The state is bringing up the bondage website posts... Hinckley: ... and you knew they were looking for another female partner. Mitchell: I was. Hinckley: ...posts they BOTH were making, Mitchell: yes.

Bench conference requested by defense after this cross exchange: HINCKLEY: you had and have similar interests to your friend.. MITCHELL: yes? Be more specific, HINCKELY: video games, role-playing games, board games like D and D right? And you’ve engaged in larping, science fiction and animee...Do you like game of thrones? MITCHELL: Yes...HINCKLEY: You may not buy the t-shirt like Lizzi Marriott, but you liked it. MITCHELL: ... yes, and the books are good. HINCKLEY: Given all these interests you must be into BDSM.. MITCHELL: That is incorrect. HINCKLEY: faulty deduction, right? MITCHELL: Yes. HINCKLEY: . faulty deduction that leads to faulty conclusions…

Chatting with a fellow journalist, who points out that Seth's mother, Heather Mazzaglia, has been a constant presence here, but out in the waiting area playing cards and sitting at a table... not in the courtroom because she was on the defense witness list. But not called.

The judge has denied the state's request to call a rebuttal witness, and in so doing, the defense's request to then offer testimony. It appears the state would have called Lisa Greenwaldt... and it appears they would raise the issue of the dates that didn't match up... that she says she visited Mazzaglia on the 14th but was not listed by the jail as having been there. That it would impact her credibility. The judge says its not directly relevant... and he declines to head down that path, of what would be a trial within a trial... says it would be confusing and distracting.

He's explaining to them that the attorneys and judge will have a charging conference.. to discuss what the Judge will tell the jury. That will happen today. The judge ultimately decides. And he's telling them that he'll deliver the case for deliberation and decision tomorrow afternoon.

by Jen Crompton/WMUR 11:37 AM

The judge is explaining what all this means... about closing arguments and instructions of law that he'll make after... says its particularly critical that they follow his instructions not to talk about anything involving the case.

The judge is talking to attorneys about closing arguments, the defense estimates they'll take an hour and a half, the state says they could take up to two hours. He made early warnings.. about content danger areas that both should be aware of ... he says he would expect to do closings and charge the jury on the same day.

Closing arguments expected today in Mazzaglia murder trial

By Kimberly Haas FOSTER'S DAILY DEMOCRAT

DOVER, N.H. — Public defender Joachim Barth rested his case in the defense of Seth Mazzaglia at 12:15 p.m. Tuesday just after a long-time friend of testified that Mazzaglia told him about a woman named Natasha who “died in his arms” during college.

~Snipped~

Robert Andrew Mitchell, of Hillsborough, told Assistant Attorney General Peter Hinckley that Mazzaglia, 31, of Dover, was in love with a woman who passed away while he was an undergraduate at Rensselaer Polytechnic Institute.

“My understanding was that she was a woman he had loved while at Rensselaer and he said she had died in his arms. I assumed he was being more dramatic,” Mitchell said of Mazzaglia, on trial for murder at Strafford County Superior Court.

“I thought that she probably existed. It seemed unlikely to me that she died in his arms,” Mitchell said.

Closings are the arguments at the end of the case. Attorneys pull from the evidence, and make reasonable inferences and references to the law, and urge ultimate conclusions. But what they say is NOT evidence.

The judge is explaining the schedule.. closings this a.m. from one side, lunch, the other side, break, and then the judge will give them instructions. He says it will likely run past 4:00 today. He's reminding all 16 of them that they can ask for a break at any time.

The courtroom is packed. Lizzi Marriott's family and friends are filling the first two rows of the courtroom, the gallery is full, and there are several more journalists than our everyday pack... usually its Mike from the Union Leader, Kim from Foster's, Beth from The Portsmouth Herald, Rod from Foster's, Sarah from 48 Hours, Lynn from the AP, and me. The state has the right to decide to go first or last because they bear the burden of proving beyond a reasonable doubt. They have chosen for the Defense to start. So Joachim Barth has started.

by Jen Crompton/WMUR 9:10 AM

----------------------------

Barth talks about all the places they could find doubt, starting with Kat McDonough's four claims... four pillars he calls them, upon which her story is supported ... and says without any one, her story falls apart. The first...BARTH: she claims she was involved in an abusively controlling relationship…that went from a euphoric grooming process to suddenly off grid to something nefarious that literally transformed a confident independent young woman to a virtual slave…

by Jen Crompton/WMUR 9:14 AM

---------------------------

Barth claims that she misrepresented the abuse she got from her father to the jury... he read some of the Facebook messages aloud that Kat sent Seth... Kat told the jury that she fought with her father over things like eating vegetables... but the Facebook messages to Seth describe something more destructive. Barth claims that SHE was manipulating and lying to SETH to get him to pull her into his apartment.

