CHARLESTON, S.C. — The father of a Cherokee Indian girl at the center of an adoption dispute that has reached the U.S. Supreme Court faces arrest because he hasn't turned over his 3-year-old daughter to the South Carolina adoptive parents as ordered by a family court this week.

Dusten Brown faces a charge of custodial interference, according to a statement from the Charleston County Sheriff's Office on Saturday.

Cherokee Nation spokeswoman Amanda Clinton called the action "morally reprehensible" and "legally questionable."

"The attorneys, the courts and the adoptive couple in this case were keenly aware of Dusten's commitment, but clearly chose to ignore it," Clinton said in a written statement. "This case is still not yet fully litigated. So to take these steps when there are pending legal actions in South Carolina, Oklahoma and Cherokee Nation courts is appalling.

Brown, who is Cherokee, is training with the National Guard in Iowa. The sheriff's office said he is expected to turn himself in to military authorities on Sunday when he returns for duty. The statement said extradition proceedings will begin when he is taken into custody.

"Not only is the adoptive couple asking this child be ripped from her father while he is serving our country, they are also endangering his military career in the process," Clinton said. "This is outrageous conduct."

Adoptive Couple v. Baby Girl

Adoptive Couple v. Baby Girl, 570 U.S. ___ (2013), is a decision of the United States Supreme Court that holds that several sections of the Indian Child Welfare Act (ICWA) do not apply to Native American (Indian) biological fathers who were not custodians of an Indian child. The court held that involuntary termination procedures required by the ICWA did not apply when the child had never lived with the father and that therefore active remedial requirements were also not required. Preferred placement in the act did not apply when no other party had formally sought to adopt the child.

In 2009, a couple from South Carolina sought to adopt a child whose father was an enrolled member of the Cherokee Nation and whose mother was predominantly Hispanic. The biological father contested the adoption on the grounds that he was not properly notified in accordance with ICWA, and won his cases in trial court and on appeal with the state supreme court. The case has received extensive coverage in the national media, and spurred calls for Congress to review and make amendments to the 1978 law.

On October 1, 2012, the adoptive couple petitioned the United States Supreme Court to review the case. On January 4, 2013, the court granted certiorari and heard the case on April 16, 2013.

Court denies 'Baby Veronica' adoption appeal

The U.S. Supreme Court on Friday denied the request of "Baby Veronica's" biological father to block a South Carolina Supreme Court ruling that grants custody of the girl to a South Carolina couple.

The order is another win for the adoptive parents, who are one step closer in their legal struggle. However, many hurdles may remain before Veronica is in their custody.

The request was filed in the quest of Oklahoma resident and Cherokee citizen Dusten Brown, the child's biological father, to receive a best-interest hearing for the child at the center of the custody battle. That hearing was denied by the South Carolina courts, which approved Veronica's adoption by Matt and Melanie Capobianco this week.

Chrissi Nimmo, assistant attorney general for the Cherokee Nation, asserted the rights of the state of Oklahoma and Cherokee Nation law in a statement expressing disappointment in the Supreme Court.

"The original decision of the United States Supreme Court did not mandate the removal of Veronica from her father, family and tribe," she said. "However, instead of clarifying their original decision, the United State Supreme Court has washed their hands of this case. ... While Veronica may not have a right to a determination of her best interest under South Carolina or federal law, she does have that right under Oklahoma and Cherokee Nation law."

Yesterday the Supreme Court decided Adoptive Couple v. Baby Girl and although it is not clear whether it will result in a “win” for the Adoptive Couple, Matt and Melanie Capobianco, there is no question it is a win for adoptive couples in general.

Baby Girl involves an Indian child, Veronica Capobianco, who was placed for adoption with the Capobianco’s at birth. Her biological father, Dusten Brown, never agreed to the adoption—he says he gave up his parental rights without knowing that the child’s biological mother was going to give her up for adoption. Upon receiving notice of the pending adoption, Brown immediately contested it. Brown is an enrolled member of the Cherokee tribe of Oklahoma and he argued that the termination of his parental rights was invalid under a federal statute known as the Indian Child Welfare Act, which aims to strengthen and protect Indian families by preventing their unnecessary break up.

