Facts of the Case

"....At Timothy Ring's trial for murder, the jury deadlocked on premeditated murder, but found Ring guilty of felony murder occurring in the course of armed robbery. Under Arizona law, Ring could not be sentenced to death, unless further findings were made by a judge conducting a separate sentencing hearing and only if the judge finds at least one aggravating circumstance and no mitigating circumstances sufficiently substantial to call for leniency. Because the jury had convicted Ring of felony murder, not premeditated murder, Ring would be eligible for the death penalty only if he was the victim's actual killer. Citing accomplice testimony at the sentencing hearing, the judge found that Ring was the killer. The judge then found two aggravating factors, one of them being that the offense was committed for pecuniary gain, as well as one mitigating factor, Ring's minimal criminal record, and ruled that the latter did not call for leniency.
Question

Does Arizona's capital sentencing scheme violate the Sixth Amendment's jury trial guarantee by entrusting to a judge the finding of facts sufficient to impose the death penalty?...."

Ring is currently appealing and requesting new trial.
His case is ACTIVE but I can't post the pic/info from the link given.
He was granted in June, 2015. until July 6, 2015, additional time to file requesting a review of his case.

Domestic violence shelters all over the Valley cater to abused women, but one shelter in the East Valley believes men should not be left out.

My Sister’s Place, which is run by Catholic Charities Community Services, is helping guys escape violent relationships by giving them a place to stay when they leave their partners.

It’s a taboo topic in a lot of ways because not many men want to admit they're getting beat up in their relationship. But the experts say it's a pretty common problem and about time the stigma disappears.

"It was just a bad situation and I just had to leave. So it was kind of like an emergency," said a man at My Sister’s Place who escaped a violent five-year relationship with an abusive boyfriend. He didn’t want to be identified for safety reasons so we’ll call him Tom.

Tom said the stigma and embarrassment of being an abused man was one of the reasons it was difficult to leave.

"Oh yeah, definitely," he said. "That's the biggest problem – leaving - and then asking for help."

My Sister’s Place started taking men a year ago.

"In the past year we've had three adult males. So that is a big shift for us because, in the past 29 years, we've had zero," said Sheryl Christianson, a mental health worker with 30 years of experience.

Also the director of My Sister's Place, Christianson said 1 out of every 7 to 10 men are domestic violence victims. Hard statistics are difficult to pin down because not many abused men report their problems.

"It's abusive behaviors that if the gender roles were turned around we would say that's a very abusive and dangerous behavior. But we don't think of that when it's a female doing that to a male," Christianson said.

Christianson said the high-profile Jodi Arias murder trial changed the way a lot of people look at domestic violence against men. Now guys just need to know there’s help available...."

The prison in Florence is Southeast of the Phoenix area (about 40 miles). JA is being held at the Perryville prison which is West of the Phoenix area. Here in Phoenix it is very hot and often humid this time of the year because of the yearly monsoon season. I doubt that JA's swamp cooler is doing an adequate job of cooling her cell right now so she probably feels like she is living in a sauna. Good!

Great find, Freckles!

Wow, I didn't think that we would get a book from Juan Martinez until after he retired, if ever. I'm so excited. Juan and Detective Flores are the only two potential authors that I am interested in hearing from. IMO, anyone from the DT or Arias' camp have huge reasons to lie and spin the truth and the Alexander's are not likely to know much more than what the public learned in the trial; therefore, I probably would not read books from the DT or the Alexander's. I don't mean that to sound insensitive toward the Alexander's, but I just don't think I could subject myself to re-live the pain that we saw on their faces everyday throughout that trial.

Travis Alexander: Lifelong friendships made in the midst of tragedy

Seven years ago Travis Alexander was murdered.  The killer, Jodi Arias, thought that would be the end of him.  She couldn't have been more wrong.

"....Attorneys are bound by not only the rules of the court but also by ethical rules.

For example, Ethical Rule 1.6-Confidentiality of Information, states that a lawyer shall not reveal information relating to the representation of a client unless the client gives informed consent. In other words, an attorney owes their client a duty of confidentiality that lasts forever, yes, forever.

This means that Kirk Nurmi and Jennifer Willmott cannot disclose, to anyone, information about Arias without her consent.

