Hi, lostyou!

I do not know anything about the appeal process in Florida.

In Texas, it can be several months.

I noticed the Casey Anthony case appeal took a real long time .

I agree that John Goodman should be in prison and serving his time for the death of Scott Wilson.

Court: Girlfriend can't also be polo playboy's 'daughter'

By Mike Tolson
Houston Chronicle - Houston, TX

March 27, 2013 | Updated: March 27, 2013 9:42pm

Heather Colby Hutchins is only
seven years younger than her
boyfriend, John Goodman,
pictured in 2009, yet he wanted
to legally adopt her.

Photo: Dave Rossman, Freelance / Freelance

A Florida appeals court ruled Wednesday that a millionaire polo playboy from Houston cannot legally adopt his longtime girlfriend, only seven years his junior.

Precisely why John Goodman, the 49-year-old heir to an air-conditioning fortune, wanted to "adopt" Heather Hutchins was never entirely clear - money was at the center of it, though explanations differed - but that reason is now moot. A three-judge panel unanimously held that Goodman's failure to tell his ex-wife and his teenage children of the adoption until it was a done deal violated their right to due process

Snipped:

Goodman is a longtime Houston resident and polo enthusiast who in recent years has spent much of his time in Palm Beach, where he built a major venue for national and international polo matches. Facing a potential prison sentence if convicted in the 2010 two-car accident, he and Hutchins executed the adoption in October 2011 and did not tell anyone until the beginning of 2012 after the objection period ended. The appeals court called that "fraud."

In a separate addendum, Senior Judge Alan R. Schwartz went further: "Even if the motivation and the means for securing it were not so reprehensible, I believe ... the adoption of a paramour is so contrary to the beneficent purposes of such an action that no such judgment can ever be sustained."

Juror may help Houston playboy's retrial chances

In the continuing saga of billionaire John Goodman's prosecution on alleged intoxication manslaughter charges, his chances for a retrial are apparently improving.

The Sun Sentinel reports that Goodman's lawyers are claiming that a juror at his original trial did not disclose that his wife had been arrested on a charge of driving under the influence.

Judge sets Goodman juror hearing for April 29

Polo mogul's attorneys seeking new trial over misconduct claim

April 4, 2013

By Marc Freeman, Sun Sentinel - West Palm Beach, FL

The newest revelation of possible juror misconduct in John Goodman's DUI manslaughter case will be examined at an April 29 court hearing, Palm Beach County Circuit Judge Jeffrey Colbath said Thursday.

The evidentiary hearing, to interview Goodman trial juror Dennis DeMartin of Delray Beach, was scheduled during a conference call with attorneys for the state and Goodman.

On Monday, the 4th District Court of Appeal in West Palm Beach sent the case back to the trial court for 45 days in response to a motion by Goodman's attorneys alleging DeMartin lied during jury selection last year.

The new argument revolves around a recently self-published book by DeMartin in which he wrote his ex-wife was once arrested for DUI, a fact the attorneys say DeMartin did not disclose when they were questioning him before being seated as a juror.

John Goodman: New trial & 11 page ruling

Judge says John Goodman deserve new trial

Story by Al Pefley / CBS12 News

WPEC - West Palm Beach, FL

WEST PALM BEACH, Fla. -- Wealthy Wellington resident and polo tycoon John Goodman has won a new trial, and it could be held before the end of this year.

In an 11-page ruling, Circuit Judge Jeffrey Colbath says Goodman juror Dennis DeMartin was not truthful during jury selection and as a result, Goodman was denied a fair trial.

Had DeMartin brought up the fact that his ex-wife had a DUI arrest, he would not have been chosen as a juror.

New trial for John Goodman

Post by Ann - Tx on Sat May 04, 2013 11:10 am

Judge orders new trial for John Goodman

May 3, 2013|Sun Sentinel
Fort Lauderdale, FL

A Palm Beach County Circuit judge has ordered a new trial for polo mogul John Goodman, who was convicted of DUI manslaughter last year.