One of the ways ICWA protects Indian families is by forbidding the involuntary termination of Indian parents’ parental rights. Under the statute, such terminations are forbidden in the absence of a heightened showing that serious harm is likely to result from the parent’s “continued custody” of the child. Brown based his argument on this statutory provision and won in South Carolina. After two years of living with the Capobiancos, Veronica was turned over to her biological father. But now, in a 5–4 decision, the Supreme Court has said that the South Carolina courts were wrong.

The court based its ruling on a very literal meaning of “continued” (they even cited the dictionary) and found it only applied in instances where the objecting parent had previously exercised physical or legal custody of the child. In this case, because Veronica was placed with the Capobiancos at birth, the court found this provision did not apply to Brown and thus, the court found that Brown’s parental rights could be involuntarily terminated. However, since the lower court believed it did not have this power, it never terminated his parental rights. As a result, the case will now be remanded back to the South Carolina family court.

WASHINGTON – Dusten Brown, the Cherokee Nation citizen and biological father of Baby Veronica, was denied his plea by the US Supreme Court to block the adoption of Veronica that will move her some 700 miles from her Oklahoma she presently shares with Mr. Brown.

The nation's highest court on June 25th remanded the case back to the South Carolina Supreme Court. The US Supreme Court ruled the South Carolina Supreme Court misapplied the Indian Child Welfare Act in its July 2012 decision that ruled in Mr. Brown's favor.

Brown filed a request with the US Supreme Court, who appeared to wash their hands of the legal matter. Brown filed in his plea to receive a "best interest" hearing for his three year daughter, who turns four on September 15.

A South Carolina family court granted Veronica's adoption on Wednesday to a non-Native South Carolina couple.

"Two Justices – Ruth Bader Ginsburg and Sonia Sotomayor – noted that they would have granted the father’s request. They did not say why, but they were among the dissenters when the Court ruled – by a five-to-four vote – against the father's legal claim under the federal Indian law. That decision came in Adoptive Couple v Baby Girl (docket 12-399)," according to the Supreme Court of the United States Blog.

DES MOINES — The father of a Cherokee Indian girl mired in an adoption dispute was allowed to leave an Iowa National Guard base and return to Oklahoma, an Iowa Guard spokesman said Sunday.

Oklahoma National Guard spokesman Col. Max Moss said Dusten Brown was cleared Saturday night to return to the Oklahoma National Guard.

Moss said Brown asked for permission to leave training in Iowa to return to Oklahoma so he could attend a hearing in the guardianship case.

The issue has been clouded by the Indian Child Welfare Act, which prompted a court in 2011 to favor the girl living with her father. But in June, the U.S. Supreme Court ruled that South Carolina courts should decide who gets to adopt Veronica.

UPDATE: According to the assistant general for the Cherokee Nation, Chrissi Nimmo, Dusten Brown has turned himself into authorities.

This comes after a press conference this morning with the Capobiancos. They spoke directly to Dusten Brown, law enforcement and anyone hiding his whereabouts. This coming after a warrant for his arrest was issued Friday after he failed to comply with court orders, and he still has not turned himself in.

During the press conference, Baby Veronica's legal adoptive parents begged law enforcement to step up and get their daughter back. The Capobiancos said any other case of custodial interference would be treated as kidnapping and have much more urgency. Matt made a threat to go get her himself and told News 2's Haley Hernandez that it wasn't said in the heat of the moment, he was going to purchasing a plane ticket. NBC news say they have reports that Matt & Melanie are already on their way to Oklahoma.

JAMES ISLAND, SC (WCSC) - Dusten Brown, Veronica's biological father and one side of a custody battle which has garnered national headlines, has been taken into custody.

Cherokee Nation Attorney General Chrissi Nimmo confirmed Brown turned himself in to authorities on Monday morning.  He was booked at the Sequoyah County jail after surrendering to deputies, online records show

Brown had been expected to attend an emergency hearing in Cherokee Nation Tribal Court at 9 a.m. but The Tulsa World reports he was absent. Brown is expected to be extradited to Charleston.

Nimmo said Veronica is still in the care of her grandparents, who still have a temporary guardianship order.

The news of the arrest comes hours after Matt and Melanie Capobianco made impassioned pleas to have their adopted child Veronica returned to them.

The James Island couple gathered outside their neighborhood gazebo as they requested help from Attorney General Eric Holder, the Federal Bureau of Investigation, and Governor Nikki Haley and Oklahoma Governor Mary Fallin.

