Raleigh, N.C. — A day after authorities say Laura Ackerson was killed at the Raleigh home of her ex-boyfriend, his wife – Amanda Hayes – bought several items that authorities say were used to cover up the crime.

Raleigh police homicide detective Jerry Faulk, the lead investigator in the case, said Monday that the 41-year-old was seen on a security video leaving a Target store after buying bleach, rubber gloves and other items that were later found in the couple's trash.

Faulk was the 45th witness testifying in Hayes’ murder trial for the state, which rested its case Monday. Over the past 10 days of testimony, it has sought to show that Hayes was angry at and resentful toward Ackerson, who was involved in a custody battle with Grant Hayes over the two young sons they had together.

Raleigh, N.C. — Testifying in her first-degree murder trial on Tuesday, a soft-spoken Amanda Hayes told a jury of three men and nine women that she did not kill her stepchildren's mother and had no involvement in the July 13, 2011, death at her Raleigh home.

It wasn't until six days later, she said, that she realized Laura Ackerson – who was involved in a bitter child custody fight with Grant Hayes – had died.

By that time, the Hayes and the children had taken a trip to see her sister in Richmond, Texas, and Grant Hayes was looking get rid of the 27-year-old's dismembered remains.

The couple was outside late one night, Amanda Hayes said, when he told her what had happened and that "none of us were going to make it back to North Carolina" if she didn't help him figure out a way.

RALEIGH, N.C. (WTVD) --  Prosecutors had their chance to grill Amanda Hayes on the witness stand Wednesday during a long cross-examination session.

But Hayes stood firm under Holt's questioning. She admitted there was an argument in the couple's Raleigh apartment with Ackerson and the 27 year old approached her.

"She um I guess she tripped on the rug. Grant grabbed her and was pulling her backwards and they started struggling, and she kicked this little wall right here and whenever she did they went backward and there was a chair, they flip, they fell, they tipped over the chair when they fell," recalled Amanda.

Hayes said Grant asked her to leave the apartment with the children because Ackerson was hurt. But when she returned he said Ackerson was okay and had gone home.

Prosecutors bring in late evidence in Amanda Hayes Raleigh murder case

Prosecutor Boz Zellinger said Grant's parents sent the Wake County prosecutor's office letters Amanda sent them to read over the phone to Grant following their murder arrests.

In them, Amanda tells Grant she loves him and thinks about him every day.

Amanda's defense objected to the late evidence, but Judge Stephens said he'd allow it if Patsy Hayes (Grant's mother) testified.

Stephens told defense lawyers he is always troubled by late evidence, but said the late evidence in this case is mitigated because Amanda Hayes obviously knew of the letters if she wrote them.

Prosecutors were working to get Patsy Hayes to the courtroom Friday.

Seeking to win a conviction in Amanda Hayes' first-degree murder trial, Wake County prosecutors called two final witnesses Friday to refute Hayes' own testimony that she had no idea that Ackerson had died and only helped in the cover-up because she was scared of Grant Hayes.

But jurors heard evidence to the contrary Friday after the defense rested its case – having called only three witnesses, including their client.

Barakat, however, said Amanda Hayes told her that she was in the room when Ackerson died.

"This was when Grant was over the body and looked up and told her that Laura was dead," Barakat said. "I asked her how that made her feel, and she said it didn't make her feel anything. She felt nothing."

Further trying to counter Amanda Hayes' claim that she feared her husband, Raleigh homicide Detective Jerry Faulk testified that the couple appeared to act like newlyweds when they were initially taken into custody.

"They were all lovey-dovey, if you will," Faulk said. "Walking down the hallway, Amanda was walking behind Grant and rubbing his shoulders."

The state also presented last-minute evidence –letters to Grant Hayes' mother – that also appeared to contradict Amanda Hayes' claims that she feared her husband because he threatened to kill or harm her and their children.

Jury asks for clarification on acting in concert. "Is it enough if the person is in the house at the time of murder?"  @ about 5:00
Judge will answer orally.
Answer:
Basically, he or she is activity or constructively assisting with the crime.