See the judge's order here.

From Roy Black: “The jury is the foundation of our criminal justice system. It is the equalizer between the citizen and the state. However, as in any institution run by human beings, there will be those who seek to corrupt the process. A juror who deceives to get on a jury in a high profile case for his own profit is a trial lawyer’s worst nightmare. Fortunately, this time the deception was exposed and a courageous judge set aside the verdict. But in this new world of social media and self-publishing, expect this to occur more frequently. John Goodman's trial should stand as a warning to all of us.”

The judge made the decision based on problems with trial juror Dennis DeMartin, who at a hearing on Monday emphatically denied lying his way onto the jury for the Wellington polo mogul's DUI manslaughter trial last year.

WEST PALM BEACH, Fla. —Polo mogul John Goodman will remain on house arrest, but his bail will be reduced.

Judge Jeffrey Colbath issued the ruling Wednesday as the International Polo Club Palm Beach founder awaits a new trial

During a hearing last week, Goodman's attorney asked that his client's bond be reinstated to the same release conditions he had before his DUI manslaughter conviction last year. However, the assistant state attorney argued that Goodman was a flight risk because of his wealth.

New John Goodman attorneys may seek to move new trial

Post by Ann - Tx on Sat Jun 01, 2013 2:58 am

New Goodman attorneys may seek to move new trial
Wellington polo mogul awarded new trial on DUI manslaughter charge

By Marc Freeman, Sun Sentinel
Fort Lauderdale, FL

7:51 p.m. EDT, May 29, 2013

John Goodman (right) arrives at court Friday morning, May 17, 2013
with his new attorney Doug Duncan to seek termination of his house
arrest. Judge Jeffrey Colbath said he would rule on the request next
week. Goodman was convicted of the drunk driving death of Scott Wilson
but he was granted a new trial due to juror misconduct.

(Sun Sentinel/Mark Randall / May 17, 2013)

John Goodman's new attorneys may want the polo mogul's new trial moved out of Palm Beach County because of extraordinary publicity in the case, according to a request filed Wednesday.

Palm Beach County Circuit Judge Jeffrey Colbath twice last year denied Goodman's former attorneys their desire to move his trial to Miami due to an intense media focus on the DUI manslaughter prosecution.

But Colbath on May 3 granted Goodman, 49, a new trial because of juror misconduct, wiping out his conviction and 16-year prison sentence. Goodman attorneys Roy Black and Mark A.J. Shapiro then left the team, and attorneys Douglas Duncan and Scott Richardson took the reins.

In their new motion, the defense asked Colbath to cancel a planned Monday conference on trial scheduling, citing that they need "sufficient, reasonable time to investigate and prepare Mr. Goodman's case for trial." They said they would not request a November trial as originally planned.

The attorneys asked for a September court date to review the status of trial preparations and reveal at that time whether Goodman will again seek a change of venue.

John Goodman's "new" trial might be in January, 2014

Judge open to moving polo mogul Goodman's new trial
Or jury could be brought in for DUI manslaughter case

July 24, 2013|By Marc Freeman, Sun Sentinel
Fort Lauderdale, FL

The judge presiding over John Goodman's DUI manslaughter case said Wednesday he's receptive to moving the new trial out of Palm Beach County because of the potential difficulty of picking a jury here.

Snipped:

The stars are lining up for a mid-to-late January trial, which would be more than eight months after Colbath threw out Goodman's conviction and 16-year prison sentence because of juror misconduct allegations.

The wait is in part because Goodman's new attorneys, Douglas Duncan and Scott Richardson, can't get their hands on case files and evidence held by Goodman's former attorney Roy Black and his Miami firm.

Duncan told the court that Black has placed a "retaining lien" on those records — a legal term meaning Black has a right to keep them until he's fully paid for his services. The new defense team is working around this by paying for fresh copies from the State Attorney's Office.