"With every passing hour, we fear for her safety," said Melanie Capobianco, "The judicial system has been spot on...enough is enough," her husband added.

CHARLESTON, SC - The Ninth Circuit Solicitor, Scarlett Wilson, released a following statement regarding the plan to return Veronica to her adoptive parents Matt and Melanie Capobianco in Charleston, SC.

I have received numerous telephone calls and emails regarding my involvement with returning the custody of a child known publicly as "Baby Veronica" from Oklahoma to her parents in Charleston. There are many legal reasons, starting with the UCCJEA (the Uniform Child Custody Jurisdiction and Enforcement Act) and including the laws of the States of Oklahoma and South Carolina that law enforcement cannot "swoop down" into Oklahoma and immediately whisk Baby V home to her parents. Our states have agreed upon legal procedures to enforce custody matters and it is my responsibility to follow them.

In the late afternoon of Monday, August 5, I received notice that the Family Court had sought my counsel in this matter. Pursuant to the Court's Order, I am required to act on behalf of the Court and I am specifically precluded from acting on behalf of any party. Under the Act, I am allowed to pursue any lawful action including criminal avenues and civil proceedings I deem necssary to locate and return the child in pursuit of the Court's order.

The biological father of Baby Veronica has turned himself in to Oklahoma authorities in Sequoyah County and is free on bond.

Dusten Brown, the 3-year-old girl's biological father, faced an arrest warrant to return the child to her adoptive parents, who live near Charleston, S.C., and raised Veronica for the first 27 months of her life. Brown was expected to be on National Guard duty in Iowa until Aug. 21 but was released from his training duties to return to Oklahoma after being subpoenaed to appear in Cherokee Nation tribal court this morning.

Sequoyah County Sheriff Ron Lockhart said that Brown turned himself in around 10 a.m. but refused extradition to South Carolina.

Brown appeared before Judge Jeff Payton where his attorney requested a fugitive bond and was ordered to appear back in court on Sept. 12. He was released on a $10,000 bond.

Lockhart said that he has been in contact with South Carolina authorities and that as soon as the South Carolina governor signs a warrant, Brown will be taken back to jail and held there until South Carolina can retrieve him.

The father of the three-year-old Cherokee girl at the center of a tug-of-war dispute turned himself in to authorities on Monday but refused extradition to South Carolina.

That's where Veronica's adoptive parents Matt and Melanie Capobianco live and where state authorities have finalized Veronica's adoption and charged Brown with 'custodial interference' for refusing to turn over the girl.

'This is my daughter,' Brown said, according to Anderson Cooper 360. 'It isn't a yoyo I borrowed for two years.'

Governor Haley signs warrant for Dusten Brown

Governor Nikki Haley has officially gotten involved in the on-going battle over Baby Veronica.

Gov. Haley signed a requisition warrant requesting Dusten Brown's return to Charleston to face charges of felony custodial interference. The governor's spokesperson said that the warrant is being sent overnight to Oklahoma.

Earlier Monday, Sheriff Al Cannon said that warrant from Governor Haley will expedite the extradition process. However, Cannon said his office does not know the whereabouts of both Brown and baby Veronica.

"My personal opinion is that his actions are only digging his hole deeper as it relates to that charge of criminal custodial interference," Cannon said Monday

Oklahoma Governor Mary Fallin confirms through her press office that she received the rendition request from Governor Nikki Haley.

That request was rushed to Oklahoma to begin the extradition of Dusten Brown, the biological father of baby Veronica.

Brown missed a mandatory visitation with the child on August 4. That visitation was to begin reacquainting the child with her adoptive parents who fought and won custody of her after a year and eight months of legal fights that went all the way to the Supreme Court of the United States.

Monday night Gov. Haley's spokesman said, "She stands in support of the Capobiancos and shares their desire to bring Veronica home safely."

Meanwhile, Governor Fallin issued a statement Tuesday saying, "As governor, my job is to ensure the law is upheld. My legal staff and I are currently reviewing the request for rendition of Mr. Brown to South Carolina. Should that request adhere to the letter and spirit of the law, I will sign it. My hope, however, continues to be that sending Mr. Brown to face criminal charges in South Carolina is unnecessary," said Gov. Fallin.

Fallin has 90 days to reply to the warrant.

