Sierra LaMar Kidnapping Suspect Charged In 3 More Attacks

December 11, 2012 12:29 AM

Snip - The charges of attempted kidnapping came from three alleged confrontations the defendant had with women on March 19 and March 26, 2009 in the parking lots of Safeway stores in Morgan Hill, according to prosecutors.

On March 19, a 36-year-old Morgan Hill woman told Morgan Hill police a man followed her to her car in the parking lot of a Safeway at 840

E. Dunne Ave. around 11 p.m., and about a half hour later a second woman said a man attacked her in the lot of a Safeway at 235 Tennant Avenue.

The second woman, 46, from San Martin, told police her attacker used a stun gun on the back of her neck but fled after someone nearby heard her screams.

On March 26, an 18-year-old Gilroy woman told police she was sitting in her car around 8:40 p.m. at the Safeway lot on East Dunne Avenue when a man opened her car door.

When the woman tried to remove a pocketknife from the glove compartment to defend herself, the man grabbed her hand and pulled the blade to her neck and then fled after she screamed.

Each woman provided police with similar descriptions of the attacker and officers released a sketch of the suspect.

After Torres was arrested in the suspected kidnap-murder of LaMar in May, police determined that he resembled the sketch’s likeness, which led to his arrest in the alleged 2009 attacks.

Torres, 21, who used to work at the Safeway store on Tennant Avenue, was 17 at the time of three 2009 incidents, but Boyd received permission from a juvenile court judge to charge him as an adult.

CBS/KPIX) MORGAN HILL - Antolin Garcia-Torres, suspect in the kidnapping and murder of missing California teen Sierra LaMar, will be charged Wednesday in the alleged attacks on three women in 2009, according to the Santa Clara County District Attorney's Office.

According to CBS San Francisco, the district attorney's office Tuesday filed an amended complaint against Torres to include three separate counts of attempted kidnapping in the commission of a carjacking, Deputy District Attorney David Boyd said.

Santa Clara County Judge Jerome Nadler reportedly said Torres will be arraigned Wednesday in Superior Court on murder and kidnapping charges in the LaMar case and the other charges related to altercations with three women in Morgan Hill in 2009.

The Santa Clara County District Attorney's Office this morning filed two felony counts of California Penal Code 664-209, or kidnapping, against Sierra LaMar murder suspect Antolin Garcia Torres, 21. The charges carry life in prison with the possibility of parole.

SAN JOSE (KCBS) – The man accused of kidnapping and murdering missing Morgan Hill teen Sierra LaMar once again failed to enter a plea in a brief court appearance on Wednesday, as he faces new charges.

Shackled and wearing a brown jumpsuit, Antolin Garcia-Torres was arraigned on additional counts of attempted kidnapping not related to the LaMar case. The 21-year-old stood before the judge and said “Yes, your honor” when asked if he understood the additional charges being added to his case.

Antolin Garcia Torres, accused in the alleged murder-kidnapping of missing Morgan Hill teen Sierra LaMar, was formally charged Wednesday with assaulting three other women in 2009.

Santa Clara County Judge Jerome Nadler ordered Torres to return to court on Feb. 9th to enter pleas in the Lamar kidnap-murder and the three assaults.

At this time with this case, what has been released is not more than information, it is not fact, except that Sierra is still gone and Torres is a suspect identified by LE.

Not only does limited information regarding Torres guilt exist publicly, but that of his innocence as well.

Any comment referring to Torres being guilty or the 'right guy' or definitely the wrong guy, is a presumption based not on the facts of the case, and I will continue to remind the thread of that.

I really wanted to take a look at a few things, and it still irks me with the way the court statement is worded:

felony complaint

(suspect) was ENGAGED IN (directly linking to the crime) AND was AN ACCOMPLICE IN (an assistant)

In other words, he may have been present at the crime and performing the actions stated, but there would seem to be another person involved who also participated in the crime. I still think there is another person involved, and AGT may not be talking in order to protect this person.

Hearing for Sierra murder suspect continued

•Antolin Garcia Torres again waived right to appear in court

Wednesday, February 6, 2013 7:15 pm | Updated: 7:39 pm, Wed Feb 6, 2013.

