside town where Longoria worked hours before the teen disappeared, the woman said.

Single parents, you have to start getting smarter! Set your standards higher, if not for yourselves, for your childrens sakes.

Now a days in addition to all the diseases you can catch, you have to make sure the intended isn't a nutjob/criminal to boot.

The risks alone make it better to stay single.

This woman and her children sound like they are lucky to be alive.

I agree, Calypso. He is a life long criminal, they don't change. Unable to live a decent, normal life. I'd guess he was in the juvenile system as well starting as a petty thief. Can't stay out of prison. No regard for anyone or anything but himself. How tragic for Alicia and her family that he came into their life and took Alicia's. So very sad.

(GREAT BEND, Kan.) — Adam Longoria appeared in a Great Bend courtroom Monday morning. He is charged with charged with one count of Vehicle Burglary and one count of Theft of property worth at least $1,000 but less than $25,000.

Longoria told the judge he understands the charges against him. He told the judge he plans to hire an attorney. Another hearing is scheduled for September 7.

Before stealing the vehicle, Six says Longoria went to post office and mailed many of his belongings to an address in Texas. “I believe that the defendant is in a desperate state of mind, and therefore, there’s a risk to the community if he’s released," said Six to the court.

And this guy also has a warrant out for his arrest in North Carolina for allegedly calling in threats to an elementary school!

A "celebration of life" service held for a slain 14-year-old girl was attended by family and friends in Great Bend Friday.

The service for Alicia DeBolt was held at 10 a.m. at the First Assembly of God in Great Bend. The Rev. Kyle Ermoian officiated. A private family inurnment took place after the service.

Alicia's family last saw her late on the night of Aug. 21, when she left home to go to a party. Her burned body was found three days later at an asphalt plant outside Great Bend.

GREAT BEND — Alicia DeBolt was remembered Friday as a kind, caring and loving person who saw kindness and beauty in everyone.

About 700 people gathered at the First Assembly of God Church in Great Bend for a memorial service for the 14-year-old.

Alicia also was remembered for her love of clothes and her tendency to speak her mind and operate on her own time.

Rev. Kyle Ermoian, who officiated, called her "willfully persistent."

"She was stubborn as a mule," he said, drawing laughter.

GREAT BEND, Kan. (AP) - A 36-year-old factory worker who spent much of his adult life in prison was charged Tuesday with sexually assaulting and murdering a 14-year-old girl whose badly burned body was found behind gravel piles at the asphalt plant where he worked.

Adam Joseph Longoria was charged with capital murder, criminal sodomy, vehicular theft and vehicular burglary and in the August death of Alicia DeBolt. He could be sentenced to death if convicted of the murder charge, but prosecutors said they hadn't decided whether to seek such a sentence.

Longoria had previously been charged with vehicular theft and burglary in connection with the case. In the Barton County Courthouse Tuesday to hear the new charges, Longoria spent nearly the entire hearing standing and leaning on his fists, staring frequently at DeBolt's family. Asked by the judge if he understood the charges, Longoria looked away from the judge and answered, "Yeah."

Wicks declined to comment after the hearing. Longoria's bond was increased to $1.5 million to "ensure public safety," Six said.


Staring at her family during the hearing......he has no remorse at all.

KSN interview subpoenaed in DeBolt case

WICHITA, Kansas -- Prosecutors have subpoenaed the interview KSN did with Adam Longoria, the suspect in the Alicia DeBolt case.

Days before Longoria was named as a person of interest in the murder DeBolt he sat down with KSN's Kevin Wheeler.

For about 20 minutes Longoria laid out his version of the events on the night DeBolt was killed.

"Alicia's ex-boyfriend gave me her number, which I didn't know it was, and told me to text her and tell her we were having a party and to mention who all was going to be there," Longoria said during the interview.

Late the night that 14-year-old Alicia DeBolt disappeared — and days before her burned body was found — Adam Longoria came home with stained clothing and smelling of fuel, according to one account.

Longoria, charged with murdering and sodomizing the Great Bend cheerleader shortly before she was to begin high school, used his girlfriend to help get rid of his clothing, according to the account.