Second Indian Infant Whisked to South Carolina for Quickie Adoption

As Dusten Brown posted bail in a Sequoyah County, Oklahoma courtroom yesterday afternoon on a federal warrant for his arrest for "custodial interference" in Adoptive Couple v. Baby Girl, Indian Country Today Media Network has learned that yet another Indian child from Oklahoma has been illegally placed for adoption in South Carolina.

Baby Deseray, an infant girl who was born on May 13 of this year, has been confirmed as eligible for the protections of the Indian Child Welfare Act, because her mother is a member of the Absentee Shawnee Tribe of Oklahoma. Currently, the infant is living illegally with another pre-adoptive couple in South Carolina with no custody order in place and no signed Interstate Custody for the Placement of Children (ICPC) application on file with the State of Oklahoma.

In his petition, the baby's biological father, Jeremy Simmons, who is non-Indian, has been supported by the infant's biological Indian grandmother in seeking to return his daughter back to Oklahoma to his custody.

The South Carolina attorney who handled the adoption is Raymond W. Godwin, who was also the original adoption attorney for Matt and Melanie Capobianco in their adoption of Veronica Brown in 2009. Godwin's office did not respond by deadline on this story. Adoption attorneys across the country said that the new adoption illustrates an emerging pattern in the adoption of Indian children in the United States.

TAHLEQUAH, Okla. — Ryan Mackey got to know Dusten Brown when they were children in this city billed as the capital of the Cherokee Nation.

They got to know each other’s Cherokee clan and participated in tribal traditions together.

But Mackey’s role when he stepped into a tribal courtroom Friday, at the start of two hearings about Brown’s 3-year-old daughter, wasn’t to take sides.

Attorneys in the custody dispute over Veronica, who was adopted by Matt and Melanie Capobianco of James Island, had agreed to have Mackey’s prayer open the tribal hearing.

The only known result of the five hours of hearings — a mediation agreement — added confusion to an already perplexing legal battle. The pact, forged earlier in the day during a three-hour hearing in state court, was sealed from public view.

Who ultimately will care for Veronica remained unknown. Neither side would answer that question.

'Baby Girl' Veronica Case: Lawyer Asks Judge To Suspend Adoptive Parents' Visitation Rights

OKLAHOMA CITY -- A lawyer appointed to look out for the best interests of a 3-year-old Cherokee girl at the center of an adoption dispute has asked a judge to suspend visitation rights for her adoptive parents, according to a court docket.

Angel Smith filed a motion in Cherokee County District Court in Oklahoma on Friday asking Judge Holli Wells to suspend Matt and Melanie Capobianco's rights to see 3-year-old Veronica pending a hearing, the Tulsa World reported.

The Capobiancos responded by filing a motion objecting to the stay. The Capobiancos also objected to a motion to appoint a guardian ad litem to represent Veronica, according to the Tulsa World.

NOWATA, Oklahoma - News On 6 has learned a three-year-old Nowata girl caught up in a custody battle was supposed to be turned over to her adoptive parents Friday at 5 p.m., but that didn't happen.

We've learned through an Oklahoma appeals court web site that Veronica's biological father's attorneys filed an appeal with the Oklahoma Supreme Court and we believe they granted a stay.


The biological father and adoptive parents of "Baby Veronica" were at the Nowata Courthouse Friday. The Green Country town is home to "Baby Veronica's" biological father, Dusten Brown.

Around 8:30 a.m., Veronica's adoptive parents, Matt and Melanie Capobianco, arrived with police escorts. A short time later, Brown and his wife arrived.

Dusten Brown, the biological father of 3-year-old Veronica, filed a motion with the Oklahoma Supreme Court late Friday to block whatever had been ruled earlier Friday in a custody hearing that was held behind closed doors in a Nowata, Okla., courtroom, The Tulsa World reported.

Whatever transpired in the hearing, which was attended by her adoptive parents, Matt and Melanie Capobianco of James Island, as well as Brown and his relatives, was unclear after it was over. All the particpants left without speaking to reporters, honoring a gag order issued earlier this month by another Oklahoma judge.

Though no one would talk with reporters, court records show that Brown’s attorney filed an appeal Friday afternoon, The Tulsa World said.

Dusten Brown asks Oklahoma Supreme Court to block judge's order in Baby Veronica case

NOWATA - Three armed men - a Cherokee marshal, a Nowata County sheriff's deputy and a Nowata police officer - guarded the courtroom door Friday morning.

