I think you're dead on.

Considering how liberal HIPPA seems to be in Fla with regards to law enforcement, it will be interesting to see if O'Mara wins his fight. It will be even more interesting to see what O'Mara himself felt so damaging that he chose to withhold it.

George Zimmerman's defense team on Wednesday announced it would de-activate its official Facebook page, citing concerns about moderating the comments left there by visitors.

"Every post made on Facebook becomes an open thread where anyone on the site can comment, and comments inevitably lead to conversations about evidence and speculation about guilt or innocence," the defense team said on its blog, which will remain active. "This type of conversation is a natural part of discourse, and there are plenty of places on the Internet where it is appropriate for this to happen, but it need not happen on a page hosted by the defense."

The blog post goes on to explain that the "biggest challenge" of the Facebook page is that the defense "cannot post without allowing comments."

For several years now, Facebook users have had 100% ability to disallow replies on the wall to any posts made by the user account. Users can post ANYthing they want and in their privacy settings, they can select the option of commenting on the wall as "Only Me" instead of "Friends" or "Friends of Friends" or "Public".

Either they are technological morons in which case they have no business utilizing the internet -- or they're lying and they're covering their @sses for some other agenda.

They don't have to have their page set up as a fansite -- they could have their page set up as a regular user account which gives them full lock-down of anything they want to lock down. What dopes....

I think that it may be closer to the truth to say that they can't post without the possibility of receiving negative comments which I'm sure takes man power to monitor and delete.

I imagine it was concluded that after experimentation with this particular SM avenue strategically it was just not that important of an activity.

The defense does maintain an overall success at establishing and asserting the humanity of their client and I think the FB page ended up not being as vital a tool as they perhaps postulated with their PR group.

George Zimmerman, the neighborhood-watch volunteer charged with murder in the death of Trayvon Martin, is hoping a judge will allow him to live outside of Seminole County.

He's been restricted to living there since Judge Kenneth Lester set his bail at $1 million, with restrictions that included prohibiting him from leaving the central Florida county.

Zimmerman's living condition "has had an ongoing deleterious effect on his ability to assist in the preparation of his own defense," his attorney, Mark O'Mara, said in a motion made public today. "Communications have been unnecessarily limited to telephone and occasional visits by counsel."

George Zimmerman Asks Judge To Let Him Leave Seminole County

Zimmerman has asked Lester to stop a subpoena for his medical records, saying the request is too broad and will include irrelevant information. A hearing is scheduled for Friday.

In his response filed with the court Thursday, Assistant State Attorney Bernardo de la Rionda wrote that several pages have been provided so far concerning Zimmerman’s treatment at the Altamonte Family Practice on Feb. 27.

At various times Zimmerman and/or his attorney “have asserted that Defendant’s head was repeatedly beaten into the concrete, and that he sustained some injuries to his head, and a broken nose after his struggle with Trayvon Martin on 2/26/2012,” de la Rionda wrote.

“The records provided by Altamonte Family Practice describe what Defendant claims happened when he came into contact with Trayvon Martin, as well (as) treatment administered by a physician’s assistant,” and they refer to Zimmerman being informed that he should be seen by an ear, nose and throat doctor, which he refused to do, de la Rionda wrote.

But, he noted, “The records provided do not include any notes, photographs, X-rays, CT scan, MRI or anything else related to his treatment that day. The State wants to make sure that no other records exist.”

More details on specifics of medical records requested by State


More has been made known about the request for additional medical records by the state. Contrary to speculation - it does not appear the state is seeking volumes of lifelong medical history including RX's, etc. They are requesting specific documentation regarding the care provided by the medical facility GZ visited following the shooting. The currect (and only) medical documents of a whopping THREE pages provided by O'Mara appear to only be transcripts of the conversation GZ had with medical staff giving his account of the evening and their resulting prognosis. No supporting evidence leading to their prognosis was provided -- no evidence of x-rays, c-scans, etc.

George Zimmerman gets permission to travel to Orange County

Judge also rules that he'll review medical records

SANFORD - The judge in the Trayvon Martin-George Zimmerman case agreed this morning to let the defendant travel to Orange County but only to go to his lawyers' offices.

Defense attorney Don West this morning asked Circuit Judge Kenneth Lester to let Zimmerman, 28, move out of Seminole County.

Lester said no, that that entailed too much planning and coordination with local law enforcement agencies, who are required to monitor Zimmerman's whereabouts 24 hours a day.

Bet she took more than what she told them she had
taken.
I know a person who will admit to having had a couple
drinks, but when you question him more you will learn he had a couple in the last 20 min. And he drank and entire case in the six hours prior.

She must have had some high powered drugs or she
was a;ready loaded before she took those last two
HYDROCODONE.

Marica, as a person in recovery I can promise you I almost *never* told the truth by a long shot in terms of consumption. "One or two" was the equivalent of saying "Five or six" or more... And to be intoxicated to the point of swerving off the road very likely involved FAR more than she admitted to. If this is not the first incident, I hope this is her wakeup call to seek help. Usually it takes something like this or family intervention to get someone to treatment before an afflicted person kills someone.

