The Atlanta Journal-Constitution reported the latest twist in the shocking case after obtaining a search warrant served on Justin Ross Harris.

'Through the investigation Harris has made comments to family members regarding a life insurance policy that he has on Cooper and what they need to do in order to file for it,' the paper reported...."

Dad Charged With Son's Hot Car Death Could Face Death Penalty

The Georgia dad charged with killing his toddler son by leaving the boy in a hot car all day could face the death penalty, a judge said Thursday at a court hearing.

Justin Ross Harris, 33, was denied bond and faces child cruelty and felony murder charges after he said he forgot his 22-month old son in his SUV while he was at work at Home Depot.

A detective said Harris spent part of the day while his son was dying in the overheated car sending explicit messages and photos to "multiple women." One of the females Harris sexted was 17, the detective said.

The prosecutor said that he brought up the sexting during the probable cause hearing because it "goes to the state of mind" of the defendant.

"He wanted to live a child free life," the prosecutor said.

At the end of the three hour hearing Judge Frank R. Cox denied bond for Harris because "this is a possible death penalty case."

New warrants explore personal troubles of Ross Harris

MARIETTA, Ga. -- A new batch of search warrant applications released early Friday add more details to disturbing testimony from Thursday's probable cause hearing for Ross Harris.

The newly-released court documents include the following allegations, as set forward by Cobb Police:

•Harris was interviewed shortly after his son was pronounced dead. "During the interview, Harris stated that leaving his son in a hot car was his biggest fear. According to Harris, he recently viewed a television show concerning child deaths in cars. He also stated that he researched the issue of deaths in cars on the internet."
Harris was questioned about Cooper's car seat. "Harris knew the specific make and model of the seat and what the weight limit was for the child to be seated in it. When the seat was inspected, the straps for the seat were set on the lowest level for a small child."
Harris told police he recently took over the finances for the family. "According to Harris, he has acquired some credit card debt, around $4,000 in order to acquire air line miles. Harris currently has outstanding student loans and car loans, for him and his wife."
•"Harris also claimed that he was happily married. Nonetheless, evidence of inappropriate sexual communications with other women has been obtained."Leanna Harris, the wife of Ross Harris and mother of Cooper, was also interviewed by Cobb Police. "She also made a similar statement that this was her worst fear. Investigators questioned her further about this. Leanna stated specifically that her fear was that her child would be left in a hot vehicle, not the fear of losing a child."

The new warrant applications were granted for Harris' Dell Computer Tower, Google Chromecast, MacBook Pro Laptop, Lenovo Think Pad, Apple MacBook, Apple Ipad and Iphone.

Those warrants show police plan to search for "information pertaining to finances, credit card debt, business information, life insurance, emails/communication regard child, wife and family issues, photos/videos of the child to show development, information about car seat searches, searches regarding in-car deaths, communications with other people on the days leading up to and the incident date, information on life insurance policies and any other information related to this incident."

The documents also show police searched the family's condo for "evidence to include the inspection of the lights in and around the residence, if there are a sufficient amount of light bulbs in storage to determine if there was a need to purchase light bulbs the afternoon of the incident."

ATLANTA - Newly released court records show police want to learn about the health of a toddler in the months before he died of heat exposure in his father's car near Atlanta.

Search warrants and affidavits released Monday show that investigators are seeking medical records for 22-month-old Cooper Harris, any medical conditions he may have had, and information about his growth and development.

The child's father, 33-year-old Justin Ross Harris, faces murder and child cruelty charges in the June 18 death. Harris has said he left the boy in the SUV for about seven hours after forgetting to drop him off at day care.

Harris hasn't been accused of past abuse. But Jessica Gabel, an associate professor of law at Georgia State University, says police often seek medical records to check for past signs of abuse in children.

COBB COUNTY, Georgia – Investigators in Georgia today took the SUV belonging to murder suspect Justin Ross Harris back to what they have previously described as a crime scene, trying to recreate details similar to the day 22-month-old Cooper Harris died.

Atlanta's FOX 5 I-Team was on the scene as investigators with Cobb County tested the real-time conditions of the Harris family car, simulating the day that Cooper died. Investigators brought the actual Hyundai Tucson to the exact spot where it was parked the day that Cooper was left in the car for seven hours while his father was inside at work at Home Depot.