They let Baby Veronica's adoptive parents go inside at 8:30 a.m., followed 10 minutes later by her biological father and stepmother. What happened next behind those closed doors, nobody is allowed to say.

But by late afternoon, Dusten Brown's attorney had filed an appeal with the Oklahoma Supreme Court, asking it to block whatever order the judged issued in Nowata.

The court docket shows that at 4:41 p.m. attorney Rob Nigh filed the appeal. There is no indication that the court issued any immediate decision.

In the family court's final order, published on November 25, 2011, there was no mention of Dusten Brown being a "thwarted father".

When the South Carolina Supreme Court issued its ruling, after the appeal, on July 26, 2012 it said, "Here, the family court found Father was not entitled to the protection of the "thwarted father" exception because there is no evidence indicating he attempted to contribute to the support of his child during Mother's pregnancy or after the child's birth."

Dusten Brown and Matt and Melanie Capobianco were back in court Friday. They've been working on a custodial agreement over 4-year-old Veronica all week.

These mediation meetings are sealed and a gag order is preventing anyone involved from telling us exactly what is discussed.

Sources tell us the two sides are close to an agreement, which would be the end of a four-year fight

The Capobiancos arrived at the state court of civil appeals around 10 a.m. Friday. They met behind closed doors with Dusten Brown to work out the custodial arrangements for little Veronica.

Supporters of Dusten Brown made themselves known Friday, saying Veronica should be with her biological father.

TULSA, Okla. – According to reports from the Tulsa World, negotiations between Baby Veronica’s biological father and the South Carolina couple attempting to adopt her ended on Sept. 23 in a Tulsa courthouse without an agreement.

The newspaper reported that the parties met five times the prior week. Starting on Sept. 16, Dusten Brown – Veronica’s father and a Cherokee Nation citizen – and Matt and Melanie Capobianco were involved in formal negotiations.

The Tulsa Word reported that the case heads back to the Oklahoma Supreme Court, where the question is whether the 4-year-old girl will stay with Brown while the appeals process continues.

“All the parties negotiated in good faith in my opinion and have been represented by lawyers of competence, skill and diligence,” a settlement judge told the Tulsa World. “It is a procedurally and substantively complex case, which we simply were unable to resolve by a settlement agreement. As a consequence, the settlement conference was adjourned this morning, and the parties and their attorneys instructed that all gag orders remain operative and in effect.”

According to an online docket, the Capobianco have filed three other statements with the Supreme Court in support of lifting a stay that keeps Veronica with Brown.

TULSA, Oklahoma - The adoptive parents of 4-year-old Veronica took custody of the girl from her biological father Monday evening.

Mediation talks in a Tulsa courtroom between Matt and Melanie Capobianco and Brown ended without an agreement after the two sides could not agree on a plan for Brown to visit Veronica. So, the case went back to the Oklahoma Supreme Court.

The state Supreme Court declined to take jurisdiction over the adoption dispute and voted to lift the emergency stay issued by the Nowata County district court on August 30, according to court records.

The emergency stay was keeping Veronica in Oklahoma with her biological father. The Oklahoma Supreme Court's decision to lift it cleared the way for the Capobiancos to take Veronica back to South Carolina.

The vote was not unanimous, with Vice-Chief Justice John F. Reif and Justice Norma Gurich dissenting, and Steven W. Taylor abstaining. Chief Justice Tom Colbert concurred in part and dissented in part.

Veronica was staying here on tribal land with her biological father, Dusten Brown.

Adoptive parents take custody of Veronica from biological father

UPDATE: TAHLEQUAH -- Baby Veronica’s biological family handed over the 4-year-old girl Monday night, giving her back to her adoptive parents from South Carolina.

The child's transfer of custody was formally announced by Cherokee Nation Attorney General Todd Hembree.

In an interview with the Tulsa World, Hembree said a district court order was issued about 4:30 p.m. to hand over Veronica. The order came after the Oklahoma Supreme Court lifted its ruling that had kept Veronica in her biological father's custody while the appeals played out.

Cherokee County Sheriff's Office undersheriff Jason Chennault said his office received the court order at 5 p.m. By 7:30 p.m., Veronica was with the Capobiancos.

