Authorities believe missing Northern California girl is dead

Santa Clara County sheriff announces the arrest of a suspect in Sierra LaMar's slaying. She says there is 'direct' evidence the Morgan Hill girl, 15, is dead.

May 23, 2012|By Kate Mather, Los Angeles Times

Investigators don't know where 15-year-old Sierra LaMar is, but they are almost certain she is dead.

For more than two months, the high school cheerleader's family has been holding out hope. They have organized repeated searches of the Northern California neighborhood where she disappeared and made numerous public appeals for help.

On Tuesday, even as authorities announced the arrest of a 21-year-old suspect on suspicion of murder, Marlene LaMar vowed not to stop looking for her daughter.

"Her body hasn't been found," Marlene LaMar said at a news conference, her voice breaking. "I believe there was a reason she wasn't found. We're not giving up on that."

But Santa Clara County Sheriff Laurie Smith said there was "direct and circumstantial" evidence that led investigators to believe that Antolin Garcia-Torres, 21, kidnapped and killed the Morgan Hill girl, who disappeared in March on her way to school.

Investigators think Garcia-Torres, a Morgan Hill resident, picked Sierra at random.

"We believe this is the worst kind of crime: a stranger abduction of a young girl," Smith said at Sheriff's Department headquarters in San Jose.

Investigators found the teenager's cellphone March 17, the day after she was last seen walking to her bus stop. The next day, they found a Juicy bag with her clothes folded neatly inside.

DNA was found on the items in the bag, Smith said. After receiving lab results March 28, Smith said, investigators identified Garcia-Torres — already in the system for a previous arrest — as their suspect and began around-the-clock surveillance.

"We needed additional information," Smith said. "We were hoping he would lead us to where Sierra was."

Smith did not elaborate on why detectives made the arrest Monday night at a Morgan Hill Safeway grocery store except to say that "public safety was our primary concern."

"Even though we had been surveilling him, surveillance is not perfect," she said. "We wanted to make sure this did not happen again."

After officials recovered Garcia-Torres' red Volkswagen Jetta, they found additional evidence linking him to Sierra, Smith said. She declined to elaborate on the evidence but said it did not include blood.

The DNA also connected Garcia-Torres to a March 2009 assault in Morgan Hill, Smith said. She did not disclose the specifics of that incident.

Garcia-Torres, who was previously convicted on a misdemeanor charge of interfering with a police officer, was also arrested but not prosecuted in connection with a felony assault. Smith said that the assault was not sexual, but that the arrest resulted in Garcia-Torres' inclusion in the DNA database used to identify him as a suspect.

Garcia-Torres' sister told the San Jose Mercury News, "It's not him."

"I honestly feel they don't have enough evidence to convict him," 26-year-old Lucero Garcia said.

Garcia said her brother is married with a young daughter. His wife is three months pregnant.

"It feels like we're in a movie right now," she said. "An unfair movie."

Several details are still not known about Sierra's disappearance, Smith said, including where her body is, how she was killed or when.

Other suspects were identified and watched during the investigation, Smith said, but detectives believe Garcia-Torres acted alone.

Although neither a weapon nor a body has been found, Smith said, investigators have "strong facts" indicating that Sierra was murdered.

"These are very, very difficult cases to prosecute, a homicide when you have not found a victim," she said. "But it has been done."

Marlene LaMar begged her daughter's suspected killer to "say where she is."

"Please, please give the information that you have to lead us to Sierra to help end this nightmare," she said.

The highlighted sentences for me say the whole story... she did not say my brother did not do this... just that they did not believe there was
enough evidence to convict... the family knows something IMO.

Wow!!! You know what? YOU ARE RIGHT ... twisted sister's statement had not caught my attention that way. But YES, you are right. Why didnt she state "MY BROTHER DID NOT COMMIT THIS CRIME PEOPLE!!!" Yeah They KNOW stuff alright ..... IMO2

Here is a statement by Alondra Garcia. IMO she uses the word "YET" review her statement and tell me what you guys think.

Alondra Garcia: I don't think he's capable at all of doing something like that.
I don't really see him as that violent - you know, like- he's pretty mellow. So, he's not like a violent guy at all. He's a good guy. He's social. He likes- he likes fishing, he likes doing outdoor things, he's with his family a lot- you know, he's a hard worker. He works a lot, too. I don't think they have enough proof yet. Like, substantial proof. I think he's innocent, you know. What I have in my mind is innocent until proven guilty- but like, full- you know, full proven, you know?

