Welcome back! Haven't seen much of you since the Treyvon Martin/GZ case.
AD, CP, and others have contributed fabulously as well...

Reeva's Death 'Ruined' Steenkamp Family, Cousin Says

South African track star Oscar Pistorius returned to court Wednesday, for the third day of his sentencing hearing which will determine if the athlete goes to prison for killing his girlfriend in February last year.  His defense team has aggressively pushed for house arrest rather than jail time.  Defense witnesses have argued that the Olympian has shown remorse, suffered a loss of income and reputation, leaving him a “broken man."   The prosecution began questioning its witnesses Wednesday afternoon.

Reeva Steenkamp’s cousin wept as she painfully recalled the moments she learned of her cousin’s death, describing it as the “end of the world."  On her way to work at the time, Martin and her husband initially heard the breaking news on their car radio.

..."It's ruined our whole family.  It's ruined Auntie June and Uncle Barry.  Reeva was everything to them,” she said, adding, “I must be Reeva’s voice.  I had to do this for Reeva, I owe it to her.”

...Court adjourned for the day following the decision that Martin was too emotional to be cross-examined by Pistorius’s defense team, who will continue tomorrow.  The prosecution is expected to call an additional three witnesses.

Oscar Trial: Nel challenges Vergeer on sentencing

PRETORIA – Defence witness Annette Vergeer, a probation officer who has recommended that Oscar Pistorius not be jailed for shooting Reeva Steenkamp, placed wrong information before court and was biased.

Vergeer stated in her report to court that the inadequate facilities in prison would only serve to “break the accused even further”, but after hours on the stand eventually conceded that it was possible for Pistorius’s needs to be adequately addressed.

Vergeer did not respond.

Nel pointed out to her that South African prison officials had successfully argued in British courts during the Shrien Dewani honeymoon murder case that prison facilities here were indeed adequate.

Vergeer said she had no knowledge of the case and was not aware of it.

PRETORIA – Oscar Pistorius paid R108,000 to Reeva Steenkamp’s parents over an 18-month period.

This was revealed by the family’s lawyer Dup de Bruyn after the issue of the payments came up in the North Gauteng High Court on Tuesday.

De Bruyn explained the circumstances of the payment to journalists outside the court.

He said he had arranged the funding via Pistorius’s legal team a month after Steenkamp was shot and killed.

"There’s nothing to tell except what I’ve told you in court. And that is when Reeva passed away the family was in financial difficulties. I conveyed it to Oscar’s legal team, they conveyed it to Oscar and he made the offer to pay them R6,000 a month," de Bruyn said.

"At the beginning in March when Oscar offered the R6,000, we wanted to make it public. We thought it fair that the public should know. They asked us to be confidential."

De Bruyn said Pistorius’s lawyers didn’t explain why the payment should remain confidential and said he never asked. He added that this was not a condition of the payment.

"It was a word of mouth agreement," he said.

I believe that Reeva's parents hired this lawyer, Dup de Bruyn, because they intended to file a civil lawsuit against Pistorius, a wrongful death lawsuit, but the lawyer instead made a deal with Pistorius that prevented Reeva's parents from taking legal action or testifying against him.

If the prosecutor would have called Reeva's parents to the stand during the sentencing phase, Pistorius' lawyers would have discredited their testimony by bringing up the money issue, that's why Reeva's cousin testified, that is why she was "Reeva's voice", Reeva's parents would have been accused of extorting "blood money" from Pistorius by his lawyers if they would have testified. The defense knew the reason why they were not going to speak on Reeva's behalf, so did the Steenkamp's lawyer, that is why  Annette Vergeer, the probation officer who has recommended that Oscar Pistorius not be jailed for shooting Reeva,  brought up the issue of the payments during her testimony.

"De Bruyn said Pistorius’s lawyers didn’t explain why the payment should remain confidential and said he never asked."

Really? He never asked? Isn't he a lawyer? Wasn't he supposed to protect the interests of his clients? I think that June and Berry were set up.

PRETORIA, South Africa –  Reeva Steenkamp's cousin sobbed while testifying Wednesday how she first heard on a car radio that Oscar Pistorius had killed his girlfriend.

Kim Martin said she had "hoped to God" that Pistorius was cheating on her cousin and that the young woman he had shot at his home was not Reeva.

"They hadn't confirmed the name, they said his girlfriend," Martin recalled of the early-morning news broadcast. "I was trying to phone her (Reeva) and she wasn't answering and I was screaming at my husband."

Martin, who said she was close to Steenkamp, went to her mother's house where she learned her cousin had been killed by the Olympic athlete.