At a preliminary hearing held last week, Cobb County  Det. Phil Stoddard referred to the parking lot and parking spot as a 'crime scene.'

Coupled with everything else, the fact the bio dad parked in the back of the lot (while other closer spaces were open) adds just another bullet in the gun.

On radio, I heard something of interest.
When the bio dad opened the door to the vehicle he would have SMELLED the odor of death. May even had flies buzzing about. There was NO WAY he did not know his son was in the vehicle and his son was dead.

Little Cooper was reported to have worn away and bruised the back of his head in trying to get free. I imagine he started trying to get free as soon as his bio dad shut that door and locked it.

The infant's face showed signs of being scratched.
They had not healed at time of death.
IMO, the child was crying frantically and probably wiping away his own tears and may have scratched himself in the process...

I am curious as to whether this child had been injured or denied proper care in the past.

This one hurts. Really bad. Sad

I agree, Freckles....It is gut wrenching to say the least.

I believe the medical records from Kaiser Permanente were on the latest search warrants...and, oh by the way, KP is directly across the street from RH work IIRC.  

Surveillance video also shows that RH sat in the car for 30 seconds after parking that morning.... saying something to Cooper?  See ya later, kiddo.  Ugh, makes me sick.  6 minute phone call to day care when all h*ll broke loose??  Not doing CPR.  He also had stranger call 911 - speculation that his dispatcher background knew that 911 calls would be scrutinized and he didn't want his voice on it?

....this one has me in despair.

ATLANTA — On Thursday, defense attorney Lawrence Zimmerman confirmed to CNN he had been retained by Leanna Harris, the mother of 22-month old Cooper Harris, who died June 18 when he was left strapped all day in his car seat inside his father’s SUV.

Leanna Harris, Justin’s wife, has not been named a suspect in the case. Officer Michael Bowman, a Cobb County police spokesman, said Monday, “Leanna Harris has been interviewed. Detectives continue to work on the case.”

Police have alleged she behaved strangely in the days before and moments after the death of her 22-month-old boy.

As they investigate, detectives in Georgia wanted to know how high the temperature climbed in that back seat, so this week they recreated that sauna heat in Justin Ross Harris’ silver Hyundai Tucson.

Authorities have not released the data yet, but CNN weather experts believe temperatures could have climbed to nearly 140 degrees inside the car.

A government traffic agency has corroborated the possibility.

Toxicology results released in death of Cooper Harris

COBB COUNTY, Ga. – Details of the toxicology report of the 22-month-old boy who died after his father left him in a hot car in Cobb County have been released.

Cooper Harris had no medications and no sedation agents given to him on the day of his death, according to the report.

Harris, who worked for two years at the The Home Depot's corporate offices in the Atlanta suburb of Smyrna, has been terminated, a spokeswoman for the company said Thursday.

Harris, a web designer, had been on unpaid leave since charges were filed last month.

Catherine Woodling gave no details of the termination.

A Home Depot charity fund paid for Cooper's funeral."

This poor little.
It makes me sick to my stomach to think of the way he died. There is absolutely no way I can possibly believe that from the time JRH strapped him in the car seat at chickfillet and drove the couple of minutes to park at work that he forgot about his son.

I can't help but think that the dad "sexting" will be his defense. I'm sure the defense will say he's a sex addict and that his addiction led him to distraction. I really hope the mom was not involved, but it's not looking good at this point.

Cobb Judge Mary Staley to preside over Justin Ross Harris case

MARIETTA — Cobb Superior Court Judge Mary Staley was assigned Tuesday to hear all future court proceedings involving Justin Ross Harris, said Tom Charron, court administrator.

“She wasn’t chosen for any specific reason,” Charron said of Staley. “The judges are assigned randomly.”

Charron said it is normal for a judge to be chosen as soon as a case is transferred to Superior Court from a lower court. After Harris July 3 probable cause and bond hearing, Chief Magistrate Judge Frank Cox transferred the case to the Superior Court.

Dad in Georgia hot car death charged with murder

MARIETTA, Ga. — More than two months after his son's death in a hot car, a Georgia man who prosecutors say sat in his office exchanging nude photos with women while his son languished for hours was charged with murder on Thursday.