After the hearing, Richardson and Duncan would not answer questions from reporters about how much money their client owes Black.

Snipped:

The judge agreed it could be possible to "shanghai" a jury from another county, keeping the trial in the courthouse about 17 miles east of the site of the Feb. 12, 2010, crash that killed Scott Patrick Wilson, 23. The victim's parents, William Wilson and Lili Wilson, attended Wednesday's hearing but declined to comment afterward.

The judge said if jurors are brought in he would consider holding long trial days and even court on Saturday "so we can get these people in and out" with as minimal disruption to their lives as possible.

Judge denies DeMartin request to have ex-Goodman prosecutor testify in contempt case

Updated: 8:26 p.m. Tuesday, Sept. 24, 2013  |  Posted: 10:31 a.m. Tuesday, Sept. 24, 2013

BY DAPHNE DURET - PALM BEACH POST STAFF WRITER

WEST PALM BEACH — Lawyers trying to save former John Goodman juror Dennis DeMartin from jail on criminal contempt charges are going to have to go to trial next week without testimony from prosecutor Sherri Collins.

Defense attorneys Robert Gershman and Joseph Walsh are representing the 70-year-old retired Delray Beach accountant for free as he fights charges he derailed the polo mogul’s DUI manslaughter conviction. He’s accused of withholding key information during jury selection and later conducting a drinking experiment. His attorneys had listed the Goodman prosecutor as a witness in the case.

Judge: Attorneys for Goodman juror DeMartin can't question prosecutor

Final hearing set for Monday on Delray Beach man's alleged misconduct

September 24, 2013 | By Marc Freeman, Sun Sentinel

Palm Beach County Chief Circuit Judge Jeffrey Colbath on Tuesday said he won't allow attorneys for former John Goodman juror Dennis DeMartin to question a prosecutor at an upcoming hearing.

Colbath denied a subpoena served on Assistant State Attorney Sherri Collins, meaning she won't have to testify at DeMartin's final hearing Monday on a misdemeanor charge of indirect criminal contempt.

DeMartin, 70, of Delray Beach, is accused of misconduct that prompted Colbath to throw out the Wellington polo mogul's March 2012 DUI manslaughter conviction and 16-year prison sentence for the February 2010 death of Scott Wilson, 23.

DeMartin, a retired accountant, faces a jail sentence of up to six months if he's convicted.

Goodman attorneys report Bentley missing from evidence for DUI manslaughter retrial

State Attorney's Office says cars released after polo mogul's May 2012 sentencing

By Marc Freeman, Sun Sentinel
5:23 a.m. EDT, September 25, 2013

John Goodman's attorneys say they've just made a stunning discovery that they say casts some doubt on the Wellington polo mogul's DUI manslaughter retrial.

Goodman's Bentley convertible and victim Scott Wilson's Hyundai Sonata — major pieces of evidence — are missing for Goodman's retrial early next year, the defense attorneys revealed in court papers filed this week.

But the Palm Beach County State Attorney's Office said it released both damaged vehicles to insurance companies, complying with requests after Goodman was convicted by a jury and sentenced in May 2012 to 16 years in prison.

~Snipped~

And now Goodman's attorneys, Douglas Duncan and Scott Richardson, informed the judge they recently were "shocked and surprised to learn that both vehicles, previously described as critical evidence … are now no longer in evidence, and no longer available for examination by defense."

State slams Goodman's bid to move DUI manslaughter re-trial over media coverage
Prosecutors say picking fair jury no problem

5:26 p.m. EDT, October 7, 2013

Snipped:
-----
Wellington polo executive John Goodman's desire to move his DUI manslaughter retrial out of Palm Beach County — to avoid biased jurors — should be rejected by the judge, state prosecutors argued Monday.

Goodman's attorneys last month requested a rare change of venue, arguing "unprecedented" negative publicity concerning the high-profile case makes it impossible to guarantee a fair trial. Chief Circuit Judge Jeffrey Colbath could make a decision during a hearing Friday; the trial is planned for early next year.

