This might be true in a clinical evaluation, but she doesn't appear to get how critical those detailed notes would be in a forensic setting, since she's admitted she's not a forensic psychiatrist.

It seems to me that the defense team did not prepare her well for what was expected of her (maybe intentionally???)

CENTENNIAL — The Aurora theater shooting gunman told the judge Thursday that he does not plan to testify in his own defense.

"I choose not to testify," James Holmes told Judge Carlos Samour Jr. Holmes gently swiveled in his chair as Samour told him that he has a right to testify or not.

Holmes said he had no questions for the judge.

After more than 250 witnesses from both sides and 46 days in court, defense attorneys plan to rest their case on Friday.

The defense is set to rest its case Friday in the Aurora theater shooting trial, after a final week of testimony dominated by a key psychiatric witness.

Dr. Raquel Gur has testified that James Holmes was legally insane when he shot and killed 12 people at a midnight premiere of "The Dark Knight Rises" three years ago.

Her assessment is key because the outcome of this trial hangs on whether the jury believes Holmes was legally insane during the attack.

"I do not believe that without the delusion and without being mentally ill that this would have ever happened," said Gur, who directs the Schizophrenia Research Center at the University of Pennsylvania.

She said she stakes her professional reputation on her testimony. So it’s not surprising that District Attorney George Brauchler aggressively attacked Gur’s assessment on cross examination.  At one point he mocked the brevity of her written report -- just 14 pages, and light on details.

"If the purpose of the report is simply to signal to other people, 'I analysed everything, I talked about everything, he’s schizophrenic,' why not just send in a post card?"

Gur replied that relatively short reports are common in the clinical settings where she works.

But Brauchler noted that other forensic psychiatric experts who testified at the trial turned in voluminous reports on sanity -- much more appropriate, he says, for a trial of this magnitude.  Gur, though, is not a foresnsic psychiatrist.

Day 47

Defense attorneys plan to rest their case on Friday in the Aurora theater shooting trial. Friday is the 47th day of the trial, and jurors are expected to hear closing arguments on Tuesday.

Defense attorney Dan King told the judge on Thursday that he plans to present a final witness and show jurors one more video before he rests his case. District Attorney George Brauchler will then have an opportunity to present rebuttal witnesses.

James Holmes is accused of killing 12 people and injuring 70 others on July 20, 2012, at the Century Aurora 16 movie theater. He has pleaded not guilty by reason of insanity, and he could face the death penalty if convicted.

The trial is scheduled to resume at 9 a.m. Friday.

Before the jury enters the courtroom, Judge Carlos Samour Jr. has a few things to go over with both sides.

Samour is discussing how a verdict will be handed down by the jury.

"It seems to me like it just makes sense to plan ahead," Samour says.

The defense doesn't want the jury to be given any extra instruction as per how they would release a verdict. Samour says he disagrees that it would have any impact and that he doesn't plan to limit the jury at all in how long they take to deliberate.

"We'll tell them in advance how we are going to proceed," Samour says.

Samour says he doesn't want to hinder the schedules of the jurors.

Bottom line, verdict will be released three hours after the jury reaches it, Samour rules.

The defense said it will be calling their investigator first and publishing exhibits, namely a video.

Jury is being brought in.

At one point in the video, Holmes is lying down on what looks like a bed with several people standing over him. Holmes' limbs are spread out.

It appears that Holmes is naked in this video as well.

It in unclear what is happening in the recording.


Higgs says she has no further questions for Gonglach.

Prosecution has a few questions for Gonglach.

Karen Pearson asks if Holmes knew that Gonglach worked for the defense.

Gonglach says yes.

Defense has no redirect.

No jury questions.

Gonglach is released.

Daniel King is told to call his next witness.

"We have decided not to play any more of the exhibit," King said.

"At this time, the defense rests," King said.


Samour calls for the morning break to last 20 minutes.

Again, the video is difficult to see over the live stream from the courtroom. There is no sound.

Deputies are crowding around Holmes in much of the jail cell video.

After about 20 minutes of the video, Higgs resumes her questioning.

"After that is when deputies put him in a restraint chair where he remains for the next several hours?" Higgs asks.

Gonglach says that's correct.

Higgs asks about a doctor who saw Holmes at Denver Health Medical Center.

Gonglach says he recalls being told that Holmes, during that meeting at Denver Health, said he was seeing shadows.

Higgs is publishing video now from Holmes' trip to Denver Health.

"This one is about 30 minutes," Higgs says.

She says she plans to play it in its entirety.

The jury is reviewing the exhibit. It's not clear yet exactly what the exhibit is, though it appears to be the aforementioned "galactic colonization" writings.

While the jury is reviewing the exhibit, Samour calls Rich Orman, for the prosecution, and Daniel King, of the defense, to the bench for a conference.

The bench conference lasts for about 10 minutes.

The jury takes roughly 25 minutes before Higgs continues.

"This is not something that you reviewed with Mr. Holmes?"

Correct, Gonglach says.