A Cobb County grand jury indicted Justin Ross Harris on multiple charges, including malice murder, felony murder and cruelty to children. The malice murder charge indicates that prosecutors intend to prove Harris intentionally left his son Cooper in the hot car to die.

The eight-count indictment also includes charges related to sexually explicit exchanges prosecutors say Harris had with an underage girl.

"Today was another step in a long process," Cobb County District Attorney Vic Reynolds said. "We look forward to the case running its course and, ultimately, justice being served in this matter."

ATLANTA (CBS46) - One day after Justin Ross Harris was indicted on eight counts related to the hot car death of his 22-month-old son, Cooper, an Atlanta defense attorney says the district attorney in Cobb County would only have sought the charge of malice murder if he thought he had a chance to get a conviction.

A conviction on that count would pave the way for Harris to receive the death penalty. He is accused of leaving his son locked in a hot car to die, while he was at work.

"I've known (Cobb County District Attorney) Vic Reynolds a long time," said defense attorney Ray Giudice. "He's a quality man and great lawyer. My belief is he would have not sought that count of malice murder in front of a grand jury unless he and his staff believe they can prove it beyond a reasonable doubt."

Report: Mother of toddler in Cobb hot car death passes polygraph test

The mother of a 22-month-old Cobb toddler who died after being left in a hot car for seven hours on a 90-degree day in June passed a polygraph test, unidentified sources told ABC News.

Fox 5 Atlanta responded to that report by tweeting that the polygraph was administered by Leanna Harris’ lawyer rather than by police.

Hot car death: Ross Harris pleads not guilty, the truth about 8 count indictment

The result of the Grand Jury hearing against Ross Harris was an 8 count indictment that included one count of malice murder, 2 counts of felony murder, 1 count of intentional child neglect, one count of child cruelty in the second degree, a count of criminal attempt and two counts of the dissemination of harmful material to minors. ABC News has reported on October 17 that Ross Harris has waived his rights for an arraignment on these charges, and also entered a not guilty plea.

...The charges in the 8 count indictment against Ross Harris are considered to be "strong" charges according to CNN. If Ross Harris is found guilty of the "most serious charge", that would be the charge of malice murder, he will spend at least the next 25 years in jail. Additionally, the charges related to minors, particularly the dissemination of sexual material, carry very stiff penalties in the State of Georgia.

The State of Georgia does not have a premeditated first degree murder charge. This is why the felony murder counts that Ross Harris are also facing are also very serious charges. Georgia breaks down murder according to two different kinds, malice murder and felony murder according to Georgia Penal Code Title 16 Chapter 5 Article 1.

".... The State of Georgia does not have a premeditated first degree murder charge. This is why the felony murder counts that Ross Harris are also facing are also very serious charges. Georgia breaks down murder according to two different kinds, malice murder and felony murder according to Georgia Penal Code Title 16 Chapter 5 Article 1.

Here malice murder, which is the first and most serious charge Ross is facing, is considered an "intentional killing." Felony murder is considered an "enigmatic unintentional killing" according to CNN, and are the second and third of 8 counts that Ross is facing. In Georgia, it is also considered a felony murder if an individual died while a felony was being committed, for example the dissemination of material to minors.

The minimum sentences for either of these charges is life in prison, however it was the malice murder count that made Ross Harris eligible for the death penalty. The malice murder is the most serious count against Ross Harris right now, and although the death penalty has been removed from consideration this does not mean that this charge will be removed come trial as well.

According to Georgia law and CNN, malice murder "can be implied" if the prosecutor can show that a defendant shows an "abandoned and malignant heart" during the commission of a crime, or while the death occurred. Since it came to light that Ross Harris was allegedly sexting multiple women, one allegedly being a minor, while Cooper Harris died, many people have considered this to be the hot car death of Cooper Harris one that was the result of an "abandoned and malignant heart."

The felony murder counts are also very problematic for Ross Harris. Georgia law considers this kind of murder to be unintentional, but felony murder is a murder that occurs while another crime is being committed. In order to meet the burden of proof for felony murder in the hot car death case of Cooper Harris, Cobb County prosecutors then will only have to show that he committed a felony, and that a death occurred while he was committing that felony.