Snip - The hearing scheduled for Wednesday was continued to Feb. 20 at the same courtroom in San Jose, according to Santa Clara County Superior Court staff. The hearing was continued at the request of the District Attorney’s office, as the prosecutor assigned to the case could not attend court Wednesday due to a family emergency.

A plea hearing for Garcia Torres was also set for April 4.

It baffles me as well Freckles they are still searching weekly... and still nothing! Torres just doesn't look like a mastermind capable of hiding her body for this long and no one finding her... does not make sense to me!! Sad

But she tears up just thinking about how lonely she's been without her bubbly teen, especially thinking about that had Sierra not been abducted March 16 on her way to school in Morgan Hill, she would have been helping her buy a party dress.

MORGAN HILL, Calif. (KGO) -- Saturday marks a grim anniversary for a Morgan Hill family. High school student Sierra LaMar vanished on her way to school on March 16, 2012. Despite countless searches by law enforcement and volunteers, there is still no sign of Sierra.

Family and friends are planning a special event in Morgan Hill and in Fremont.

Burnett Elementary School has become the Sierra LaMar Search Center and on Saturday they will have a balloon release to mark the tragic anniversary of the 15-year-old's disappearance.

Steve LaMar, Sierra's father, and a few volunteers spent Friday afternoon getting ready for a news conference on Saturday. For the whole LaMar family, the last year has been rough.

"Missing Sierra, the frustration, not knowing what happened to her and that part has made it a long year," said Steve.

Seems promising the judge is ready to move forward at the next hearing scheduled for 5/16/2013. The notes from the last hearing request for AGT to appear 'dressed out'.

4/18/2013 hearing highlights -

• Under Plea Conditions, the minute notes read 'The court finds good faith efforts have been made by the prosecution to provide discovery'.

• Under Jail/Prison, the minute notes read, 'The defendant is to be dressed out, have a shower, and shave for the above mentioned court date' (This has never been a request in any of the previous court minutes).

• The Felony Complaint was amended. It appears in the Safeway attacks, counts 2, 3 and 4 the word 'attempted' was added to the 'kidnapping during a carjacking" charge.

• The minutes from the 4/4/2013 were amended. (I'm not sure what was amended)

Sounds like they have found enough to move forward with the case. If they want him to get dressed, it seems they will file on his behalf.

What is this thing where it says 'body discovery?' I thought they are still doing searches?


And the school which served as HQ is being petitioned by some in town to be re-opened. They are building a lot of houses in the area.

Fairly simple to read.

Count one: 3/16/12
Murder of Sierra while committing a felony;

Count two: 3/19/09
Annette Walters: Attempted kidnapping while carjacking
w/gun

Count three: 3/19/09
Miss Lundy: Carjacking with attempted kidnapping

Count four: 3/26/09
Miss Orozco: Carjacking with attempted kidnapping


Appears they are putting ALL of these together to attempt a conviction of some sort OR to show a pattern of related crimes. IMO, that could be a dangerous move...
(BTW, beware the Ides of March! ALL these crimes were in the month of March. )

SAN JOSE -- Two dozen supporters of missing Morgan Hill-area teen Sierra LaMar walked out of court Thursday feeling frustrated after the man suspected of killing her once again did not enter a plea -- nearly a year after his arrest.

The attorney for Antolin Garcia Torres, who is facing charges of murdering Sierra, with the special circumstance of kidnapping, successfully requested the plea hearing be continued to next month.

I believe AGT is now 22 and interestingly his DOB appears to be in March. The date 3/30/1991, appears in some of the court minute orders. He apparently likes the month of March. Sierra was kidnapped in March and the Safeway attacks all occurred in March.

thank you Lash... I was wondering why he was given a "youth" designation at one point... when I had heard that he had a child on the way and a 1.5 year old...
this video is interesting as the sister keeps saying that "they don't have a body, she hasn't come up yet"... her b/f or husband and her are saying the same things... but are physically far apart.. he talks about what kind of DNA is in the bag! Not on the clothes but in the bag!! leaves me with questions!!