The judge has decided to give the jury their instructions in the morning. He stresses that they cannot talk to each other or others about any of the evidence. They will return at 9 am.

by Jen Crompton/WMUR   2:50 PM

---------------------------

Ward's last words to the jury - "Send him the message you’ve seen thru the lies, that you know the truth that he is a cold- blooded killer, and make him responsible for what he has so long tried to avoid. Thank You."

by Jen Crompton/WMUR   2:49 PM

---------------------------

Ward says Kat's story to the defense was ridiculous, open-ended, never admits being the one to kill Lizzi Marriott. "Meanwhile the defendant is creating his escape plan. Upset about evidence.. why would someone be willing to kill or murder [referencing his plan to do something to Roberta and Paul]…why would you be willing to become a murderer if you’ve been involved in an innocent accident ... that's why the conspiracy charges are so important."

by Jen Crompton/WMUR   2:44 PM

---------------------------

Ward explains that Kat McDonough had to tell the truth to the Grand Jury... that she didn't want to be there... and that if she didn't tell the truth she'd be guilty of perjury. He tells the jury to compare her demeanor there, in the tape of it they heard, to her demeanor in telling the exact same story in court. After being free and away from Seth Mazzaglia after being reunited with her mother, and after getting an Attorney.

by Jen Crompton/WMUR   2:38 PM

---------------------------

Ward says this was a deliberate, premeditated murder. WARD: the conspiracy is part and parcel of his murder.. evidence that he was trying to get away with this murder ... the cover-up … there was no accident the defendant who makes plans to kill witnesses was not involved in an accident...he’d taken cpr courses including treating seizures… yet gave no assistance to a dying victim, instead dumps her body in the river and destroys evidence and escape jail is not someone involved in an accident.

by Jen Crompton/WMUR   1:58 PM

---------------------------

Ward points out what the DNA evidence shows... he claims Seth wrote in his letter that he wore a condom with Lizzi but that it broke, to cover up her DNA on his underwear. But the condom that was recovered, did not have any of Lizzi's DNA on it.

Prosecutors urge jury to see through Mazzaglia's lies

Defense attacks credibility of star witness Kat McDonough

By Elizabeth Dinan
June 25, 2014 8:23 AM

Editor's note: This story includes graphic content.

DOVER — State prosecutor Geoffrey Ward ended the Seth Mazzaglia murder trial on Wednesday by asking a jury to send Mazzaglia the message “that you’ve seen through the lies” and know “he is a cold-blooded killer.”

“Deliver the justice he has tried for so long to avoid,” Ward told the jury, which begins deliberations on Thursday, following instructions from Judge Steven Houran.

Ward’s closing arguments to the jury focused on evidence, after defense attorney Joachim Barth spent most of his hours-long argument talking to the jury about the credibility of Mazzaglia’s ex-girlfriend and state witnesses Kathryn “Kat” McDonough.

~Snipped~

Barth began his arguments by his pointing out multiple lies McDonough has told since Marriott died. He ended with a plea for the jury to remember what McDonough told witness Roberta Gerkin when she didn’t know Gerkin was secretly recording the conversation for investigators.

At that time, Barth reminded, Gerkin told McDonough that Mazzaglia was “throwing you under the bus.” To that, Barth said, McDonough candidly answered, “It was sex and ropes and an accident and a seizure.”

State vs. Seth Mazzaglia: Live trial coverage

Thursday, June 26, 2014

Charging the jury has been a bit delayed, attorneys met for a sidebar conversation and the judge left... Peter Hinckley went over to explain things to the family... Mr. Marriott actually just left the courtroom .. perhaps for a moment. Seth Mazzaglia has just left as well. May be a bit longer of a wait than we thought.

by Jen Crompton/WMUR   8:15 AM

----------------------------

Seth Mazzaglia is back in the courtroom, his mother is in the front row behind him. Normally he looks straight ahead when he comes and goes, but now he glances her way. His leg is bouncing wildly as he sits leaning in his chair, facing the front of the court. The Marriott family members are chatting, Mr. Marriott leaning with his back to the bench in front of him conversing with Lizzi's Mom and Grandmother. Can't imagine how families cope with this.

Jury to decide Mazzaglia’s fate today

Seth Mazzaglia, right, watches as the courtroom is cleared before he leaves for the lunch break in Strafford County Superior Court, Wednesday, June 25, 2014 in Dover, N.H. Jurors who will decide the fate of the man charged with raping and killing a University of New Hampshire student were given two markedly different scenarios to weigh in closing arguments yesterday.

Prosecutors cast Seth Mazzaglia as a cold-blooded killer who manipulated and dominated his former girlfriend and became enraged when the woman she lured to their apartment – 19-year-old Elizabeth “Lizzi” Marriott – rebuffed his sexual advances.

