While the FBI continues to piece together this case, construction workers who have been roofing next door may be key witnesses in the investigation.

Anthony Gardner, a contractor says, "On Wednesday we heard a lot of arguing. I didn't think much of it; I wish I would have now."

He says other crew members smelled something burning last Thursday. They said it smelled different, like flesh. They have been interviewed by investigators several times.

Anthony Bennett was in enough trouble before he was ordered last week to stand trial for allegedly assaulting a corrections officer.

Bennett, who has been in the Bay County Jail since his arrest for suspected child abuse in June, is accused of assaulting 4-year-old Carnel Chamberlain, whose remains were found under the porch of the home in Isabella County where Bennett lived with the boy’s mother.

Not yet charged in Carnel’s death, Bennett was indicted by a federal grand jury in U.S. District Court in Bay City.

BAY CITY, MI — Anthony M. Bennett, the Mount Pleasant man charged with abusing 4-year-old Carnel Chamberlain a month before his remains were discovered, has state and federal trials before him, but the question is which will happen first.

In federal court, the 20-year-old Bennett is to go to trial on Nov. 27 on a charge of assault resulting in substantial bodily injury to a child younger than 16, a five-year felony. On the state level, Bennett is scheduled to face a trial in Bay County Circuit Court on the same day on two counts each of assaulting a prison employee and assaulting, resisting or obstructing police and one count of malicious destruction of property between $200 and $1,000.

“I would imagine the federal case would proceed first,” said Bay County Prosecutor Kurt C. Asbury.

A federal grand jury on Wednesday indicted the man long suspected of killing 4-year-old Carnel Chamberlain in June.

Already facing abuse charges against the boy, Anthony Michael Bennett, 20, is charged in U.S. District Court in Bay City with first-degree murder.

A seven-count superseding indictment charges Bennett, who is accused of killing Carnel at his mother’s Tomah Road home on the Isabella Reservation, with killing Carnel while abusing him on June 21, according to U.S. Attorney spokeswoman Gina Balaya.

BAY CITY -- A judge has entered a not guilty plea for a man at his arraignment in federal court in the death of a 4-year-old boy whose charred remains were found on a Saginaw Chippwa Indian reservation.

Anthony Bennett has been in custody on another charge since Carnel Chamberlain's remains were found June 28 at a home on the Saginaw Chippewa Indian reservation, about 70 miles north of Lansing. He was living with Carnel and the boy's mother.

A Nov. 7 grand jury indictment charges him with first-degree murder, assaulting a child, assault with a dangerous weapon, animal cruelty and witness tampering.

Bennett stood mute Tuesday at his appearance in Bay City federal court. He remains jailed, and his next court date is Nov. 27.

BAY CITY, MI — A jury will decide the fate of Anthony Bennett, the man charged with killing 4-year-old Carnel Chamberlain on the Saginaw Chippewa Indian Reservation in Mount Pleasant, beginning in April, according to court documents filed Tuesday, Nov. 27.

Magistrate Judge Charles E. Binder signed the order to schedule the jury trial to begin on April 23, 2013, at 8:30 AM before District Judge Thomas L. Ludington.

Jaimee Chamberlain, charged in Emmet County with several drug offenses, has agreed to testify against two others accused of selling drugs to undercover police officers.

Chamberlain, the mother of 4-year-old Carnel, who was murdered in June, pleaded guilty on Monday to possession of marijuana.

She agreed to testify against Jade Pelcher, 21, and Nicholas Bonstelle, 22, who were arrested with her near Petoskey in December, Emmet County Prosecutor James R. Linderman said.

MOUNT PLEASANT, MI — The house where 4-year-old Carnel Chamberlain lived has been removed from the property at 7340 E. Tomah.

Chamberlain's body was found underneath the porch of the home on June 28, 2012, one week after he was reported missing.

The house was split in half and taken away on a flatbed truck on Wednesday, Jan. 2, Chamberlain family spokesman Kevin Chamberlain said.