Lisa Brown, 43, says the account comes from details that her 31-year-old sister — Longoria's live-in girlfriend — told her during several conversations. Their brother, Jeff Brown, 34, says his younger sister gave him the same basic account.

Lisa Brown said she is concerned that her sister has become embroiled in the case.

"I believe she's been manipulated," Lisa Brown said. "I believe she's been lied to. I think he (Longoria) used her, and he's still using her."

I don't know why this lovely young girl was even being friendly with this creep, who was more than twice her age. Age differences often are a bad combination, when it concerns a young naive teen and a much older male.
Her death should serve as a warning to other teens, but, they just don't want to listen to warnings. It is another tragedy of the times.

The state has filed a motion to determine if a common law marriage exists between Longoria and his girlfriend Eva Brown. Statements Longoria made to Brown would be protected under marital privilege if a common law marriage exists between the two of them.

MOTION TO DETERMINE EXISTENCE OF COMMON LAW MARRIAGE

Comes Now the State of Kansas, by and through Attorney General Steve Six, and moves this Court to make a finding as to whether a common law marriage exists between the defendant and Eva Brown. In support of this motion the State alleges as follows:

1. Pursuant to K.S.A. 60-423(b) an accused in a criminal action has a privilege to prevent his spouse from testifying in such action with respect to any confidential communication had or made between them while they were husband and wife.

2. Law enforcement officers have interviewed Eva Brown. In the interviews Ms. Brown has revealed statements made to her by the defendant that could be potentially be protected by martial privilege if Ms. Brown and the defendant were married.

3. The criminal investigation has revealed that the defendant and Ms. Brown were living together.

4. At Arraignment the court inquired of the defendant as to his marital status. The defendant replied "common law".

5. The State desires to call Eva Brown to testify at the preliminary hearing. A determination of whether or not the defendant and Eva Brown were married under the common law of the State of Kansas is necessary prior to the admission of her testimony.

WHEREFORE, the Plaintiff prays that this Court hear evidence as to the relationship between Eva Brown and the defendant and determine whether a common law marriage existed.

First hearing in teen's killing postponed

A hearing set this morning in the capital murder case of Adam Longoria has been continued until next month.

Many of the motions scheduled to be heard today in the killing of 14-year-old Alicia DeBolt had been settled by agreement or dropped, including a controversy over whether Longoria was married.

Barton County District Judge Hannelore Kitts will now be hearing the motions on Nov. 18, when Longoria is set for a preliminary hearing.

Court hears evidence against man accused of murdering Great Bend teen

The Attorney Genera’s Office focused on the timeline of what happened in the hours before DeBolt was murdered. The court heard from DeBolt’s mother, who testified she left her home around 11 p.m., but she didn’t she who she left the house with. A neighbor testified DeBolt got into a dark-colored SUV consistent with the one Longoria is accused of stealing. A KBI agent also testified about evidence of several text messages between Longoria and DeBbolt, showing he messaged her when she was on her way back from school shopping in Wichita with her mom to see if she wanted to meet up.

“Longoria to DeBolt: I can pick you up and we can go out and party. We will have fun,” said KBI Agent Stephanie Smith, reading an alleged text message from Longoria to DeBolt.

The texts go on to show Longoria asking for DeBolt’s address and texting, “I’m here” at 11:01 – just a moment before DeBolt was seen leaving her home.

Adam Joseph Longoria, the 36-year-old Great Bend man charged in the Aug. 21 slaying of 14-year-old Alicia DeBolt will stand trial for capital murder and criminal sodomy in connection to the killing, Barton County District Judge Hannelore Kitts ruled Thursday afternoon.

The ruling came after a day-long preliminary hearing that included graphic testimony concerning text messages sent between Longoria and DeBolt on the night of her death, the alleged intimate relationship between Longoria and DeBolt, and the charred condition of DeBolt’s body found at a Venture Corporation asphalt plant southwest of Great Bend. If convicted, Longoria could face the death penalty.

The motion, filed Tuesday, states that Longoria is to have no contact with Eva Brown, who is a witness in the case. It also states he cannot have contact with another person, Jeff Brown.

GREAT BEND, Kan. -- A Kansas judge on Tuesday rejected challenges to the state's death penalty law raised by the man charged with killing a 14-year-old Great Bend girl last year.