The youthful offender status was brought up because at the time of the Safeway Attacks in 2009, AGT would have been 17. He was only days away from turning 18.

the fact the sister keeps saying "she hasn't come up yet" leads me to think that they know something... I wonder if the brother was not alone and he hasn't plead yet to protect the partner? Sister admits that her place of residence was watched as well!

Awwww, thank you so much, I am happy to be here. I have done ALOT of investigations on the Sierra LaMar case ... just on my own. I have my own theory as to what most likely happened. I do feel Sierra is definitely gone though. Sierra and my daughter are friends and they went to school in Fremont together. But what makes it even tougher to deal with is that Sierra and my daughter had just started arguing over a boy that they both like, when Sierra came up missing. What a hard lesson to learn. Im in constant prayer for Sierra and her parents. I ask that you all continue to pray for their family. Thank for the welcome and I am especially glad to be here :)

After Torres was arrested in the suspected kidnap-murder of LaMar in May, police determined that he resembled the sketch’s likeness, which led to his arrest in the alleged 2009 attacks.

Torres, 21, who used to work at the Safeway store on Tennant Avenue, was 17 at the time of three 2009 incidents, but Boyd received permission from a juvenile court judge to charge him as an adult.

Welcome to RC. I am sorry your daughter is missing a friend. I hope Sierra will be brought home. Sierra's family/friends deserve some resemblance of closure and peace. Sadly, I too believe she is no longer with us and I don't believe AGT will ever give up her location.

I also caught AGT's bday was in March, 3/30/1991. His DOB appears in some of the court minute orders. There does appear to be an eerie attachment to March. Sierra was kidnapped in March, all the Safeway attacks occurred in March and now his DOB. I hope LE has looked at all the unsolved cases that occurred in the month of March.

Thank you for the link. I don't know that I personally have ONE theory set in mind. However, I do think that there are ALOT of facts about this case that we are so not aware of. Here is an article that I just cant seem to get out of my mind. I do think this was Sierra in this article, I can feel it in my gut. So terrible. Here is the article:

Residents of the Parkway Lakes RV Park, along with thousands of people all over South County, are eagerly awaiting closure to the case. Two of the RV park’s residents who were outside watching the deputies and divers enter the marshy area surrounding the percolation ponds said they heard a vehicle pull up outside the locked gate late in the night after Sierra was reported missing.
James Silver, 15, said he did not see the vehicle but he heard it pull up to the gate late Saturday night. He was inside his grandmother’s motorhome. He heard the car doors shut, and two men exit. He heard them talking briefly, and the vehicle left about 15 minutes later. One of Silver’s neighbors, Helen Robison, 47, said she heard the same thing but did not see the vehicle or the men associated with it.
Silver’s grandmother, Sandy Mullican, 68, said she was walking her dog a few hours after that, about 4 a.m. Sunday, and heard a loud screaming sound. But she and other residents indicated that the area is inhabited with mountain lions and bobcats, which sometimes make screaming sounds.
“I wasn’t going to stay around and find out,” Mullican said.*
The area between the RV Park and U.S. 101, where the percolation ponds are, is a remote area covered with wild grass, thick brush and woods.*
“I’ve been praying for that little girl every day,” Mullican added.*
Residents also noted that another neighbor, whose name they did not know, was contacted Sunday by what appeared to be parole officers. The resident was detained, but Cardoza said so far no one has been arrested or detained in connection with Sierra’s disappearance.*

My thoughts are: It was that Sunday morning that Sierra's Bag was found near that shed. I hate the thought of this but if this woman heard a loud scream at 4am that Sunday morning, that is probably when he killed her. So so terrible. In reading past attempts AGT made, he always attempted to catch himself a TEENAGER on a FRIDAY. I think he would catch these teens on a Friday, keep them for just the weekend and kill them on Sunday morning (early). Im sure he would tell his mom and wife him and some buddies were fishing. These guys are truly EVIL.