The State Attorney's Office contends that in a county with 1.3 million people it won't be a problem to find a panel of jurors who have an open mind about the case: Goodman, 50, is accused of driving drunk and causing the Feb. 12, 2010, death of Scott Wilson, 23, at a Wellington intersection.

"The defendant's request for a change of venue is premature in that there has not been any attempt to select a fair and impartial jury," wrote Assistant State Attorney Leigh Lassiter Miller.

No change of venue for polo mogul's DUI manslaughter retrial

5:49 p.m. EDT, October 11, 2013

Snipped:
-----
It's been decided: Wellington polo executive John Goodman's DUI manslaughter retrial will be held in Palm Beach County. But only if — and the defense thinks it's impossible — fair and impartial jurors can be found here.

So while denying Goodman's renewed bid for a change of venue, Chief Circuit Judge Jeffrey Colbath on Friday insisted on a backup plan to move the high-profile trial elsewhere in Florida if Goodman's legal team turns out to be correct.

Tampa, anyone? Goodman, 50, would like his trial held there. Jacksonville, perhaps? That's the favorite of prosecutors, said Chief Assistant State Attorney Alan Johnson. The judge listed those areas, and Orlando, as the top contenders.

John Goodman case: Judge delays start of DUI manslaughter retrial
WEST PALM BEACH, Fla. -- Fifteenth Judicial Circuit Court Judge Jeffrey Colbath has agreed to delay the start of the DUI manslaughter retrial of International Polo Club founder John Goodman after defense attorneys said they needed more time to prepare their defense. The trial, which had been expected to start in January, could now start as early as late February or early March. The next hearing is scheduled for 8:15am on Tuesday, January 14. wrote:
[quote="The hearing, the last scheduled one of the year, came one month after defense attorneys said an expert would travel to Texas to examine the 2007 Bentley Continental GTC driven by the International Polo Club founder the night University of Central Florida student Scott Wilson was killed in Wellington. In November, defense attorneys alleged that prosecutors at the Palm Beach County State Attorney's Office withheld information about vehicle malfunctions similar to the one argued during the 2012 trial that ended with Goodman being convicted of DUI manslaughter. "[Prosecutors] argued that because the vehicle was a "quarter of a million dollar" vehicle, it was ludicrous for the defense to argue that the vehicle could have malfunctioned," defense attorneys wrote in their motion. The premise of a vehicle malfunction had been a central focus of Goodman's defense. ][/quote]

Judge Jeffrey Colbath of the 15th judicial circuit in West Palm Beach scheduled another hearing on the case for Jan. 14, WPTV reported. Defense lawyers asked the judge Monday to postpone the trial from January because of motions on evidence.

Colbath set March 3 through March 21 for the trial.

This may be old or past time but I want to share ASAP.
This was a live vid this AM but I did not catch it earlier.

Commentary update:
http://www.wptv.com/dpp/news/region_c_palm_beach_county/west_palm_beach/john-goodman-hearing-video-live-stream

The defense wanted the judge to suppress the blood evidence. Attorneys argued that Goodman's blood was taken without a warrant and therefore should not be used in this trial. The state said that investigators had every right to take blood because there was probable cause of a traffic homicide. Judge Colbath denied that motion. The re-trial is expected to take place March 3rd. Read more: http://www.wptv.com/dpp/news/region_c_palm_beach_county/west_palm_beach/john-goodman-hearing-video-live-stream#ixzz2pMOiaQJ4 wrote:

Goodman wants charges dismissed because of Bentley decision

Wellington polo mogul claims defense can't get fair retrial
5:59 p.m. EST, January 10, 2014

Snipped:
-----
The DUI manslaughter charge against John Goodman should be dismissed because prosecutors in "bad faith" intentionally released the Wellington polo executive's Bentley and victim Scott Wilson's Hyundai right after Goodman's first trial in 2012, defense attorneys charged this week.