Sierra LaMar Case Delayed Again, Prosecutors Review New Evidence

July 23, 2013 7:47 PM

SAN JOSE (CBS SF) – The Sierra LaMar murder and kidnap case was delayed in a San Jose courtroom to next month as prosecutors sift through evidence still coming in from law enforcement agencies, a prosecutor said Tuesday.

Santa Clara County Judge Sharon Chatman set a new hearing for Aug. 22 to review the status of evidence sent by the district attorney’s office to lawyers for murder defendant Antolin Garcia Torres.

This is one of the first cases I followed... and it makes no sense why this is taking so long to get this POS to plead. This poor family needs some kind of closure...or movement! Something!!!

Man accused of killing teen appears in court

Antolin Garcia Torres fails to enter plea

Published  7:01 PM PDT Oct 03, 2013

MONTEREY, Calif. —The man accused of killing Morgan Hill teen Sierra Lamar has again failed to enter a plea during a court appearance Thursday.

Antolin Garcia Torres is charged with the kidnapping and murder of Lamar in March 2012. A legal analyst said defense attorneys likely won't enter a plea until they've received all the evidence from prosecutors.

On Thursday, attorneys told a judge they haven't received all the evidence. The defense also said since they don't have all the evidence this could be a missing person's case not a murder investigation.

"This was the first time that we’ve seen the defense come out and start to give us a signal as to where they’re going in this case, at least preliminarily,” said legal analyst Steven Clark. “And until Sierra’s body’s found, they’re going to pursue this avenue of defense.”

I am hoping that on November 15th AGT's next court date that a plea will be entered. I still find it strange that the man would rather sit in Jail than enter a plea and take his chances.. if they don't think there is enough evidence to prove she isn't alive then plead not guilty and hope for the best. There has to be some other reason they are waiting!! JMO

Garcia Torres plea hearing continued to January

Sierra LaMar murder suspect remains in custody; 17 months have passed since defendant’s first court appearance

Posted: Friday, November 15, 2013 3:56 pm

By Michael Moore

Attorneys involved in the case of the man accused of murdering Morgan Hill teen Sierra LaMar continued to verbally spar over the sluggish evidence disclosure process at a hearing Friday, but the suspect again declined to enter a plea.

Antolin Garcia Torres, 22 of Morgan Hill, appeared at the hearing at the Hall of Justice in San Jose. He was handcuffed and wearing County Jail inmate scrubs - a contrast to recent previous hearings where he wore a brown suit and tie.

~Snipped~

Garcia Torres’ attorney Friday told Superior Court Judge Sharon Chatman that a spreadsheet listing items of evidence, provided by prosecutors and requested at Garcia Torres’ last hearing in October, was “inadequate.” The list only indicated evidence provided by the Santa Clara County District Attorney’s Office so far, while Garcia Torres’ attorney Al Lopez was under the impression the spreadsheet would include a list of items that are “going to come our way.”

Santa Clara County Deputy DA David Boyd was consequently perturbed that the defense waited until Thursday’s hearing to let him know their view on the completeness of the list of evidence.

Sierra Lama Murder, Kidnapping Suspect Appears in Court

By Monte Francis | Thursday, Jan 9, 2014 | Updated 4:45 PM PST

It’s been more than a year and a half since his arrest, and the man accused of kidnapping and killing Morgan Hill teenager Sierra Lamar still has not answered to the charges.

Antolin Garcia Torres appeared in Santa Clara County Superior Court on Thursday and again, refused to enter a plea.

~Snipped~

Judge Sharon Chatman refused to enter a plea on the defendant’s behalf and set a new hearing date for March 3rd. At that time, she said she expected that a date for a preliminary hearing would be set, and that Garcia Torres would also enter a plea.

New Lead in Sierra Lamar Case Sends Divers Searching South Bay Lake

By Erin Sherbert | Fri., Feb. 7 2014 at 8:58 AM

A Santa Clara County Sheriff's Office dive team returned to a South Bay lake Thursday, combing the waters for evidence in the case of Sierra Lamar, the 15-year-old girl who vanished while on her way to school two years ago.

NBC News spotted the divers supposedly training at the lake, but sources close to the investigation later told the news station that the divers were actually there looking for evidence in that murder case after potentially new leads had surfaced. They were reportedly equipped with new powerful sonar that allows them to better locate bodies in murky waters.

NBC News wouldn't reveal the location of the lake so as to not hurt the investigation. The same undisclosed sources also told the news station that this was the second time divers had gone out to this particular lake, which they described as a "high interest" to investigators.