Defense attorneys argue that Mazzaglia’s girlfriend, Kathryn McDonough, manipulated Mazzaglia and the truth of what really happened that night to save herself. They claim McDonough suffocated Marriott during rough sex involving restraints and a panic-stricken Mazzaglia helped dispose of the body in the ocean to protect her.

The fifth charge, CONSPIRACY TO COMMIT FALSIFYING PHYSICAL EVIDENCE. The judge reads all the varied elements...from sending a text message to Elizabeth Marriott's phone asking why she didn't arrive at the apartment, to putting Lizzi into a suitcase... dumping her body in the Piscataqua River, destroying her phone and GPS,and tossing physical evidence out the car window and into dumpsters. The jury only needs to find him guilty of one of these choices,

by Jen Crompton/WMUR 9:34 AM

---------------------------

The fourth charge the judge explains... CONSPIRACY TO COMMIT TAMPERING WITH WITNESSES OR IFORMANTS. The judge lists 13 different overt acts under this charge... each of which constitutes an agreement between Mazzaglia and one other person... such as concocting a false alibi with Kat McDonough.

by Jen Crompton/WMUR 9:22 AM

---------------------------

The third charge is 2nd degree murder... that Seth Mazzaglia recklessly caused the death of Elizabeth Marriott, showing an extreme indifference to life by strangling her. The judge explains that they must first consider the two alternative first degree murder charges... and decide those beyond a reasonable doubt. Only then would the move to the second degree charge. They cannot find him guilty of both a first and second degree charge.

by Jen Crompton/WMUR 9:15 AM

---------------------------

He's explaining the charges and breaking them down. First charge is 1st degree murder ... that Seth Mazzaglia killed Elizabeth Marriott by strangling her. Second charge - 1st degree murder ... that he strangled her and committed felonious sexual assault before, during or after.

by Jen Crompton/WMUR 9:05 AM

---------------------------

The judge is taking a drink of water before reading charges, jurors are listening intently.

Geoffrey Ward, one of the state's prosecutors, urged jurors in his closing arguments to see through what he called Mazzaglia's cover-ups and manipulations.

"Send him the message," Ward said, "you've seen through it all and know the truth about him: That he is a cold-blooded killer."

After murder conviction in Strafford County Superior Court , Mazzaglia waits for final words

By DOUG ALDEN
New Hampshire Union Leader

A Dover man convicted of killing a University of New Hampshire student and dumping her body into the Piscataqua River awaits a sentencing that has already been decided.

Seth Mazzaglia, 31, automatically faced life in prison without the possibility of parole once a jury convicted him Friday of two counts of first-degree murder in the death of Elizabeth "Lizzi" Marriott, 19. Still to be determined is Mazzaglia's punishment for conspiring to falsify physical evidence and to commit witness tampering.

The jury - seven women and five men - reached its verdict at Strafford County Superior Court shortly before 12:30 p.m., just minutes after posing a question to Judge Steven Houran related to the conspiracy charges.

A sentencing hearing will give Marriott's family an opportunity if they choose to address the court directly after having sat through weeks of emotionally grueling testimony.

Convict will be tried on escape plot charge

BY: Associated Press
Wednesday, July 9, 2014

DOVER, N.H. — The man convicted of raping and killing a University of New Hampshire student in October 2012 will be sentenced in August.

Prosecutors said Wednesday they also intend to prosecute Seth Mazzaglia of Dover, 31, on a charge that he enlisted a cellmate to help plot his escape.

Prosecutor Peter Hinckley told WMUR Wednesday (http://bit.ly/1n7LEFv ) that he does not consider it a waste of resources to pursue the charge of criminal solicitation, "because he committed the crime."

Mazzaglia escape try trial set for Nov. 3

By Kimberley Haas
Thursday, July 10, 2014

DOVER — Convicted murderer Seth Mazzaglia was back in court Wednesday morning for a status conference on a criminal solicitation charge which relates to his alleged attempt to break out of the Strafford County House of Corrections in 2012.

~Snipped~

In court Wednesday, Hinckley told Judge Steven Houran, who sat on the bench during Mazzaglia's murder trial, that the state is tentatively planning to proceed on the criminal solicitation charge against Mazzaglia.

“At this point we would ask for a trial,” Hinckley told Houran. He said the trial should last approximately two days.

Based upon the court's schedule, Houran selected Nov. 3 for the start of jury selection, with the trial to begin that week.

Whether or not he is convicted on the criminal solicitation charge and barring a successful appeal, Mazzaglia will spend the rest of his natural life in prison without the possibility of parole because state law mandates that for criminals convicted of first-degree murder.