Arias was not Martinez’s client, so he doesn’t owe a duty to her and doesn’t need her consent to write a book.

However, he did have a client. That client was the State of Arizona, and he needs permission from Arizona to disclose the information learned during the prosecution of Arias and to publish his book.

The Maricopa County Board of Supervisors is the most probable authority to give, or withhold, permission. Martinez also needs permission from his boss, County Attorney Bill Montgomery.

The office referred questions about the book to the publisher.

If Martinez is able to obtain permission from each party, he still needs to make sure there are no court orders from Judge Sherry Stephens that prevent him from disclosing information.

If you remember, much to the frustration of every trial follower and commentator, during much of the trial and all of the retrial, the players were under orders from Stephens to not speak to the media.

Lastly, and perhaps most importantly, if an appeal is pending, Martinez must be careful because prosecutors are subject to extra special ethical rules.

Under those extra special rules, prosecutors have to watch what they say to the public so as not to create unwarranted ridicule of the defendant or taint the jury pool.

Considering there is no jury involved at this point, Martinez is probably OK, but he still needs to tread carefully. Martinez is smart and I highly doubt he would do or say anything at this point to impact the conviction he worked so hard to get....."

Juan announced the release of his book;
Nurmi followed by announcing the release of the first of a three book series on this case.
This is an excerpt.
Would you agree with his statement based upon what you saw during the televised court trials? Or is Nurmi attempting to reduce the collateral damage done to his name by his actions and those of Arias? How much is he accountable for his own actions?
Keep in mind the type of cases Nurmi represented PRIOR to JA: They were all male, sex offender cases...
Now, how much do you think he was unwillingly damaged and how much did he want this case for the publicity, free advertising it would give to him????


"....."To fully get a visual of what Ms. Arias did to my brain you would have to find some fecal matter, throw it into the pan, add a chopped up dead rat and scramble the whole mess up. Once completely cooked this concoction would then approximate the effect that Ms. Arias would have on my brain."..."

Nurmi writes he quickly shut Arias down, as her "sole goal was to manipulate me into acting in accordance with her wishes."

"I was the most significant male relationship in her life. I took that to mean that in her sick twisted mind, Ms. Arias saw me as her boyfriend. Putting two and two together, this meant that Ms. Arias did not care if I saw her naked because she viewed me as her boyfriend. Sadly, the fact that your client creeps you out is not reason to file a motion to withdraw, trust me I filed many of those motions in this case and 'she creeps me out' is not a viable legal motion. Trust me, if it was, I would have filed it."
Intimidation, Nurmi said, surfaced when he wouldn't bend to Arias' will....."

unless she is basking in her own sunshine...
I am sure she is rather irked by Nurmi's statements in his book(s) and is probably threatening to sue him for... defamation??? lol

(I am wanting to know what was said by JA when she was the "secret witness" on the stand during the trial media blackout...)

Watch the vid!! At the very end, near 4:30 JA is asked re the pictures taken.
She is stating Travis suggested all the poses. And then, when asked about one of the poses, JA responds, "...He didn't disagree" to the pose! This would imply it was JA who was suggesting the poses as Travis, DIDN'T DISAGREE. Surprised Juan did not catch that.

I want to know if any money from the book will be headed back toward JA or her entourage?

How did JA feel about the book?
Was she aware he was going to write the book? If so, when?
Is this just another PR stunt?

He speaks of "damage to his client base"... but fails to address the MEGA MONEY he made off this case as well as the free advertising for future cases. He complains he was working 14 hours a a day... but neglects to mention being paid for many days he was not in court or the court being dark, holidays, etc... He says he was paid only small amount...

Publisher disputes claims Arias juror 'fell in love'

William Pitts, 12 News 5:36 p.m. MST December 1, 2015

The publisher of prosecutor Juan Martinez's upcoming book disputes claims made in a tabloid that a juror in the Jodi Arias murder trial "fell in love" with Arias.

A spokesperson for HarperCollins said no one from The Daily Mail, which initially published the claims, contacted them to fact check the story. The spokesperson went on to say much of what the Daily Mail reported isn't even in Martinez's book.