Sierra LaMar: Suspect in kidnapping, killing indicted by grand jury

By Eric Kurhi

Posted:   02/11/2014 04:51:24 PM PST | Updated:   about 2 hours ago

SAN JOSE -- Antolin Garcia-Torres, who was arrested last May in the kidnapping and killing of 15-year-old Sierra LaMar, was indicted Tuesday for the crime by a Santa Clara County Superior Court grand jury.

In addition to the killing of the young Morgan Hill resident, Garcia-Torres was indicted for a series of violent attacks on South Bay women in 2009, the Santa Clara County District Attorney's Office said Tuesday.

The indictment means he will now go directly to trial instead of face a preliminary hearing.

Garcia-Torres, 22, who has been in out of court without entering a plea since his arrest, will be arraigned Thursday at 1:30 p.m. The charges brought on by the indictment supersede those previously filed by the district attorney's office.

Sierra LaMar's Father: "Not Knowing What Happened" Is Most Frustrating After 2 Years

By Riya Bhattacharjee and Marianne Favro    |  Sunday, Mar 16, 2014  |  Updated 7:28 AM PDT

Two years after Morgan Hill teenager Sierra LaMar was last seen near the bus stop near her home, the search to find her continues.

Friends, family and even strangers have volunteered – and continue to volunteer – their time to bring Sierra home, hopeful that she is still alive. But it hasn’t been easy, especially for the LaMars.

Sierra’s father Steve LaMar, spoke with NBC Bay Area about his daughter and how the family is holding up two years after the disappearance.

“I am doing OK, it’s tough, especially at this time. It’s been very frustrating two years – we haven’t really found anything with the searches but we are still doing that,” Steve LaMar said.

LaMar described the length of the court process as “frustrating.”

Friends Dedicate Memorial Bench in Honor of Missing Teen Sierra LaMar (Video)

By NBC Bay Area Staff and Wires   |  Sunday, Mar 16, 2014  |  Updated 6:27 PM PDT

Family and friends of missing Morgan Hill teenager Sierra LaMar marked the two-year anniversary of her disappearance with a new memorial Sunday.

They dedicated a bench in her honor at the school she once attended: Washington High School in Fremont.

The circular bench wraps around a tree on the campus. Friends of 15-year-old Sierra, who vanished outside her home near Morgan Hill on March 16, 2012, wanted to dedicate the bench at Washington in her memory because it would have been her last year of high school.

Death penalty sought in missing California teen case

Published May 19, 2014 · Associated Press

SAN JOSE, Calif. –  Prosecutors are seeking the death penalty against a man charged with kidnapping and killing a 15-year-old Northern California girl whose body has not been found, the District Attorney's Office said on Monday.

Santa Clara County District Attorney Jeff Rosen said he made the decision to seek capital punishment against Antolin Garcia-Torres in the 2012 disappearance of Sierra LaMar after a "comprehensive review" by a committee of senior prosecutors.

"I have concluded that this defendant should face the ultimate penalty," Rosen said. He said he would not be making any additional comments to ensure that Garcia-Torres receives a fair trial.

Sorry, I am so far behind can anyone tell me what happened during the September hearing… after unsealing the Grand Jury record… reading that it was hair on a rope that was found makes the earlier question we all had about what was found in the car make much more sense.. I wish that they would find her.

AGT finally pled...not guilty. Awaiting trial. Both attorneys are preparing for the capital case. I expect the trial will begin early next year. Nothing more on the hair on the rope or any other evidence.

thank you Lash…

I still can not comprehend why someone would sit in custody all that time and not plead… unless they are planning a huge lawsuit for being in custody for so long without a trial… but can't see that working.. or maybe it was his way of not going back to visit the crime scene (didn't trust himself not to go) … or showing a partner that he is loyal and not saying anything… alright so my mind has raced trying to figure out why someone would sit that long..

I just want to know where her body is located and why!!!
WHY!!! Did he not know the consequences of his actions?
It is apparent, if he did this, he did not CARE FOR HER.
Well, did he not care for himself? Those of his family who are now branded by association with him?

Sicko.
Illogical.

MORGAN HILL, Calif. (KGO) -- A man accused of kidnapping and killing Sierra LaMar, 15, is expected be back in court.

A judge will set a trial date for Antolin Garcia-Torres.

Prosecutors say LaMar's DNA was found in Garcia-Torres' car along with evidence that implicates him in two previous attempted kidnapping cases.

LaMar vanished while walking to her school bus stop in Morgan Hill three years ago.

Officials have not been able to find her remains.

Sierra LaMar Murder Trial Date Set (Video)

Antolin Garcia-Torres faces murder charge even though girl's body has never been found

By  Robert Handa

Updated at 12:10 AM PDT on Thursday, Sep 3, 2015

Her body has never been found, but Sierra LaMar’s suspected killer remains in a South Bay jail, and after countless delays, a trial date has finally been set.