BAY CITY, MI — The Mount Pleasant man charged federally with killing a 4-year-old boy has a day to decide whether or not he’ll take a plea.

U.S. District Magistrate Judge Charles E. Binder is to preside over a plea hearing for Anthony M. Bennett at 11 a.m. on Thursday, March 21, at the federal courthouse in downtown Bay City. Bennett, a member of the Saginaw Chippewa Indian Tribe who turned 21 on Monday, March 11, is charged with seven counts — first-degree murder, assault resulting in substantial bodily injury, assault within special maritime or territorial jurisdiction, assault with a dangerous weapon, animal cruelty and two counts of tampering with a witness, victim or informant.

The hearing does not mean Bennett is entering a guilty or contest plea, just that it is the last possible day for him to enter such a plea before the case goes to trial. The Times has been unable to contact federal prosecutors or defense attorney Anthony T. Chambers to determine the likelihood of Bennett entering a plea or if a plea offer has been made.

An Isabella County man accused of murdering a 4-year-old boy is headed for trial next month.

Thursday marked the deadline for a plea agreement in U.S. District Court in Bay City for Anthony Michael Bennett, 21, of Chippewa Township.

Bennett is charged with the June 21 first-degree murder of Carnel Chamberlain, whose remains were found under the porch at his mother’s Tomah Road home a week later.

Bennett and Carnel’s mother, Jaimee Chamberlain, shared the home.

Bennett’s trial begins April 23 at 8:30 a.m. in U.S. District Judge Thomas L. Ludington’s Bay City courtroom.

BAY CITY, MI — Anthony M. Bennett, the Mount Pleasant man charged with killing his girlfriend's 4-year-old son, has a new attorney, due to his previous one being temporarily suspended from practicing law.

The Michigan Attorney Discipline Board on Monday, April 22, ruled Anthony T. Chambers' license to practice law be suspended for 180 days. A hearing panel ruled that Chambers, who practices out of Detroit, neglected several legal matters.

BAY CITY, Mich. (AP) - A federal judge in Bay City has delayed the trial of a man in the death of a 4-year-old boy whose badly burned remains were discovered buried on the Saginaw Chippewa Indian Reservation.

Twenty-1-year-old Anthony Bennett was set for trial this spring in last year's killing of Carnel Chamberlain.

Judge Thomas L. Ludington delayed the trial until Jan. 14 after Bennett's previous lawyer had his law license suspended and John A. Shea took over the defense.

Bennett faces first-degree murder, assault and other charges.

MT. PLEASANT, MI (WNEM) - The murder scene is now an empty lot. The porch and home that hid Carnel Chamberlain's remains for a week are gone. But the memory of the four-year-old won't soon be forgotten.

"As we held hands around this tree, this is all we got right now. This is all we can have right now," said Kevin Chamberlain, a member of Carnel's family.

Friday, a tree planted will help carry on his Carnel's memory. The Red Oak will be planted on this exact spot with the exact soil that covered Carnel's body. The Red Oak is expected to grow to be about 80' tall, and the family says as it matures, so does Carnel in spirit.

An attorney for Anthony Bennett says there's been too much negative publicity about the case. John Shea says Bennett is unlikely to get a fair jury in Bay City federal court because the public could be "poisoned" against him.

I'm sorry but Detroit filed Bankruptcy, so how are they going to afford a trial like this? I just heard it cost the city of Sanford around $35,000 just to put up the jury for GZ's trial. If they have to sequester this jury, they will be fed PB&J sammiches.

Federal prosecutors say there’s no need to move the trial of the man accused of killing a 4-year-old Mt. Pleasant boy in 2012.

The attorney for Anthony Michael Bennett argued in court documents that there’s been too much negative publicity about the case. Bennett, 21, is charged with killing Carnel Chamberlain, whose burned remains were found buried last summer outside the boy’s home on Tomah Road on the Isabella Reservation.

