The long-awaited trial of a Chisago County man accused in the death of Danielle Jelinek could begin Monday, if remaining disputes over the admission of evidence are resolved.

Aaron Schnagl, now 31, will get his day in court more than two years after he was indicted on a third-degree murder charge for allegedly causing Jelinek's death by providing her with illegal drugs.

Her family reported her missing on Dec. 9, 2012. Five months later, her body was found in a shallow slough near a rural cul-de-sac in Chisago County, about a quarter-mile east of Schnagl's home.

Schnagl unintentional homicide trial in third week of testimony

by DENISE MARTIN

The third degree homicide trial of Aaron Jude Schnagl continues this week in district court in Center City.   Last week an offender who shared Schangl’s jail cell and who was interrogated repeatedly over the two years that this case has been developed,  appeared on the witness stand.

Donald Heilman II, of Rush City, was jailed in November 2012, and shared a cell with the Schnagl, who was booked December 10.

An attempt to question Heilman about a letter he’d allegedly written to Schnagl,  was thwarted when prosecutors successfully argued the letter was unknown to them.

Schnagl resided in the house where the victim, Danielle Jelinek, was last known to be at in December 2012.  He was immediately jailed for violating conditions of probation (in connection with an earlier offense) while search teams began to scour the countryside.  He remains incarcerated.

Aaron Schnagl was found guilty of third-degree murder in the death of Danielle Jelinek.

"It's a very difficult process but at the end of the day it's worth it. It's worth it to do justice," said Nick Hydukovich, the prosecutor in the case.

But the jury also determined that Schnagl did not try to conceal Jelinek's body.

"At the end of the day, I think that the jury clearly saw that the accusations that he hid her body were uncredible," said Melvin Welch, Schnagl's attorney.

A Chisago County man, Aaron Schnagl, was found guilty of third-degree murder Friday evening for providing the cocaine that killed Danielle Jelinek.

In a related decision, the jury found him not guilty of concealing her body, which would have meant a stiffer prison sentence had he been convicted of that.

The verdict came about three hours after attorneys concluded their final arguments in a Chisago County courtroom, but four weeks after testimony began. Schnagl, now 31, admitted in court that he was a high-volume drug dealer. He is serving time in Rush City prison on a previous drug conviction.

“I’m really quite pleased,” prosecutor Nick Hydukovich said of the verdict. “It was an exceptionally long and difficult process.”

Defense attorney Melvin Welch said the verdict was a “mixed bag” but that Schnagl was relieved the jury rejected concealment — known as an “aggravating factor” — which could have meant 25 years in prison.

Before the jury deliberated, Hydukovich said in his final argument that Schnagl was protecting his livelihood as a drug dealer when he dumped Jelinek’s body in a pond after providing her with the cocaine that killed her.