"There is no logical, legal reason or justification for the release of the vehicles," argues Douglas Duncan, in a 49-page motion filed Thursday and expected for more than a month. The attorneys claim in this formal argument that the vehicle evidence is critical to helping Goodman receive a proper defense at his retrial starting March 3.

...With Colbath's permission last month, Goodman's investigator recently went to check out the car. The vehicle's "electronic control modules" or "brains" of the Bentley had been removed and much of the inspection couldn't be conducted, the attorneys reported.

"As a result, the State has destroyed constitutionally material evidence of a known/established exculpatory value to the Defense, thereby preventing any chance for Mr. Goodman to present a complete defense and receive a fair trial," the defense wrote.

...In November, his attorneys filed a motion seeking to exclude Goodman's blood test results from evidence because the sample was taken without a warrant three hours after the crash. But Colbath, after hearing objections from prosecutors last week, formally denied the request in an order Friday.

...The retrial is set to run from March 3-21.

Where is John Goodman's wrecked Bentley???

Post by Ann - Tx on Sun Jan 26, 2014 3:08 am

John Goodman's wrecked Bentley turns up near Houston

Saturday, January 25, 2014

KTRK (ABC) - Houston, TX

HOUSTON (KTRK) --  A vital piece of evidence from a high-profile DUI manslaughter case is in the hands of a car hobbyist outside of Houston, the Sun Sentinel reports.

Snipped:

So where is that wrecked Bentley now?

It's sitting in the garage of businessman Ryne Manahan's home in Sugar Land, according to the Sun Sentinel.

The Goodman Bentley was originally purchased at auction by an unknown buyer for $27,737, the Sun Sentinel reports, and it turned up on the auction block again in July 2013. That's when Manahan says he bought it online for $11,000.

Manahan, 45, tells the Sun Sentinel that he intends to completely restore the car.

Detailed article about John Goodman's Bentley car

More detailed article/video here:

John Goodman's smashed Bentley turns up in Texas

New owner had no idea of the car's infamous past

By Marc Freeman, Sun Sentinel
West Palm Beach, FL

8:11 p.m. EST, January 25, 2014

It's the luxury car from one of South Florida's biggest pending criminal cases, and it's not in evidence. Not even close.

Parked 1,142 miles away in the garage of a residence near Houston is Wellington polo magnate John Goodman's smashed 2007 black Bentley Continental GTC convertible.

Businessman Ryne Manahan now holds the keys. And he intends to completely restore the car despite its less-than-glorious past.

"Nobody will be able to tell it was ever wrecked," Manahan, 45, told the Sun Sentinel last week in an exclusive interview. "It'll look nice."

How did the vital piece of evidence from Goodman's DUI manslaughter case wind up with a Texas car hobbyist?

I don't like this...

" ... There's also expected to be a request by attorneys to postpone the trial by three months.

Prosecutors say they now need more time to prepare because of pre-trial matters brought on by the defense. However, that will be a moot point if Judge Jeffrey Colbath decides to dismiss the case....."

Jane Musgrave:
The Bentley was inspected without the defense present. No videotape was made.

11:01

Jane Musgrave:
The expert - Dr. Livernois - manipulated the butterfly valve, Duncan said. Livernois said the valve was stuck, he added. Snelgrove said he doesn't remember. Further Snelgrove says he didn't know Livernois tested a similar car to arrive at some of his conclusions.
11:03

Jane Musgrave:
Snelgrove says there are cars in another lot that are kept for a long time, possibly as long as 10-20 years. But, he says, that is a different division - violent crimes. He works in traffic homicide.