Lawyer John Shea of Ann Arbor says Bennett is unlikely to get a fair jury in Bay City federal court because the public could be “poisoned” against him. Shea asked U.S. District Judge Thomas Ludington to move the case to Detroit.

A federal judge will determine whether an Isabella County man facing a murder charge will be tried in Bay City or another location.

United States District Judge Thomas L. Ludington cancelled a hearing that was set for Tuesday in Bay City to hear prosecutors and Anthony Bennett’s defense attorney argue their cases.

Ludington said legal paperwork filed by assistant U.S. attorneys Roy Kranz and Craig Wininger, and Bennett’s Ann Arbor-based defense attorney, John Shea, were sufficient for him to make a decision.

"Nowhere among the media sources Bennett identifies, although not containing glowing reports of his contributions to society, is there blatantly prejudicial 'evidence of the smoking-gun variety,'" Ludington's opinion states. "The Court is confident individuals in the Northern Division are capable of impartially assessing the evidence to be presented in this case. An impartial jury of 12 can be found among the available 866,000 individuals."

BAY CITY -- The lawyer for Anthony Bennett, the Isabella County man accused of killing 4-year-old Carnel Chamberlain wants the murder charge dropped.

Bennett's attorney, John Shea, filed a motion seeking dismissal of the charge claiming the grand jury indictment is "unconstitutionally vague" and that it violates Bennett's due process right to "adequate notice as to what constitutes the offense."

According to Shea, the indictment against Bennett alleges three different theories of first-degree murder: that it was premeditated, that it was allegedly committed while Bennett was abusing the child, which makes it felony murder, and that it was committed as a part of a pattern of prior assault.

Shea said he is challenging the third theory.

An Isabella County man accused of killing a 4-year-old boy last year should stand trial despite his attorney trying to get a murder charge dropped, a prosecutor said.

In his response to John Shea’s motion asking for U.S. District Judge Thomas L. Ludington to drop the murder charge against Anthony Bennett, Assistant U.S. attorneys Roy Kranz and Craig F. Wininger argued that federal murder law prohibits the unlawful killing of another “with malice aforethought.”

A hearing on the defense motion is set to be argued Nov. 18 at 9:30 a.m. in Ludington’s Bay City courtroom.

In their response to defense attorney John Shea’s motion, Kranz and Wininger said Shea’s assertion that the element of malice aforethought is not applied to felony murder is incorrect.

They also challenged a defense claim that the grand jury indictment against Bennett was vague.

“Murder in all its forms - premeditated murder, second-degree murder, felony murder and ‘misdemeanor murder’ - requires malice aforethought,” the prosecutors said in their response. “Malice, however, does not require proof of an intent to kill.

Anthony Michael Bennett, the Isabella County man jailed for more than a year in connection with the murder of 4-year-old Carnel Chamberlain, has entered a plea in federal court.

Bennett, 21, pleaded guilty Tuesday to second-degree murder in U.S. District Judge Thomas L. Ludington’s Bay City courtroom.

He is scheduled to be sentenced March 27 at 2:30 p.m.

According to the plea arrangement, Bennett, who murdered Carnel at the home he shared with the boy’s mother on East Tomah Road in Chippewa Township June 21, 2012, is to be sentenced to 35 to 40 years in prison, according to court documents

Man pleads guilty to killing 4-year-old boy on Indian reservation

BAY CITY — A young man accused of killing a 4-year-old boy on a central Michigan Indian reservation and burning the body pleaded guilty Tuesday to second-degree murder.

The plea came less than a month before trial was scheduled in Bay City federal court. Anthony Bennett admitted killing his girlfriend’s son, Carnel Chamberlain, in 2012 and burying the remains under a home where the three lived on the Saginaw Chippewa Indian Reservation near Mount Pleasant.

“Bennett acted with callous and wanton disregard for Carnel’s life when he killed Carnel,” according to a 10-page plea agreement signed by prosecutors, Bennett and his attorney.