I smell a rat ... Me too! I am sure he did this in order to prevent any future claims the family might make in a wrongful death case. It was a, "See? I tried to be compassionate and caring and the bled me dry, into bankruptcy! What more do they want?" It was NOT done because he wanted to take responsibility for his actions but rather wanted the appearances the family was black mailing him.... Again, OP ants to blame the victim.... or the victim's family for his own actions.

In Pretoria Central prison, #OscarPistorius could have a single cell, w own loo, basin, bed, sheet, blanket “& also a pillow!” says Modise.

Steenkamp cousin says Pistorius apology not genuine

"My lady, I really believe the accused, Mr. Pistorius, needs to pay for what he's done," Martin testified before the red-robed judge.

Schultz is a former boxer and the self-confessed killer of a businessman who escaped prosecution in an immunity deal with the state. He has been seen sitting in court this week with two men who have had altercations with Pistorius in the past...."

Roux gets what he wants. Modise states that Oscar Pistorius WILL go to the prison hospital

Roux: there is 1 doctor for 700 inmates? Modise: Yes, but there are other doctors who come to the prison.

Modise estimates that there are 7000 inmates at Kgosi Mamphuru - with one doctor and 5 psychologists

Modise: there are 22 single cells in the hospital unit, 7 of which are currently occupied.


So court is adjourned until tomorrow. The defence and state will submit their final arguments ahead of sentencing

Mr Pistorius, the greatest contribution you can make for those with disabilities will be in prison. So show the country that you are the great man you said you were – take your punishment, and make prison a place where disabilities are well accommodated.

People with disabilities in South Africa - and the formal disability agencies and associations representing this constituency - have been trying, desperately, to be recognised in the mainstream.

However, when we transgress, and break the law, we must accept the appropriate punishment, too. We do not want special laws for people with disabilities just because one OP killed his girlfriend. And now you, the very same person who bragged about fighting your way into the Olympic arena, which you thought was greater than the Paralympic arena, are desperately trying to find a way of doing community service in the disability sector and community.

You must also show your colours in the correctional services arena. JAIL.

We do not want you doing community service in our sector. You profess to have inspired the disability sector and constituency. A referendum would prove you wrong. Your arrogance has never been embraced by us. Your achievements have only fed your own ego. Your definition of philanthropy is giving away an old pair of Nikes and a scratched pair of Oakleys, mixing with people with disabilities whilst cameras flash; giving away your signature.

Reuters) - Oscar Pistorius will be committed to the hospital wing of one of South Africa's toughest prisons if the double-amputee Olympic track star is sentenced to jail time for killing his girlfriend, the head of the prison service said on Thursday.

On the fourth day of Pistorius' sentencing hearing, Zach Modise, who has worked in the prison service for 35 years, was questioned by the defense about conditions at the Pretoria Central Prison, Pistorius' most likely destination because of its disabled facilities.

The tiring and at times farcical Oscar Pistorius trial took a strange twist on Thursday as defence and prosecution continued to argue in mitigation and aggravation of his sentence. The story, however, is coming to an end. By GREG NICOLSON.

Like an unnecessary plot twist in a Shonda Rhimes series, the trial saw drama on Thursday featuring a brute, a grieving sister and the fallen athlete. I saw none of it myself – it's hard to see anything beyond the shoulders of Marc Batchelor and his proteined cohorts – so the story is second-hand, from the mouth of Carl Pistorius.

Aimee Pistorius is the stoic, grieving sister. She's been at at Oscar's side throughout the trial, passive, occasionally crying and stealing a moment with her brother to hold hands, seeming almost connected to his anguish. She has dark hair and a pale complexion, has been dressed in elegant grief. If Oscar has played the bereaved accidental killer, she's the epitome of the innocent, fragile family member, dignified, loyal and attractive.

Mikey Schultz is Marc Batchelor's mate. The Batch is connected to the case, slightly: the soccer star was called into a meeting with police and Pistorius after they had words following the Olympian's reported threat that he would break Quinton van den Bergh's legs for talking to his girlfriend at the time, Sam Taylor. Batchelor found Pistorius had a bad temper and could be controlling of women. He wasn't exactly a key witness.

Self-Confessed Killer Mikey Schultz Causes Drama In Oscar Court

There was unhappiness in the North Gauteng High Court on Thursday, after self-confessed killer Mikey Schultz sat down in the front row on Oscar Pistorius’s side.

Schultz, who confessed to killing mine magnate Brett Kebble in 2005, sat down next to the Pistorius family with a friend. He caused a stir after he allegedly mouthed “F*** You” to Pistorius’s sister Aimee shortly after court adjourned for lunch.