Child neglect is one of the felonies the state is pursuing against Ross Harris. The State will try to show that Ross acted in a way that caused Cooper Harris "cruel and excessive physical pain" according to CNN. Child cruelty in the second degree is another felony stacked against Ross as it stands right now. Here the prosecutor will need to show that Ross Harris "caused pain with criminal negligence", regardless of whether or not the infliction of pain was intentional.

The remaining counts against Ross Harris are related to the sexting, these are all very serious charges as well, particularly considering a minor was allegedly involved. To the small handful of people that are supporting Ross Harris, these charges seem frivolous. But that Ross has been indicted on these charges now makes the alleged sexting to a minor very relevant charges, and relevant evidence in this case...."

If the sexting information will be relevant at trial, which it will be as it has been included in this indictment against Ross, it will be very interesting to see when and how much Leanna knew about that. She has claimed that she first heard about this at the probable cause hearing, although many find that hard to believe. It has been alleged that Ross Harris was sexting a minor for over a year. How could Leanna Harris not know about that?

If she did, this changes the face of this case. It would mean she lied for one thing, and if so, why? This is the issue that has confused so many people. Why would someone stay with someone that engaged in this kind of behavior in a marriage? ...."

Justin Ross Harris Wants Murder Charge Dropped in Case of His Toddler's Death

11/19/2014 AT 04:00 PM EST

PEOPLE has obtained 15 motions filed on Oct. 27 that will be argued in front of a judge next month. In one of the motions, Harris's attorney, Maddox Kilgore, argues that the murder charge should be dropped. He argues that the life sentence that Harris faces "is cruel and unusual if it is grossly out of proportion to the severity of the crime."

In another motion, Kilgore argues that Harris's interviews with police should be suppressed, claiming that Harris was not read his Miranda rights. "Statements to law enforcement officers were the result of custodial interrogation … made without being properly advised of his rights," he wrote.

...The jury trial is scheduled to begin Jan. 12.

Channel 2 obtains evidence list in Ross Harris case

COBB COUNTY, Ga. — Channel 2 Action News has obtained a list of evidence prosecutors will use against Justin Ross Harris. He's accused of deliberately leaving his 22-month-old son, Cooper, to die in a hot car.

"There's simply an extraordinary amount of material. Some 124 individual items of evidence listed here, any one of which could be reams and reams of documents or volumes and volumes of electronic material so there's quite a lot to digest," Holloway told Channel 2's Ross Cavitt.

The evidence turned over to Harris' legal team includes videos taken from Home Depot, the Chick-Fil-A where Harris and his son ate breakfast and those taken by investigators at the crime scene and elsewhere.  

The list inclused dozens of interviews with witnesses, friends, and co-workers of both Harris and his wife, Leanna, and lengthy forensic examinations of multiple computers, cellphones, and hard drives belonging to Harris and his wife.

Attorney: Harris hot car death trial may see delay

MARIETTA — The attorney for Justin Ross Harris, who is charged with murdering his 22-month-old son by leaving him in a hot car to die, received police evidence in the case this month, including various electronics and Internet records.

Maddox Kilgore, who represents Harris, 33, of Marietta, requested the evidence Dec. 4, according to Cobb Superior Court records.

Marietta attorneys say Kilgore’s request for the evidence was the natural next step in the case, based on Georgia law, which requires both the defense and prosecution to share all the evidence each plans to present in court.

As the Jan. 12 scheduled start date for Harris’ trial looms closer, Marietta defense attorneys say Kilgore might not have enough time to prepare, so the case could be pushed back.

One year later, hot car death case still not close to trial

COBB COUNTY, GA (CBS46) -

Justin Ross Harris, the Cobb County man accused of letting his son Cooper die in the back of a hot car, is still waiting for his day in court, one year after his son died from extreme heat exposure.

...Before the case can go to trial, a judge must first hear motions from the prosecution and defense, and rule on them. Reynolds said he expects that to happen late in the summer or early in the fall. After the motions have been heard and ruled upon, the judge will set a trial date.

That date probably will not be until sometime early in 2016, according to the Cobb County District Attorney's Office.Another factor is the jury.