11:12

Jane Musgrave:
Goodman hit head on driver's side window, according to a report Duncan is reading.
11:13

Jane Musgrave:
One of defense's car experts has been arrested for various felonies, Duncan said. That's why "he's unavailable to us," he adds.
11:13

Comment From foxone1
that model had side air bags
11:13

Comment From guest
Didn't Goodman have a concussion?
11:13

Jane Musgrave:
That's what his defense team says.
11:26

Jane Musgrave:
Duncan is hammering Snelgrove about why he didn't call Goodman or the defense team before he released the Bentley, particularly when there was personal property involved.
Snelgrove is unflappable.
11:27

Jane Musgrave:
Duncan says prosecutor Sherri Collins, who helped Ellen Roberts convict Goodman at the first trial, didn't know the Bentley had been released. Snelgrove agrees.
11:28

Jane Musgrave:
At your deposition, you said he were getting 1,2,3 calls a week from Chubb as the first trial approached, Duncan says. Snelgrove agrees.
11:29

Jane Musgrave:
Phone records show that in 2010 (the year of the crash) there were 8 calls from Chubb Insurance, Duncan says.
11:30

Comment From Guest
I wouldn't say Snelgrove is "unflappable" because he's having involuntary bodily responses when he's (uncomfortable) with the question or answer.
11:31

Jane Musgrave:
In 2011, Chubb records show no calls were made. In 2012, records show there were 5 calls, Duncan says.
11:31

Comment From BOD
Snelgrove is holding his own, though. You can tell that he's a veteran in the witness box.
11:32

Jane Musgrave:
Snelgrove says there were also calls being made to the impound lot to release the Bentley. Duncan says Chubb records show there was one call made to the impound lot.
11:33

Comment From BOD
Tons of hearsay evidence is being admitted to which the prosecution is not objecting. Can't understand why.
11:34

Jane Musgrave:
Duncan claims that Snelgrove, at a deposition, never said that he told other traffic homicide investigators that he was being inundated by calls from Chubb. Snelgrove says he doesn't remember whether he was asked that question.

11:38

Comment From Guest
The point is that Roberts said Snelgrove and the impound lot were getting harassed by Chubb and that's why she released the car. The defense said phone records did not show numerous calls from Chubb at that time. State said there wouldn't be records cuz they went through a switchboard. Defense says Chubb's own records show lots of calls to Snelgrove early on, but do not show lots of calls during the time in question. In fact, Chubb records show Snelgrove calling them.
11:38

Comment From guest
if this is true...May 31, 2012 letter - two weeks after Goodman sentenced - Ellen Roberts requests that evidence custodian preserve all the evidence in the case. Why did they get rid of the evidence?
11:39

Jane Musgrave:
They just got rid of the cars - about a month earlier. Ellen Roberts and Snelgrove say it was routine to do so after trials.
11:39

Comment From guest
Even when there is an appeal?
11:40

Jane Musgrave:
Roberts testified that she felt the case was rock solid and there were no grounds of a successful appeal.
11:40

Comment From Guest
Even when defense has asked state to keep them?
11:40

Jane Musgrave:
The dispute is over whether the defense ever asked to conduct additional tests of the car. There is no evidence that they did other than a letter their car expert wrote to a defense attorney.
11:41

Comment From BOD
So is the defense relying on a spoliation of evidence as the crux of their argument?
11:41

Jane Musgrave:
In this hearing, yes. They claim the release of the vehicles constitutes gross misconduct on the part of the state and the charges should be dismissed.
11:41

Comment From foxone1
has the defense found a witness that will say the car malfunctioned?
11:42

Jane Musgrave:
In the first trial they did. They also have a new expert who says the throttle in the Bentley was "intentionally manipulated" while at the impound lot.
11:42

Comment From Michelle
How old is Snelgrove? Has he always been with PBSO? If so, I'm sure there are other individuals in the homicide unit he is in that has dealt with functioning cars in a case...you would think he would ask for an opinion on releasing it after the 1,2,3 calls from the insurance company.
11:43

Jane Musgrave:
He's been at PSBO for 19 years and in traffic homicide since 2002.
11:43