I remember that article. IIRC, wasn't there something found near that area? Whatever it was, Cardoza stated it had no connection. However, that doesn't mean we were being told the truth. Interesting, I get the impression you believe two people were involved. Many others believe this too. I believe he worked alone only because the Safeway attacks don't appear to have been anyone but AGT. However, it is possible someone was waiting in the background for AGT to capture a victim.

Yes, I think it IS probable he committed the Safeway crimes : They had the artist sketches up shortly after the crimes were committed and it does appear to be him for those crimes.

We STILL don't know WHAT HAPPENED to Sierra; WHEN did it happened; WHERE is she?

IMO - THAT SURE WOULD BE (ALOT) OF PLANTING DNA GOING ON THERE HU? Just look at AGT's face the couple of times he has actually showed up in court. The first time, he stood with his head down, looking at the floor. If that's not guilt, WHAT IS? The second time he stood there gazing with pursed lips, probably planning his next evil deed. I mean for PETE'S SAKE (look at his myspace) and its been said all over the net that AGT is a speed freak. Im sorry, but you would have to come up with something awfully good to make me think HE DIDNT DO IT. Just sayn

There are simply just TOO MANY thing that POINT straight to (AGT) his dna, her dna, his car, direct evidence that he murdered her, safeway assults, other attempted kidnappings (on a Friday) same color car with a black hood and tented windows, .... I mean CMON .... how can ANYONE even think, "gee ... are you SURE it was him?" is BEYOND me .... IMO

On Tuesday, even as authorities announced the arrest of a 21-year-old suspect on suspicion of murder, Marlene LaMar vowed not to stop looking for her daughter.

"Her body hasn't been found," Marlene LaMar said at a news conference, her voice breaking. "I believe there was a reason she wasn't found. We're not giving up on that."

But Santa Clara County Sheriff Laurie Smith said there was "direct and circumstantial" evidence that led investigators to believe that Antolin Garcia-Torres, 21, kidnapped and killed the Morgan Hill girl, who disappeared in March on her way to school.

Investigators think Garcia-Torres, a Morgan Hill resident, picked Sierra at random.

"We believe this is the worst kind of crime: a stranger abduction of a young girl," Smith said at Sheriff's Department headquarters in San Jose.

Investigators found the teenager's cellphone March 17, the day after she was last seen walking to her bus stop. The next day, they found a Juicy bag with her clothes folded neatly inside.

DNA was found on the items in the bag, Smith said. After receiving lab results March 28, Smith said, investigators identified Garcia-Torres — already in the system for a previous arrest — as their suspect and began around-the-clock surveillance.

"We needed additional information," Smith said. "We were hoping he would lead us to where Sierra was."

Smith did not elaborate on why detectives made the arrest Monday night at a Morgan Hill Safeway grocery store except to say that "public safety was our primary concern."

"Even though we had been surveilling him, surveillance is not perfect," she said. "We wanted to make sure this did not happen again."

After officials recovered Garcia-Torres' red Volkswagen Jetta, they found additional evidence linking him to Sierra, Smith said. She declined to elaborate on the evidence but said it did not include blood.

The DNA also connected Garcia-Torres to a March 2009 assault in Morgan Hill, Smith said. She did not disclose the specifics of that incident.

Garcia-Torres, who was previously convicted on a misdemeanor charge of interfering with a police officer, was also arrested but not prosecuted in connection with a felony assault. Smith said that the assault was not sexual, but that the arrest resulted in Garcia-Torres' inclusion in the DNA database used to identify him as a suspect.

Garcia-Torres' sister told the San Jose Mercury News, "It's not him."

"I honestly feel they don't have enough evidence to convict him," 26-year-old Lucero Garcia said.

Garcia said her brother is married with a young daughter. His wife is three months pregnant.

"It feels like we're in a movie right now," she said. "An unfair movie."

Several details are still not known about Sierra's disappearance, Smith said, including where her body is, how she was killed or when.

Other suspects were identified and watched during the investigation, Smith said, but detectives believe Garcia-Torres acted alone.

Although neither a weapon nor a body has been found, Smith said, investigators have "strong facts" indicating that Sierra was murdered.