LaMar’s family and longtime supporters were stunned and relieved on Wednesday when Judge Thang Barrett set a trial date of April 25, 2016, for Antolin Garcia-Torres.

Garcia-Torres looked composed in court Wednesday. He is accused of murdering the 15-year-old in Morgan Hill on March 16, 2012. Her body has never been found.

LaMar’s father told NBC Bay Area the judge’s decision to set a date is good news, even as the defense vows to keep fighting.

Body of Murder Victim Found in Santa Cruz Mountains
By Jennifer Wadsworth

".....He reportedly accused Myrick of being part of some conspiracy involving the high-profile kidnapping and killing of Morgan Hill teen Sierra LaMar.

"I was framed," Hlebo said in a separate 45-minute conversation with NBC Bay Area. "I am innocent. It's something out of a science fiction novel, really."

According to a statement penned by San Jose Sgt. Paul Hamblin and Detective Jason Tanner, however, Hlebo killed Myrick after a scuffle, dragged his body into a truck and dumped it in the mountains south of San Jose....."

Sheriff Smith says Sierra LaMar is dead, Morgan Hill man is the killer
By Julia Prodis Sulek, Mark Gomez and Robert Salonga Mercury News
POSTED: 02/11/16, 11:00 AM PST

"....Smith said investigators initially had many suspects, but right now they believe only one person is responsible for the kidnap and murder of Sierra: Garcia Torres.

The first deputy who responded to the March 16 missing person's report on Sierra knew immediately she was not a runaway, Smith said. But Sierra was not taken off the missing person's list until 10 days after her disappearance.

Two days after she was reported missing, Sierra's bag and some clothing were found.

"It was that clothing that was really instrumental in identifying the suspect," Smith said.

Smith said from March 28 on, Garcia Torres was under 24-hour surveillance, hoping they would find Sierra.

"He may have believed he was under surveillance," Smith said. "We talked to him multiple times.''..."

Morgan Hill: Missing girl's cell phone found three-quarters of a mile from her home

"...A Morgan Hill teen girl who was last seen Friday morning before heading to school remains missing, according to the Santa Clara County Sheriff's Office.

The Santa Clara County Sheriff's Office, which led the weekend search efforts for 15-year-old Sierra Lamar, on Monday morning confirmed the girl's cell found was discovered Saturday shortly before 7 p.m. about three-quarters of a mile from her house at Dougherty and Palm avenues, according to Sgt. Jose Cardoza.

Sierra's phone was located at the northeast corner of Scheller Avenue and Santa Teresa Boulevard. Investigators are examining the cell phone and Sierra's computer. They are also interviewing students at Sobrato High School and Fremont's Washington High School, where Sierra attended before transferring to Sobrato last fall...."

Human Remains Found in Gilroy Not Sierra LaMar: Sheriff's Office

"...The prosecutor in the Sierra Lamar murder case spent Thursday afternoon in Gilroy, looking at the remains of a body found in the outskirts of town the day before.
Santa Clara County Sheriff's Office authorities said the remains were not those of LaMar, who was murdered in 2012 and whose body has yet to be found. Sgt. James Jensen said dental work found on the teeth of the remains had gold caps.

FINALLY ~ The date for the trial has been set for: April 25, 2016. These trials should not be allowed to drag on and on, when there is enough evidence to convict.

It is costly, and extremely emotionally painful for the family of Sierra La Mar. I feel so sad for them.

Not Sierra... but I want o know what is in the water up there??
Another one....
Shelly Titchener, 57 yo, Fremont, CA

Torso found in Fremont may belong to missing woman

"...The remains of a woman that has been missing since February 13 may have been found in Fremont, reports ABC News. Shelly Titchener, 57, was reported missing by her husband, Paul Kitchener on Feb. 15. Titchener told KRON news that he and his wife got into a disagreement on February 13 and she told him she was going to stay with a friend. Later it was found that none of her friends said that she had contacted them. Paul Titchener and his son, James were seen putting up missing posters in the neighborhood.

On Tuesday the Fremont police stated that the man that had died after he jumped off the Bay Bridge was identified as Paul. Just two days prior a torso was found about 30 minutes from the couple’s home near Dumbarton Pier. The Brisbane and Fremont Police Depts. have cordoned off the Titchener home and have called it an active crime scene...."

Gosh, there might be a further delay.  We should know more on Monday.