Comment From guest
Her saying it so...doesn't make it so.
11:43

Comment From Guest
Not Roberts' decision to make, whether or not there were grounds for a successful appeal.
11:43

Comment From foxone1
it was a rock solid conviction in my opinion I don't think that will change in the re trial
11:43

Comment From foxone1
is this the last witness?
11:43

Jane Musgrave:
Yes.
11:44

Comment From foxone1
but there are other motions for today correct?
11:44

Jane Musgrave:
No. They haven't been scheduled for hearing.
11:46

Jane Musgrave:
After the motion to dismiss was filed, Snelgrove said prosecutors alerted him that phone records don't back up his claims that Chubb was bugging him to release the Bentley.
11:46

Comment From Guest
Aww..poor Goodman and his injuries that he caused himaelf by his selfish
11:46

Comment From BOD
Parker is reading her questions verbatim.
11:47

Jane Musgrave:
Parker says prosecutor Sherri Collins has taken classes on how to detect masked phone calls.
11:48

Jane Musgrave:
Prosecution has suggested that someone was pretending to be Chubb INsurance to get Snelgrove to release the Bentley.
11:49

Jane Musgrave:
If the calls were spoofed, they would be illegal, Liz Parker, a member of the defense team, says.
11:49

Comment From BOD
Hearsay all over the place.
11:50

Jane Musgrave:
Liz Parker is asking why Snelgrove didn't investigate the so-called "spoof calls," given that spoofing is illegal. Snelgrove says he didn't know it was illegal until Parker told him just now.
11:50

Comment From Guest1
Did they call Chubb insurance as a witness to see if the calls were "real"?
11:50

Jane Musgrave:
No. they just have Chubb phone records.
11:50

Comment From OWK
There is not doubt that the vehicle was improperly released ! The only issue for Colbath to determine is whether it's release prevents the defendant from obtaining a FAIR trial and interferes with his due process rights. The State is entirely responsible for this nonsense. Seek Justice and protect everyone's rights would have been accomplished by holding on to the evidence until all appeals have been exhausted! SHAME
11:51

Comment From BOD
Police don't issue subpoenas, state prosecutors do.
11:51

Jane Musgrave:
Did prosecutors suggest an investigation be launched into who was making these phone calls to you and pretending to be Chubb?
Snelgrove: No.
11:53

Jane Musgrave:
Liz Parker gets a plug in for own book. Chapter 9, she says, deals with how to investigate spoof calls. She wrote a book about failed murder-for-hire plot "masterminded" by Dahlia Dippolito.
11:55

Jane Musgrave:
Johnson: "They are calling this man a liar.... They are trying to say he never received these phone calls from Chubb Insurance."
Duncan: "We aren't calling him a liar."
11:55

Comment From BOD
Getting a little contentious.
11:55

Jane Musgrave:
Duncan counters that Johnson made even wilder accusations against Goodman, accusing him of making the phone calls to Snelgrove or hiring someone to do so.
11:56

Jane Musgrave:
Scott Richardson, Goodman attorney, said Chubb claim records match the phone records.
11:56

Comment From foxone1
the car didn't malfunction the driver did
11:57

Comment From BOD
Doesn't that possibility of hiring someone to make the calls seem feasible? It does to me.
11:57

Comment From foxone1
everybody but the Defense
11:57

Jane Musgrave:
Chubb gave us claim records. We also asked them for evidence of phone calls made to Snelgrove.
11:58

Jane Musgrave:
"There's an inconsistency between his testimony that he received multiple phone calls and the records," Richardson said.
"He made the statement in his deposition that he was hounded," he continued. So, the team checked it out. They discovered: "Not from Chubb."
11:58

Comment From guest
Maybe the car did malfunction
11:59

Comment From foxone1
I must be the only one in North America with *67
11:59

Comment From Guest
Even if Chubb made 1,000 calls asking for the car, Roberts should not have released it. Is Chubb more important than safeguarding evidence in a homicide?
12:00