"The court order was directed to us, so we served it," Chennault said. "We gave the Browns time to say goodbye and pack some things for Veronica, some clothes and things."

The Cherokee Nation was prepared to require that the court order giving custody to the child's adoptive parents, Matt and Melanie Capobianco, be domesticated in tribal court, Hembree said. But Dusten Brown, the girl's biological father, decided that it was in Veronica's best interests to proceed with a "peaceful and respectful transfer," Hembree said.

However, the appeals might not be over.

"We will assess our legal options in the morning," Hembree said. "Is this over? I would say not."

The adoptive parents of Baby Veronica released a new statement and family photo Tuesday afternoon.

Nearly 21 months ago, we vowed to do everything legally possible to reunite our family. While we are overjoyed to bring Veronica home, we sympathize with the Brown family during this difficult time. Despite our differences, and everything that has happened over the last several months, we all love Veronica and want what is best for her. We are grateful that the visits we’ve enjoyed with our daughter allowed us to reconnect as a family and ease her transition home. We are all doing well and our focus now is on healing and getting our life back to normal. While we recognize there are many who have taken a strong interest in Veronica’s case, we ask for privacy during this precious time with our daughter. We are eternally grateful for the overwhelming outpouring of prayers and support for our family.

After two years of being with her biological father this child should have remained with him. The adoptive parents were not looking for the best interest for her. This little girl is going to suffer psychological problems in the future. The adoptive parents should have just left it alone. Two years is too long of a time for a 4 year old to be taken away from her father whom she grew to love and become bonded with.

I think these adoptive parents are selfish people and were only concerned for themselves. They couldn't have possibly still missed the child after 2 years.

As Matt and Melanie Capobianco took possession of Veronica Brown on Monday night, another court action was brewing behind the scenes. Today, their lawyers in South Carolina are in court seeking fines, attorneys' fees and expenses totaling approximately $500,000 from Dusten Brown.

Brown, a member of the Oklahoma National Guard who served in Iraq, was forced to turn over his biological daughter to them after the failed visitation “negotiations” last week. On the presumption that the couple's attorneys were looking for a set of deep pockets from which to profit, the Cherokee Nation is also named in the action; however, according to tribal attorneys, the tribe is not a part of the contempt order and therefore not obligated to pay the Capobiancos. Additionally, they noted that the Capobiancos have no jurisdiction to sue the tribe and that the Cherokee Nation is protected under the 11th amendment granting them sovereign immunity from civil actions seeking damages and financial compensation.

But for Dusten Brown the suit has potentially devastating consequences. Costs outlined in the contempt action include fines of up to $32,000 a day, in addition to be forced to pay for the Capobiancos' living expenses while in Oklahoma. With a modest income and few assets, friends and insiders acknowledge that he has little chance of ever paying that kind of bill.

Dusten Brown had worked with, Baby Veronica’s legal adoptive parents for custodial rights of his daughter, but was unsuccessful. Veronica, who is now 4, left Oklahoma with her legal adoptive parents days ago and is now back in South Carolina.

Dusten Brown issued the following statement on the transfer of his daughter, Veronica:

“The last few days without Veronica in our home have been more painful than words can describe. We are heartbroken at the loss of our daughter. I moved heaven and earth for two years to bring Veronica home to her family where she belongs. And when I finally picked her up for the journey back to Oklahoma two years ago, we looked into each other’s eyes and it was like we had always been together. That bond was instantaneous, and nothing can break it. Veronica is my child, my flesh and blood, and I love her more than life itself. And to our daughter, Veronica—Mommy and Daddy love you and miss you so much, and we cannot wait until we see you again. We will see you again.”

Contempt of court proceedings in South Carolina could seek compensation from Dusten Brown and the Cherokee Nation for expenses that Baby Veronica's adoptive parents accumulated in Oklahoma, according to multiple sources.

The proceedings were apparently initiated by the courts, not by Matt and Melanie Capobianco, who spent seven weeks in Oklahoma before taking custody of the 4-year-old girl Monday.

It's not clear how much money the courts could demand from the biological father and his tribe, who fought to keep the girl in Oklahoma.

But the courts could impose hefty fines on Brown and the Cherokee Nation, and award legal fees and living expenses to the Capobiancos, sources said.