"These are very, very difficult cases to prosecute, a homicide when you have not found a victim," she said. "But it has been done."

Marlene LaMar begged her daughter's suspected killer to "say where she is."

"Please, please give the information that you have to lead us to Sierra to help end this nightmare," she said.

Judge Sharon Chatman scheduled a new plea hearing for Antolin Garcia Torres for July 23 after his lawyer said prosecutors had not turned over required information to the defense.

Santa Clara County sheriff announces the arrest of a suspect in Sierra LaMar's slaying. She says there is 'direct' evidence the Morgan Hill girl, 15, is dead.

Investigators don't know where 15-year-old Sierra LaMar is, but they are almost certain she is dead.

For more than two months, the high school cheerleader's family has been holding out hope. They have organized repeated searches of the Northern California neighborhood where she disappeared and made numerous public appeals for help.

On Tuesday, even as authorities announced the arrest of a 21-year-old suspect on suspicion of murder, Marlene LaMar vowed not to stop looking for her daughter.

"Her body hasn't been found," Marlene LaMar said at a news conference, her voice breaking. "I believe there was a reason she wasn't found. We're not giving up on that."

But Santa Clara County Sheriff Laurie Smith said there was "direct and circumstantial" evidence that led investigators to believe that Antolin Garcia-Torres, 21, kidnapped and killed the Morgan Hill girl, who disappeared in March on her way to school.

Investigators think Garcia-Torres, a Morgan Hill resident, picked Sierra at random.

"We believe this is the worst kind of crime: a stranger abduction of a young girl," Smith said at Sheriff's Department headquarters in San Jose.

Investigators found the teenager's cellphone March 17, the day after she was last seen walking to her bus stop. The next day, they found a Juicy bag with her clothes folded neatly inside.

DNA was found on the items in the bag, Smith said. After receiving lab results March 28, Smith said, investigators identified Garcia-Torres — already in the system for a previous arrest — as their suspect and began around-the-clock surveillance.

"We needed additional information," Smith said. "We were hoping he would lead us to where Sierra was."

Smith did not elaborate on why detectives made the arrest Monday night at a Morgan Hill Safeway grocery store except to say that "public safety was our primary concern."

"Even though we had been surveilling him, surveillance is not perfect," she said. "We wanted to make sure this did not happen again."

After officials recovered Garcia-Torres' red Volkswagen Jetta, they found additional evidence linking him to Sierra, Smith said. She declined to elaborate on the evidence but said it did not include blood.

The DNA also connected Garcia-Torres to a March 2009 assault in Morgan Hill, Smith said. She did not disclose the specifics of that incident.

Garcia-Torres, who was previously convicted on a misdemeanor charge of interfering with a police officer, was also arrested but not prosecuted in connection with a felony assault. Smith said that the assault was not sexual, but that the arrest resulted in Garcia-Torres' inclusion in the DNA database used to identify him as a suspect.

Garcia-Torres' sister told the San Jose Mercury News, "It's not him."

"I honestly feel they don't have enough evidence to convict him," 26-year-old Lucero Garcia said.

Garcia said her brother is married with a young daughter. His wife is three months pregnant.

"It feels like we're in a movie right now," she said. "An unfair movie."

Several details are still not known about Sierra's disappearance, Smith said, including where her body is, how she was killed or when.

Other suspects were identified and watched during the investigation, Smith said, but detectives believe Garcia-Torres acted alone.

Although neither a weapon nor a body has been found, Smith said, investigators have "strong facts" indicating that Sierra was murdered.

"These are very, very difficult cases to prosecute, a homicide when you have not found a victim," she said. "But it has been done."

Marlene LaMar begged her daughter's suspected killer to "say where she is."

"Please, please give the information that you have to lead us to Sierra to help end this nightmare," she said.

 The highlighted sentences for me say the whole story... she did not say my brother did not do this... just that they did not believe there was
enough evidence to convict... the family knows something IMO.

Hmmm. Why not try to cut a deal and lead them to Sierra's body?
Is he afraid there could be other compromising details there?