Jane Musgrave:
A county telephone guy testified that there's no way to accurately trace calls through the county system, particularly if calls were transferred.
12:01

Jane Musgrave:
Snelgrove said neither defense or state present when he and his team did crash reconstuction. But, he said, all of the information was turned over to both sides.
12:01

Comment From BOD
It's hard to imagine that in this Orwellian age of surveillance, calls to and from a government entity cannot be traced.
12:02

Comment From OWK
Yes Jane and Johnson made those allegations without a spread of evidence! A bit " high schoolish "! Again don't mistake my comments for sympathy for Goodman! I just believe in ethical professionalism. We have the best Judicial system in the world when ALL play by the rules!
12:02

Jane Musgrave:
Yes, that was the point of Liz Parker's cross-examination of Snelgrove. She was pointing out that the prosecution never launched an investigation into the source of the calls to see if Goodman was behind them.
12:02

Comment From BOD
Or perhaps I'm too big of a fan of the show The Wire.
12:04

Jane Musgrave:
Cars in homicide lot for 10-20 years are likely linked to cold cases, prosecutor Johnson says.
12:06

Jane Musgrave:
Snelgrove said he knows of no car kept 10-20 years in the traffic homicide impound lot.
At least 80 to 100 traffic homicide cases are investigated each year. They also keep cars in connection with other crimes. The point: It's a busy place and they need all the space they can get. That's why cars are moved out after trial.
12:06

Comment From Guest
Please RECUSE Colbath and file a motion to move the trial out of the 15th Judicial
12:06

Jane Musgrave:
There already is a request to move the trial out of PBC. It is pending. If they can't get a jury that knows nothing about the case, it will be moved.
12:07

Comment From foxone1
That's a lot of car homicides
12:07

Jane Musgrave:
Yes, Colbath was impressed as well. Scary.
12:08

Comment From OWK
Again really? Johnson ? Likely cold cases? Shouldn't you know?
12:08

Comment From BOD
There's more involved in granting a venue change than the potential jury pool being unaware of the case.
12:08

Jane Musgrave:
Colbath put the motion on hold pending jury selection.
12:10

Jane Musgrave:
Snelgrove is off the stand. Moving to closing arguments.
12:10

Comment From foxone1
The car got scooped up fairly fast considering it was totaled
12:11

Jane Musgrave:
Colbath is going to wait until after lunch for closing arguments. Each side gets 20 mintues.
12:11

Comment From Guest
what are these exhibits? I couldn't hear what the discussion was over an exhibit DD was introducing.
12:12

Jane Musgrave:
I believe he wanted to introduce a letter the defense car expert wrote to Mark Shapiro about wanting to do more testing on the Bentley. It wasn't admitted.
12:12

Comment From BOD
Will Colbath rule at end of today's hearing or deliberate and file a written order/opinion at a later date?
12:13

Jane Musgrave:
I don't think he will rule today. The hearing resumes at 2:45 p.m. See you later.

Jane Musgrave:
In a nutshell, the defense is asking that the charges against Goodman be thrown out because the state released the Bentley and the Hyundai. They claim it was gross misconduct to do so.

Jane Musgrave:
Duerk is being shown a Bentley throttle body assembly. He identifies the throttle blade, housing cover and throttle control module. "I want to understand the terminology," Richardson says.

Jane Musgrave:
Duerk didn't bring a camera when he inspected Bentley in August 2010. Or a video-camera.

Jane Musgrave:
Duerk reviewed his July 2011 deposition and met with the prosecutors office yesterday to discuss his testimony. They asked him about the separation of the throttle body.

Jane Musgrave:

Jane Musgrave:
No damage to the passenger-side throttle body but the driver's side had a separation. "You could see there was an impact of some kind," Duerk says.

Jane Musgrave:
The plastic cap was damaged, Duerk says. This is obviously to refute the defense expert's testimony that the throttle body was damaged while it was at the lot. Duerk is saying it was damaged when he saw it.