What I'd like to know is what doctor prescribed this mixture to her and were they also the same doctor who prescribed the RX meds to GZ?

Yes Freckles, that would be one angle. And also the possibility exists that GZ did have a prescription for meds, but there is nothing that prevents a person from double-dosing or abusing their RX.

Is it just me or does it often seem like the peripheal family members of people at the center of a criminal investigation or hearing all seem to start getting into trouble with the law as well (?) Dunno...maybe just more focus and scrutiny on them...or perhaps the stress of matters wear them down.

Doubt we would ever have heard about MIL,
unless she had caused a major accident.
Had this been the case and GZ hadn't already
dragged the whole family "under the microscope"
she would have just been another dope addict
destroying lives. Once the spot light is focused,
it is pretty hard for anyone connected to escape
even the dim outer edges.

I have Rx's for HYDROCODONE, and yep Xanax too,
along with a SOMA.. Fortunately, I despise taking
pills and these are ALL as needed. I have been using
these meds for a number of years, and they still work
for me even at minimum dosages, so that tells ya I
don't abuse them.. I cannot imagine anyone taking
enough to be so out of control. Sounds to me like
she is someone who takes these medications to
escape reality. If my medication isn't working as it
is prescribed, then I am on the way to the ER to get
help. Those people know how to deal with pain
without risking my life.

The only two RX's I have ever had in my life were percocet (for wisdom teeth) and hydrocodone (after vein surgery). I tried *one* of the hydrocodone after surgery and it made me so nauseous I couldn't take any more and there is a full bottle - minus one - still in the cabinet that has sat there for 6 yrs (and likely needs to be tossed due to expiration). I think I keep it as a trophy -- to show myself I don't need it. I'm not a pill taker either. Alcohol is my demon but I care nothing of pills and never did. But I agree with you 100% that they train us in treatment center that if anyone takes anything to excess, then they are abusing the effects to escape something -- to escape *feeling*. That is the number #1 reason why anyone abuses substance -- to not feel. Embarrassment, resentment, anger, shame, guilt, etc. Even if you drink to excess because you think you're happy or celebrating -- there's an underlying deceptive agenda at play going on in your subconcious that you are repressing, even in times of happiness -- because true happiness does not require embellishment of mental state of mind. The sad thing I see however from the treatment center, is that with pill abusers (moreso than alcohol abusers) the practice seems to run in the family. If mom or dad turn to pills for "pain" or "help" then usually that is witnessed by the kids and the grown adult kids pick up the same habit - because it's very easy for people to hide behind an RX and say "I need this" -- not so for alcohol, as no Dr. prescribes that). So I'm just wondering if pill abuse is something that Shelly and GZ also share as a common denominator in their relationship. We already know that GZ was on a cocktail of RX's -- some lethally dangerous to a person exhibiting anger management issues. We just don't know of anything regarding Shelly.

Taafe (notorious loudmouth ...er I mean unofficial spokesperson for GZ) apparently was DOUBLE the legal limt when pulled over for DUI and arrested. I'm sure his drinking issues will be raised in court as an afront to his credibility as well as his practices of breaking the law (ironic given his self-assumed status in his neighborhood watch program).

Taafe blames DUI on RX meds !!!!

Oh my God....it gets better...

George Taafe told Orlando WFTV reporter, Daralene Jones that the ONLY reason his blood alcohol level was DOUBLE during his DUI was because he was on prescription pills (um...wonder if he bought them from GZ's mother-in-law) and the mixture RAISED his blood alcohol reading.

Um...okay -- first, I had to google this phenomenom and see if RX pills really can *increase* your blood ALCOHOL reading... (obviously I know RX pills can *impair* you just like alcohol, but he specifically said they directly impacted his alarmingly elevated blood alcohol level on his DUI arrest).

So here is the Doctors answer: NO -- a big fat EPIC FAIL LIE. And I'm a bit surprised WFTV didn't bust him out right on the spot for that. I guess they're just going to wait until he gets publicly REEMED for that remark and run a followup story.

This will make the GZ trial all that more interesting.... what's up with Team Zimmerman and their apparent addiction to pills?

Frank Taffe sz Mother gz mother in law.Proves that birds of a feather .Anyone whom gets in a vechicle an drives under the influence of drink drugs or both .Is a person whom cares nothing for life there own or others .And has no problem endengering innocent/strangers lifes at risk with a potential lethal weapon.

I don't understand the last sentence in the article - "If today's ruling stands, the case would likely pass to Circuit Judge Debra S. Nelson, another felony trial judge in Sanford." Does this mean the prosecution can appeal the ruling?

Thease are stragic battles that in the end may well do gz more harm than good.In every war loose lips sinks sink ships.An gz sunk his own battle ship as soon as he started flappin his lips.Bring on a new Judge wont change the facts.The gz nutzoid defenders may see this as a small victory.Wont change the final outcome either defeat or surrender by the zman in the war

I simply can't believe this huge bit of information cruised right by me. I take a few days off to do a bit of research and BAM. GZ and crew just may be sorry they took this route ~~C

Expected replacement judge is Debra Nelson, according to some articles. Reputation for tough sentencing.