On Thursday, Matt and Melanie Capobianco declined several offers to visit with Veronica and quietly discuss her future with the Brown family. They instead filed yet another petition in Cherokee County, Oklahoma, demanding that the girl be brought to the courthouse by 9 a.m. this morning, where they have already alerted the media to attend.

Brown and his family have been residing in Tahlequah, Oklahoma, with round-the-clock security so that the family can maintain their privacy and safety while Veronica attends preschool without media intrusion.

But as they continued their Oklahoma media tour yesterday, a large black SUV with blacked out windows was spotted trolling the Sequoyah Indian School campus in Tahlequah, the capital of the Cherokee Nation. Troy Dunn, star of the hit tv show "The Locator" and Capobianco spokesman, had brought a camera crew with him in an apparent attempt to track down Veronica and confront Dusten Brown in person on school grounds. The school is located on federal Indian trust land with hundreds of students and faculty ranging in age from pre-K through high school.

"The couple's spokeswoman, Jessica Munday, told news outlets that the Capobiancos did not accept Brown's offer to see Veronica because there is “anxiousness, when you're this close and not five states away.”

Rather than accept Brown's request to meet quietly to discuss Veronica's future, however, the Capobiancos instead turned to what has now become what insiders are calling “desperate and chilling” attempts to use the media to argue their case.

“While publicly pleading for a visit and a compromise on custody, now the Capobiancos refuse to respond to reasonable offers for both of those things, while they allow and condone a reality TV crew to stalk and harass the Browns,” said a local lawyer. “It is unclear what exactly the Capobiancos want, but it is clear that they are not at all concerned about what is best for Veronica.”

As the Capobiancos head to court this morning, Indian Country Today Media Network has learned that in her testimony in South Carolina Family Court, Melanie Capobianco testified that she was previously charged with underage drinking as a teen and later as an adult with Driving Under the Influence in South Carolina. Like many of you here in Charleston, I've followed the Baby Veronica case with great interest. And like many of you, when I first heard this morning that Veronica's biological father Dusten Brown had surrendered to authorities in Oklahoma to be extradited to South Carolina, I thought that this sad, sad saga had finally begun to come to an end. But like the countless other times when it seemed as if this entire ordeal was over with — that Veronica was finally going to be with a family that would love and care for her— it suddenly wasn't.

A short time ago, an Oklahoma judge ordered the Sequoyah County Sheriff's Department to release Brown from jail. As it stands now, Dusten Brown will return to court on Oct. 3 to learn whether he will be sent to South Carolina to be tried for the crime of custodial interference, namely that he had failed to turn over Baby Veronica to the Capobiancos. And if and when he is extradited, it will do nothing to solve the ongoing custody fight over the three-year-old little girl. In fact, it will only make things worse. Much worse. Especially for the Capobiancos.

TULSA — Dusten Brown and the Cherokee Nation announced the four-year custody battle for “baby” Veronica is over Thursday.

Veronica, who’s now four, is currently with her adoptive parents, Matt and Melanie Capobianco, and that appears to be where she will stay.

Today, her biological father Dusten Brown and the Cherokee Nation announced during an emotional press conference, “it’s over” and this decision is in the best interest of baby Veronica.

“During this four year fight to raise my daughter I had to make many difficult decisions,” says Brown. “Decisions no father should have to make.”

Local adoption attorney Jim Ikard says these battles usually end because tribe officials realize they don’t have a chance at winning and if the past four years have any lasting effects on baby Veronica, he claims it’s her father’s doing.

“Why go on if you’re going to lose time after time after time,” says Ikard. “It’s not going to be easy, but it`s not going to be easy because of the actions taken by the Cherokee Nation and the Browns.

Those actions Dusten Brown says were always to remind veronica of her Cherokee heritage.

“You will always be my little girl, my princess and I will always love you,” says Brown. “Never ever for one second doubt how much I love you, how hard I fought for you or how much you mean to me.”

Since losing the epic custody battle over “Baby Veronica,” a four-year ordeal that went all the way to the U.S. Supreme Court, Dusten Brown has steadfastly avoided media attention.

So when the girl’s biological father was invited to speak Thursday in south Tulsa, where federal officials were discussing the way Indian adoptions are regulated, he chose instead to send a written message, read aloud by an attorney.

That’s partly because Brown and his wife have a new baby boy to take care of in Nowata, an hour north of Tulsa, the attorney explained.