Adam Joseph Longoria of Great Bend has been charged with capital murder and criminal sodomy in the August slaying of Alicia DeBolt, whose charred body was found at an asphalt plant. If convicted, Longoria could face the death penalty.

Longoria's attorneys have filed two new motions challenging the death penalty. The first motion claims that international law prohibits the reestablishment of the death penalty once it has been abolished. The defense argues in the motion that Kansas abolished the death penalty in 1978, and therefore violated international law when they reestablished the death penalty in 1994.

The second motion motion argues that international standards of decency have evolved to the point that the death penalty is now considered cruel and unusual punishment, and is in violation of Longoria's Eighth Amendment rights.

These murderers always seem to have somebody fighting for their right to live, but what about the rights of their victims while they were suffering cruel and unusual deaths?

I agree. The method of death is not cruel, an injection into a vein. They actually die very peacefully. And it's certainly not unusual. The death penalty has been around since about the beginning of time.

I have never understood why a murderer's past record can't be exposed during the trial. When my SIL was being tried for killing my daughter, they could not bring up that he had already beat her twice before, requiring her to be taken to the hospital.

Motion to Enjoin the Victim's Family and Friends from sitting Directly Before the Jury and from showing Emotion in the Courtroom During the Trial

COMES NOW the accused, Adam Longoria, by and through his counsel, and moves this Court pursuant to the Fourth, Fifth, Sixth, Eighth, and Fourteenth Amendments to the United States Constitution and Sections One, Five, Nine, Ten, and Eighteen of the Kansas Constitution to enjoin the victim's family and friends, or members of any victims' rights groups, from sitting directly before the jury and from showing emotion in the courtroom during the trial. In support of this motion, Mr. Longoria states as follows:

1. This is a capital murder case.

2. Even in the non-capital case, appeals to passion and prejudice and other inflammatory
appeals to the jury are totally impermissible. See Viereck v. United States, 318 U.S. 236, 247-48, 63 S.Ct. 561, 87 L.Ed 734 (1934); United States v. Garza, 608 F.2d 659 (5th Cir. 1979); United States v. Gasparo, 744 F.2d 438 (5th Cir. 1984); Parks v. State, 330 S.E.2d 686 (GA 1985); Conner v. State, 303 S.E.2nd 266 (GA 1983); and American Bar Association, Standards Relating to the Prosecution Function, Section 3-5.8(c) (1982).

3. One source of great emotion arises when the victim's family vents its obvious grief in the courtroom. See Fuselier v. State, 468 So.2d 45 (Miss. 1985) (reversing where trial court allowed the victim's daughter to sit within the rail).

4. For example, while it is very clear that the family, or the victims' rights advocates, come to court to support the prosecution's cause, it is equally clear that "the victim's survivors' opinions about the crime and the murderer is clearly irrelevant to any issue in a capital sentencing hearing." State v. Bernard, 608 So.2d 699 (LA 1992). See Also State v. Donesav, 265 Kan. 60, 959 P.2d 862 (1998) ("The admission of evidence in a murder trial regarding the victim's family, the victim's relationship with a spouse or family member and friends, the victim's character, and the details of the victim's last days before death which has been intentionally and not incidentally elicited by the prosecuting attorney during the trial, is patently improper and reversible error.") If— as is legally evident — such opinions cannot be expressed on the witness stand, they cannot be made clear by extraneous actions in the courtroom.

Wherefore, Mr. Longoria moves this Court to take action to ensure that such shows of emotionalism do not occur at his trial and for such other and further relief as the Court deems just and equitable.

In advance of his capital murder trial that starts Monday, Adam Longoria is already touting to media a chance to have the "first interview" at the conclusion of the case.

Longoria, charged with killing 14-year-old Alicia DeBolt in August 2010, sent a letter to The Hutchinson News, postmarked March 20 with the return address stamped from the Sedgwick County Detention Facility.

He first acknowledges in the letter that he can't talk about his case, due to a "gag order."

"Now, I do have a offer to present to you," the letter states. "My trial starts on March 26th of 2012.

Longoria's trial is expected to last two weeks, with jury selection lasting two to four days, according to Ron Keefover, media liaison in the case and the chief information officer for the Office of Judicial Administration.