Justin Ross Harris Trial: Defense asks to shut the public and media out

September 9, 2015


Attorneys for Ross Harris, the Georgia dad accused in the "hot car death" of his toddler son Cooper, filed a motion yesterday to seal the courtroom on future pretrial motions hearings.

Lawyers for (Justin) Ross Harris claim their client cannot receive a fair trial unless the judge closes the courtroom to all public and media for upcoming pretrial motions hearings.  In the 17-page motion, the defense cites local and nationwide pretrial publicity as justification for holding hearings in a closed courtroom.

...Harris has pretrial hearings coming up next week and in October.  

...Judge Mary Staley is expected to set a trial date at the upcoming hearings.

As Justin Ross Harris, accused of intentionally leaving his 22-month-old son inside a hot SUV to die in June 2014, prepares to return to the public eye for the first time in more than a year, Cobb County on Friday released the toddler’s autopsy.

There was little new information in the medical examiner’s report, which listed the cause of death as hyperthermia.

A re-creation of Cooper Harris’ death, conducted on a slightly warmer day, found the temperature reached 120 degrees inside his father’s SUV.

...A series of pre-trial hearings are scheduled through Wednesday, including a defense motion to suppress evidence of a conversation between Harris and his wife soon after they learned he was being charged with his son’s death.

...Harris’ attorney has moved to close the pre-trial hearing to the media, arguing their presence could jeopardize his right to a fair trial.

Superior Court Judge Mary Staley refused a motion by the prosecution last winter to limit public access to documents and is unlikely to grant the defense’s request.

Judge will allow cameras in courtroom during hot car death case

COBB COUNTY, GA (CBS46) - Cameras will be allowed in the courtroom during the trail of the man accused of intentionally leaving his son in a hot car to die.

Justin Ross Harris appeared in a Cobb County courtroom on Monday to ask a judge to suppress certain evidence in the case, among other motions, including one to disallow cameras in the courtroom.

Several hearings are scheduled this week in the case against Justin Ross Harris who was charged with murder in the death of his son in June of 2014. It was at that time when Ross allegedly left his 22-month-old son, Cooper, in a hot SUV for seven hours while he went to work at the Home Depot headquarters.

COBB COUNTY, GA (CBS46) - The case against Justin Ross Harris is playing out in a Cobb County courtroom.

Harris is accused of leaving his 22-month-old son Cooper Harris to die, in a hot car, last summer.

The defense is arguing that some statements Harris made during the interview should be thrown out, because investigators did not follow the proper procedure during that time.

A responding officer spoke to what she recalls about Harris in the moments right after he discovered his son was dead.

The judge ruled Tuesday that those statements will be admissible in his trial.

ATLANTA — One of the first officers to respond after an Atlanta father discovered his son, comatose, in the back of his SUV testified Tuesday Justin Ross Harris was combative with police at the scene, the Atlanta Journal-Constitution reported.

Det. Jacquelyn Piper said Harris refused when she instructed him to hang up his cell phone, then told a fellow officer who repeated the demand to “shut the (expletive) up.”

Within hours of his son’s death, Justin Ross Harris appeared relaxed and unemotional as he chatted with Cobb County police — up until the time he was charged with felony murder and cruelty to children, according to testimony and video taken of his interview with investigators.

At that point, Harris told them he had “no malicious intent,” testified Det. Phil Stoddard Tuesday during Day 2 of motions hearings, adding he was well-acquainted with the charges against him and what they meant.

Detectives take stand in Ross Harris pretrial hearing

ATLANTA -- New details emerged Tuesday morning in regards to what Ross Harris said to authorities moments after discovering his 22-month-old child dead in his car.

Detective Jacquelyn Piper, who was a patrol officer the day Cooper died, was the first of two detectives to take the stand. There, she discussed three statements Harris made when he was arrested.

While on stand, Piper said Harris was put in handcuffs to help secure the scene, not because he was under arrest.

Detective Phil Stoddard, who was the first to talk to Harris at the police station, followed Det. Piper on the stand.

Det. Stoddard interviewed Harris for about 20 minutes, taking his handcuffs off and offering him water and snacks. When the accused father was told he would be charged with murder, Harris told the detective: "there was no malicious intent" and invoked his right to remain silent.