Soooo, if she hide's the children away knowing what is going to happen is that in concert? Not that I believe that was the extent of her role.

Jury is retiring for the day.

Well, at least we know they have a foreman; and they are dismissed for the day.

Jury deliberations will begin at 9:30 am tomorrow morning.

IDK, concerning that last question, I took from the judge's response that:

two persons acting together with a common purpose; and each person must be active or constructively present at the time of the murder -- for "in concert" murder.

Come on, Jury!  The state has proved their case.

Yes he did. However, he also said even if one of them was a look out they are working in concert. So her taking the children to the bedroom if true puts her in that category.

So now, I'm really worried about how the deliberations are going because if their considering that then she is going to get less then 1st or 2nd. Is that right?

I so agree Nan that the State proved there case in spades.

Here is that question, the first time the judge read it:

I'm afraid they might have believed her story that Laura tried to grab Lily, and she [Amanda], ran for the bedroom and thus didn't see or take part in the actual murder of Laura.

The pharse "each is present" was contained in the wording of the original jury instructions.

At about 6:30 minutes:
Judge Stevens:  As to this charge, the state relies upon the legal theory of acting in concert, which is recognized and accepted as part of the law of North Carolina.

Under that law, for a person to be guilty of a crime, it is not necessary that she herself, personally, do all the acts necessary to constitute that crime.

If two persons act together with a common purpose to commit the crime of first degree murder— and each is present at the time that first degree murder is committed—then each of them is held responsible for the acts committed by the other, done in the commission of that crime.

It's so early to try to say, though; they were just settling in and one person might have just wanted clarification of that particular phase as it stuck in their minds.

I noted the judge was really careful how he answered.  

Here is his answer in this video; and you know I love this judge, but here I find his answer rambling:

You asked me what it means to be “each is present.”  By the law in this state, to be guilty by acting in concert all perpetrators must be actually, or constructively, present.  A person is constructively present when he or she is close enough to the scene to render assistance to the other perpetrator to carry out the crime.

I remind you that each of them must be actively assisting the other to cause the crime to occur.

So, a constructive presence is sufficient under the law so long as one is close enough to where a murder is occurring to render assistance to the other perpetrator, as each of them actively participate in causing the crime to occur.

I agree that the judge said earlier that if Amanda was acting as the lookout, they were acting in concert--but that was well after the actual murder and was during the disposal of the body.  That makes me a little bit uneasy because it can be seen to fit with the "accessory after the fact charge."

I also agree that her taking the kids to the bedroom puts her in the "in concert" category; but only if the jury believes that Amanda knew what Grant was doing.  If the jury believes Amanda had no idea what was going on at that point, we may be in trouble if we are hoping for a murder conviction.  (As I am.)

I personally disbelieve that whole part of Amanda's story about Laura wanting to hold Lily and blah, blah, blah.  I think she lured Laura to that apartment--remember the state believes Laura spoke to Amanda that afternoon; and that implies to me that Amanda had a plan in place at that point to murder Laura.

I don't believe it went down anyways near to what Amanda said on the stand.   = Amanda

Now, if only the jury is with me.

Raleigh, N.C. — What Wake County prosecutors and defense attorneys for Amanda Hayes both agree on is that her husband, Grant Hayes, committed a heinous crime when he killed Laura Ackerson – his ex-girlfriend and the mother of his two young sons – nearly three years ago.

What they disagree on is the role Amanda Hayes – on trial for first-degree murder and accessory after the fact to murder – played.

The jury deliberated for about 75 minutes Monday afternoon, asking for a diagram of the Hayeses' third-floor apartment and inquiring about the definition of "acting in concert" as it applies to a requirement for a first-degree murder conviction.

Jurors have six verdicts they can consider.

On the charge of murder, they can consider guilty verdicts of first-degree or second-degree murder, as well as not guilty.

If the jury finds Amanda Hayes not guilty of murder, it must then consider accessory after the fact to murder in both the first- and second-degrees or not guilty.

Jury deliberations resume at 9:30 a.m. Tuesday.