Snip Garcia-Torres' lawyers filed a motion in court Thursday, requesting the profiles of the other 11 people who also were hits in the DNA database. If the defense attorneys get their wish, Clark said the trial will likely not start next month, as scheduled.  End Snip

Sierra LaMar Murder Trial: Defense Gains Access to DNA Analysis (Video)

The case started four years ago this week when the Morgan Hill teen disappeared while walking to a school bus stop.

By Damian Trujillo

Attorneys representing the suspect in the Sierra LaMar murder trial will now be getting access to a potential key piece of evidence: DNA analysis.

The lawyers for Antolin Garcia-Torres filed a motion last week to obtain the evidence. A crime lab previously tested the DNA on LaMar's pants and received a hit on 12 profiles, with one of those profiles being Garcia-Torres.

Lawyers representing Garcia-Torres escorted the suspect into court on Monday and announced the defense "went over both protective orders and came to an agreement" to gain access to the evidence.

The defense wants to know who the other 11 profiles from the lab test belong to.

They have found 11 OTHER profiles from others who ARE in the DNA criminal data base...
I am trying to recall: Where were the pants found?

Vid indicates a rope was found in trunk of his car that had hair belonging to her...
I was not aware a rope had been implicated in this crime... Wow. More evidence is coming to light.

Trial opens today.

'Sierra LaMar is dead. And this man killed her!' Prosecution lawyer dramatically points his finger as trial of man accused of killing 15-year-old cheerleader begins

"...A search for the car began after it was captured on several surveillance videos close to the missing teen's home and the area where authorities recovered some of her belongings.

Sierra's cellphone was found near the side of the road the day after she vanished and her Juicy brand black and pink purse with clothes folded neatly inside was found the day after that.

There is also evidence linking his DNA to clothing found in Sierra's abandoned backpack, which was tossed in a shed not far from her home.

The reveal dirt stains and reflective beads from the road were found on her jeans, indicating she was dragged, according to Fox 5.

Legal Analyst Steven Clark said prosecutors are relying heavily on forensic DNA evidence to prove Garcia-Torres' guilt. ..."

Friends of 'clean-cut' cheerleader, 15, who vanished four years ago tell her accused killer's murder trial she planned to take ecstasy on the day she disappeared and smoked marijuana

".....Her friend Shannon Foreman reluctantly told the court that Sierra had texted that she was 'excited about going to Freemont and popping pills,' the day she disappeared.

Foreman also said she had seen Sierra take ecstasy one or two times before.

Garcia-Torres' defense team claim the teenager had contact with people in the criminal underworld and could have either run away or been abducted by drug dealers. ...."

Lawyers for man accused of killing 15-year-old cheerleader Sierra LaMar tell the court she ran away leaving behind a note saying 'I hate my life'... but the prosecution says the handwriting is not hers

"...Handwriting expert John Bourke, an analyst in the Santa Clara County District Attorney's Office crime lab, testified that Sierra had 'probably' not written the note, as many letters in it had 'significantly' different characteristics from her known writing samples. ...."

".... Garcia-Torres is the owner of a red car caught on surveillance camera near her home on March 16, the day of her disappearance, which was seized by police before his arrest.

Sierra hasn't been seen or heard from since she left her home in Morgan Hill to go to school on March 16, 2012. Authorities believe she was kidnapped while walking to a bus stop.

Authorities arrested Garcia-Torres two months after her disappearance at the convenience store where he worked. ...."

Sierra LaMar trial: Investigators, arborist testify

Volunteer searchers continue to attend court in San Jose

Posted: Wednesday, February 15, 2017 4:11 pm

Testimony in the trial for Sierra LaMar’s suspected killer continued this week, with more witnesses from the Santa Clara County Sheriff’s Office taking the stand to answer questions about the investigation that led to the arrest of Antolin Garcia Torres.

On Feb. 14, sheriff’s deputies and sergeants spent hours in court at the San Jose Hall of Justice offering details of their surveillance of Garcia Torres in the days after Sierra disappeared March 16, 2012. Santa Clara County Deputy District Attorney showed numerous video clips from a security camera outside Garcia Torres’ neighborhood, Maple Leaf RV Park in south Morgan Hill, from March 16 to March 18, 2012.

The videos showed Garcia Torres coming and going in his red Volkswagen Jetta, as well as arrivals and exits of his mother’s Toyota RAV4.

Garcia Torres went on a ski trip with a friend all day March 18, a Saturday, defense attorney Al Lopez said.

Other law enforcement officers testified about the GPS tracking device they attached to Garcia Torres’ vehicle shortly after he became a suspect in Sierra’s disappearance. Multiple agencies, including the FBI, assisted in the surveillance, which did not lead to the discovery of Sierra’s body.