Towards the end of the hearing, the judge announced she would allow all statements to be used in the trial, which would likely take place in the spring of 2016.

But! IS it reasonable to expect "private and personal use" during work hours and at a work environment when your employment description does NOT include the creation of pornographic material during your employment hours? Is it reasonable to expect "privacy" (even on break) while at a place of employment or on the grounds, ie, parking lot, outside the building or work site?

Overriding this, of course, is the fact the recipient of the porn material was a minor at the time. No clear definition on the term of "child" vs "minor" child. Atty wants this to be ignored as the child was of age, in his opinion, to BE of age to consent to sexual activity at the age of 16 years of age.

He argues it HAS to be tied to a "criminal crime" in order to be classified as exploitation of children. He asks if this would include two children engaging in sexual activity, the creation of media depicting children engaging in said activity while there is no real child involved but just images created. This poor little.
It makes me sick to my stomach to think of the way he died.  There is absolutely no way I can possibly believe that from the time JRH strapped him in the car seat at chickfillet and drove the couple of minutes to park at work that he forgot about his son.  

I can't help but think that the dad "sexting" will be his defense.  I'm sure the defense will say he's a sex addict and that his addiction led him to distraction.  I really hope the mom was not involved, but it's not looking good at this point.


Look at the hearing vids just posted.
His attys are trying to argue RH did not break any laws with the sex-texting as they were both of consenting age.
States a right to privacy.
That will be the way to try to suppress letting the jury hear of his activities.
Mainatins it was private and protected by right of privacy.

You nailed it, however, as to what this is going to be about.
It is NOT going to focus on the death of an infant.

Prosecutor: Explicit chats point to motive in Ga. boy's hot car death

MARIETTA, Ga. -- A judge ruled on Monday that she won't try charges that a Georgia man accused in his son's hot car death had inappropriate online exchanges with an underage girl separately from murder charges against him.

Allegations that Harris had sexually explicit online conversations with the underage girl are completely unrelated to the murder and child cruelty charges he faces in the death of his 22-month-old son Cooper, defense attorney Maddox Kilgore argued Monday.

But Cobb County Superior Court Judge Mary Staley ruled against him, agreeing with the prosecution that those alleged actions can provide evidence of a motive for the murder charges and can demonstrate Harris' state of mind leading up to and on the day of the boy's death.

A detective testified that Justin Ross Harris told women he met online that he would leave his wife if not for their son, reports the Atlanta Journal Constitution

Father accused of intentionally leaving his 22-month-old son in a hot SUV to die tries to get evidence that he was sexting underage girl thrown out of court

"....Defense lawyers filed a 35-page motion Monday arguing police violated Harris' Fourth Amendment rights by seizing and searching his cell phone and computers without probable cause or a warrant.

The attorneys are trying to suppress the electronic evidence filed against him, according to WTOC.

Cobb Police Detective Jacquelyn Piper testified on Monday Harris was arrested at the scene of his son's death after he became confrontational with a cop, the Atlanta Journal Constitution reported.

Harris, who was not a suspect at the time, refused to stop talking on his phone and swore at an officer, so he was placed in handcuffs and his phone was confiscated and subsequently searched.

Lawyers for Harris claim the evidence is not admissible in court because of how it was obtained.

Justin Ross Harris’ defense team on Monday assailed Cobb police’s handling of the investigation that led to the arrest of the former Home Depot web developer charged with intentionally leaving his son inside a hot car to die.

In a 35-page motion being heard in Cobb County Superior Court, the defense accused police of searching Harris’ cell phone “without securing a search warrant … a clear violation of (his) Fourth Amendment rights.”

Harris’ lawyers seek to suppress all evidence obtained from their client’s cell phone, which an officer seized in the Cobb parking lot just minutes after the Marietta man discovered his 22-month-old son’s lifeless body.

Cobb Police Detective Jacquelyn Piper testified Monday she took the phone away from Harris after he had become confrontational with another officer at the scene. He was not a suspect at the time.

Harris, 34, pleaded not guilty to charges including malice murder, felony murder and cruelty to children. He has been held without bond since his arrest in June 2014, with his trial scheduled to begin February 22.

Cobb Superior Court Judge Mary Staley said Monday she was determined to stick to that date, calling it “reasonable” and “doable.”