Jury begins deliberating in Raleigh murder trial of Amanda Hayes

RALEIGH (WTVD) --  The jury in the Raleigh murder trial of Amanda Hayes began deliberating Monday afternoon. The jury got the case after lawyers on both sides made their closing arguments.

But in his response, Wake County prosecutor Boz Zellinger called some of the defense assertions "ridiculous" and said many had no basis in fact.

Zellinger said Amanda was a willing participant in getting rid of Ackerson's body - pointing to surveillance pictures that show her dumping acid containers that Grant purchased to try to dissolve the body.

Zellinger also showed the jury pictures that Grant and Amanda took of themselves on the tip home from Texas that show them laughing and smiling. He asked how she could have been so afraid of Grant, but still take such photos.

BBM - Circumstantially, if we refer to all the points Becky Holt made in her closing statement, absolutely hiding the children in their room would be acting in concert; because that would have been part of their plan; constituting "two persons acting together with a common purpose."

I have to admit that I have strong doubts as to the fact that the children were hid away in their room.  I'm afraid that both of the little boys witnessed the whole thing.

All we have to indicate that they were in their room, is Amanda's lies on the witness stand.

Those little boys had no bedtime; no meal time; no real regiment in their lives.  It appears to me that they existed on a schedule set for adults--and adults with strange habits.

If they were expecting their mother, I'm sure they were at the door before Grant and Amanda could get there.  If they had no idea their mother was coming, they may have been in their room with a movie turned up loud.  Maybe Grant and Amanda even locked them in their room as they prepared for Laura's arrival and what was to come.

I'm sure they would have heard their mother and tried to go to her.

Regarding the BBM, I didn't address this part in my first reply.

Yes, I believe you are correct here.  If the jury finds that Amanda was not "in concert" with Grant, then all they have left to consider is accessory after the fact for murder one; or accessory after the fact for murder two. (Or, of course, not guilty--which I don't want to contemplate.)

That "in concert" part is important.  I think that's why the judge put so much thought into his reply.

Oh, I'm so praying the jury gets it right.

I had forgotten about her calling Laura to come to the apartment. I sure hope the jury remembers that as well.
Yes, I agree that Laura never caused a scene over Lily, that is just ridiculous.
Another thing that has crossed my mind is that 'IF' she did have the children in the bedroom which I don't believe because little Grant saw what happened in my mind, I think Lily needing a diaper change is a lie. I think she would have gone out of the room to be nosy and make sure Grant is doing what she wants him too.

Another jury question:

They want to see the reciprocating skill saw.

The judge is going to bring the jury in because he wants to make sure that they understand that the saw in evidence is not the same saw that Grant and Amanda used on Laura.

Amanda:  It’s okay.  Ohhh, nooo.  It’s okay.  We love you.  [blows kiss]

Grant:  Hmmm?

Laura: Hey, Amanda, can I talk to you for a couple of quick seconds without the kids?

[Unintelligible]

Amanda:  No problem.  You just made us late last weekend [unintelligible]; so, [cross talking] can you just let us know—like—in advance, if you are going to be late, that would be awesome.

Laura:  [Unintelligible] you guys have been late before.  I don’t react like ...

Amanda:  What?  We have never been late, more than 5 minutes, ever.  Because I am very, very, very, [unintelligible] about being late.

Laura:  [Unintelligible]

Amanda:  So, I can guarantee you that we have not been late.  And the day that we were late—on the rainy day—we were six minutes late, [unintelligible] on the dot.

Laura:  I’m not even talking about being late.

[Unintelligible]

Laura:  [Unintelligible] your having, showing disdain for me.  From what I understand that is not a good [unintelligible] to have, but if we can please just remain cheerful [unintelligible.]

Amanda:  I would just prefer we didn’t even speak.  How about that?

Laura:  [Unintelligible]

Amanda:  [Unintelligible] I don’t see anything [unintelligible]

Laura:  *sigh*  I agree.

Amanda:  Okay.  So, I mean, you agree with me.
Thank you Nan. She is such a witch and was clearly trying to control Laura. Laura should have decked her.