It’s understood Aimee was concerned that by Schultz sitting with the family, it would create the impression he was associated with them.

Schultz has denied he threatened Aimee and the Pistorius family. He reportedly called the family a “bunch of liars just like Oscar.”

Kebble was gunned down in Melrose, Johannesburg in September 2005 by Schultz and two others. Schultz claimed Kebble was in financial trouble and wanted to die. He said he helped Kebble to commit suicide.

Schultz was arrested for Kebble’s murder but escaped conviction after he agreed to testify against drug trafficker Glen Agliotti, the man who allegedly masterminded Kebble’s murder.

15 minutes until last day of sentencing (mitigation phase) trial pf OP for the murder of Reeva. Both sides will present their clsoing statements and then submit said report to the judge for her consideration. If it is concluded this AM, possibly have a sentence before close of SA business day. If not, then in two or three days the judge will call everyone back in for the sentencing. She has told the court she is booked solid for the next few weeks so I sure hope this is a done deal.... finally! .... today. Early morning court hours are killing me. Tell me I should be awake and I instantly am cantankerous and sleepy.

IMO, first clue of excessive force is he killed his gf intentionally!

Roux: I have no doubt that the state will present you with cases to tell you about deterrents, retribution.

Roux: the accused's actions were dominated by vulnerability and anxiety...it is compromised person

Roux: You can put him in jail but that's not ubuntu. Get him to give the goat back and get him to do something good in society.

IMO He can't "give the goat back" after he has killed it...

Roux: uBuntu should involve getting the perpetrator to "pays the price in a corrective and restorative way."

IMO, this is the opinion of Roux. Is it the current law? He believes the punishment should be corrective so EVERYONE benefits, including the perp....

Roux: there was an accused an a victim. After the trial, the accused became the victim.

Roux on bail hearing: "He was accused of premeditated murder. It's not in dispute that the investigating officer gave false evidence."

Roux: not a single witness has refuted what state psychologist said about accused's feeling about Reeva..

Roux: Pistorius never ever considered that it was Miss Steenkamo behind that door

Roux condemns some media and social media for pushing pre-meditated theories about #OscarPistorius deliberately killing Reeva.

Roux: OP was subjected to unfair attacks by media including claims that he took acting lessons before testifying.

Roux refers to case of rugby player Vleis Visagie, who accidentally shot and killed his daughter.He was never charged


Roux: there is permanent excruciating pain in being the one who caused the death of a loved one. It's permanent

Roux: "He disclosed everything at bail.. never wavered from it. But he became for 18 months a pre-meditated murderer

Judge interjects, says she's concerned about his references to media reports. How would she know if true or not?

Roux says reports are false. Point he's trying to make is to expose their unfairness, impact on Pistorius

Masipa: It's important for the court not to be influenced by anything that was not part of this trial.

Roux: 'is this a person you must remove from society? We say no.'

Roux describes #OscarPistorius going beyond contractual charity work to contribute privately to help others.





My Comment:
Every case Roux has cited deals with blood relatives, married spouses... Not one case was a gf murdered by bf...Roux keeps harping on how much OP and Reeva loved each other. I call BS! and point to her letters stating her fear of him... and the short time they had dated. They did NOT live together for if they did, why did she have her suitcase out with folded clothing in it the day she was killed? Roux is arguing OP has been falsely accused of road rage, etc. BS. If OP does not like the truth others see in him then he should change who he is



So much BS by Roux.
Judge is going to buy this crap, IMO.

#OscarPistorius doesn’t want the money back. “It’s unconditional,” says Roux, telling the Steenkamps to give it to charity.

IMO That would cloud the issue of a wrongful death lawsuit and the cash involved IF they gave it away now... it must be REJECTED and not ACCEPTED for charity if they are to sue at a later date. He knows this. The lies are thick from Roux re OP's feelings, actions, charity work, temperament, and financial setting.

According to a graph, ROI determined that 65.5 percent of people wanted Pistorius to be jailed, and 18.58 percent wanted him to get house arrest.

Another 9.76 percent of people wanted Pistorius to be given community service, and 6.15 percent wanted him to be fined.

On September 12, Pistorius was convicted of culpable homicide for the shooting of Steenkamp.

The court found him not guilty of murdering her. Pistorius shot Steenkamp through the locked door of the toilet, apparently thinking she was an intruder about to emerge and attack him.

Pistorius was also found guilty of firing a pistol under a table at Tasha's restaurant in Johannesburg in January 2013. ...."