More has been made known about the request for additional medical records by the state. Not sure why O'Mara would be freaking out about that.... oh, wait... I guess it does seem a bit more obvious now.
You're right. Whatever is in those documents O'Mara is all up in arms about must have something in them that will be able to open the door for the Prosecution to ask for even more records.

Up-thread someone mentioned a few things about Hipaa. If you really read it, it mostly is there to protect the patient so that if, for instance, a family member calls to get all up in your business (health, insurance, account balance, whatever). Unless the person calling has been listed on the Hipaa list, no info will be released -- not even appointment info. LE usually gets the necessary paperwork. Regarding GZ, another thought I had was maybe LE is checking out doctor shopping; we had a lot of that when I was working. (We even received a list of doctor shopping patient list at least once a month, along with ones from the insurance companies for those patients dumb enough to run the scripts thru their insurance thinking that as long as they went to a different pharmacy everything would be peachy-keen.) ZOMG!

However, this is all going downhill fast for the Zimmerman clan JMO. After all, isn't FL the easiest state in which to obtain these narcotics? People drive from several states away to go the the infamous pain clinics. Unbelievable. (I mean the undercover expose we watched about this very topic made it seem easy if you had the front money.) Seems like the Z house of cards is starting to sway, maybe even shake, with these DUI's hitting close to home. Since he's out on bail, does he have to have random drug tests? I can't remember. ~~C

Perry really disappointed me, he was a poser, all talk and no walk. Casey was the one who walked.

I'm glad they made him step down though, it eliminates another possibility for an appeal. Hopefully the next judge will stick to the job of judging and not worry about the case being high profile. I wish we had never heard of GZ, he would probably already have pled out and would be serving his 20 yr. (hopefully) sentence. Thanks alot Sanford PD, and whoever else thought it was ok to let him go that night. They did fire the Chief so I'll give them credit for that.

Seems some egos were hurt.

Debra S. Nelson, the new judge assigned to George Zimmerman's case on Thursday, is a 13-year judicial veteran who has a reputation for working hard, being ambitious and imposing long prison terms.

Not long ago, she sentenced a robbery suspect to 27 years in prison after he'd rejected a 20-year deal from a prosecutor.

"You don't mess around with her," said Lake Mary attorney Isadore Hyde Jr.

She wants to keep Seminole safe from violent crime, he said.

"I think her sense of justice, civility is such that she's going to make sure that this place, Seminole County, is not Mogadishu," he said.

Seminole County Circuit Judge Debra Nelson is a familiar face to the Zimmerman family: She is the same jurist assigned to handle Zimmerman’s wife’s perjury case.

Zimmerman’s legal team might live to regret forcing the last judge off the case because Nelson runs a tight ship and tends to favor the prosecution, Central Florida lawyers said. A native of South Florida who did a brief stint at the Broward state attorney’s office, Nelson is known for being a no-nonsense judge who keeps lawyers on their toes.

“I don’t think they did themselves any favors,” said attorney Jose Baez, best known for defending “tot mom” Casey Anthony. “She has a reputation of being more pro-prosecution than the previous judge. We have an expression: ‘The devil you know is much better than the devil you don’t.’ ”

Nelson was appointed in a random rotation a day after the Fifth District Circuit Court of Appeal in Daytona Beach ordered Circuit Judge Kenneth Lester to recuse himself. The first judge on the case was also forced off, making Nelson the third judge assigned to the case.

Luis Calderon agreed that O’Mara had little choice but to seek a new judge because Lester’s demeanor changed sharply after Zimmerman was caught misrepresenting his finances. But, like Baez, Calderon suspects getting a new judge may be worse for the defense in the long run.

“She’s a tougher judge than Lester — not that her sentences are harder, or that she treats defendants with ill will, but she doesn’t let attorneys fall asleep at the wheel,” Calderon said. “If you need more time, you better have a good reason.

I'm sure O'Mara is aware of her reputation and will shape up -- because we have already seen evidence of him falling asleep at the wheel a few times now already where GZ made a fool of him.

And despite my dislike for Bozo -- I chuckled in agreement with his remark about the "devil you don't know". So true .... be careful what you wish for, eh?

Also of interest is the fact that Nelson was the judge for Shelly's perjury case -- so she is likely fully up to speed on parts of the Zimmerman files already.

I don't know if this was ever posted, but this is a *fascinating* analysis and well worth the few minutes to watch. This woman is really good in breaking down every minute facial expression in a way that makes sense. I'll now pay closer attention the next time I lick my lips in a response...

MOM is going to use 776.032 which is a self-defense immunity hearing. I believe it is also referred to as a Dennis Hearing. 776.013 is the Stand Your Ground clause.

Many of the articles out there keep referring to it as a SYG but it is not correct.

Thanks Deb - that makes more sense. That was my understanding as well: self-defense, but not SYG.