Higgs is asking about some jail videos, including one where Holmes is placed in an emergency restraint chair by deputies.

One of the videos is being played now. It does not have any audio.

Through the live stream, the video is impossible to clearly see.


In the courtroom, Holmes appears to be diligently watching the screen.

At one point in the jail cell video, Holmes appears to be naked. Deputies swarm the cell and restrain him.

Juror 378 is late.

Court is now in recess until that person arrives.

After a delay of about 15 minutes, court resumes. The jurors are now, actually, brought in.

Holmes is wearing a blue dress shirt and dark slacks. As he stand while the jury enters the courtroom, he is keeping his hands in his pockets.

"Good morning everyone," Samour says. "I should say good Friday morning."

Rebekka Higgs, for the defense, recalls John Gonglach, an investigator for the defense.

Higgs wants to ask Gonglach about the "galactic colonization" writings of Holmes.

"Did he volunteer that, 'Hey, I've got these writings. Come get them!'" Higgs asks.

Gonglach says absolutely not.

Gonglach says the defense was receiving video from the jail of Holmes in his cell.

"In some of those clips it looked like he was writing on a tablet or a notepad," Gonglach says. "At some point, near the end of August, the jail stopped recording or copying the footage of that cell."

Higgs is now publishing an exhibit. A copy is being handed to each juror.

Prosecutors in the Aurora theater shooting case say the mental evaluation conducted on suspect James Holmes contains "numerous deficiencies," and they allege that the doctor who performed it, Dr. Jeffrey Metzner, had "an unfair bias." They'd like Holmes to be re-examined by two experts that they've chosen.

Those are among the revelations contained in an order (on view below) issued by Judge Carlos Samour. The judge will hold a hearing on the prosecution's request, but the public won't be allowed to attend.

The hearing is scheduled to start on January 27, 2014. Four experts are expected to testify and their testimony will likely consist of the most detailed information revealed in court thus far about Holmes's mental health. But Samour has decided that the information also has the potential to prejudice prospective jurors and thus, has closed the proceedings to the public, the victims of the shooting and the media.

Holmes subsequently underwent a sanity evaluation at the Colorado Mental Health Institute at Pueblo to determine three things: whether he is competent to stand trial, his sanity on the date of the offense and how any mental disease he may suffer affects any mitigating factor in the death penalty law. The evaluation was conducted by Metzner, a University of Colorado psychiatrist who has written about mental illness and the prison system.

Samour's order, which is dated December 20, says that Metzner's 69-page report about Holmes's sanity concludes that Holmes is competent to stand trial. However, prosecutors are contesting Metzner's findings related to Holmes's sanity on the date of the offense and how any mental disease he may suffer affects any mitigating factor in the death penalty law. Samour's order does not say what those findings were.

But it does say that prosecutors want Holmes to be re-evaluated by two experts of its choosing: Dr. Kris Mohandie and Dr. Phillip Resnick. According to their curricula vitae (also on view below), Mohandie is a California psychologist who works with the FBI and local police departments, and Resnick is an Ohio psychiatrist and a professor at Case Western Reserve University. Both have consulted on numerous criminal cases.

Metzner, Mohandie, Resnick and another expert to be called by the defense, Dr. Robert Hanlon, are expected to testify about about "myriad details" from Metzner's evaluation of Holmes, as well as the contents of a notebook that Holmes mailed to CU psychiatrist Lynne Fenton just hours before the shooting, according to Samour's order.

Samour writes that while he believes the media plays an important watchdog role when it comes to criminal court proceedings, allowing the media to report on the testimony given at the January hearing could impair Holmes's right to a fair trial.

Prosecutors have accused the psychiatrist who performed a crucial mental-health exam on the Aurora movie theater gunman of having "an unfair bias" that influenced his findings, according to a judge's order issued this month.

Dr. Jeffrey Metzner, a University of Colorado psychiatrist with an expertise in the mental health of prison inmates, was the man picked to perform the most closely watched psychiatric exam in state history. Metzner's job was to determine whether James Holmes was sane when he killed 12 people and wounded dozens more in the Century Aurora 16 theater.

The results of Metzner's exam, which was court-ordered, have not been released other than that Metzner found Holmes mentally competent enough currently to stand trial. Prosecutors are challenging Metzner's two other conclusions, one related to Holmes' sanity at the time of the shooting and one related to whether Holmes is mentally fit enough to be eligible for the death penalty.

Little has been released about the prosecutors' challenge — and the hearings that will decide whether prosecution experts will be allowed to conduct their own exam on Holmes have been closed to the public.

But, in an order issued last week, Arapahoe County District Court Judge Carlos Samour revealed that prosecutors "contend that at least one aspect of the ... examination is unfair because Dr. Metzner had 'an unfair bias.' " Prosecutors also argue that Metzner's evaluation contained "numerous deficiencies," according to Samour's order.

Samour's order does not reveal what the alleged bias is or in what ways prosecutors contend the evaluation was deficient. Defense attorneys have argued that Metzner's conclusions are solid, according to Samour's order.

Judge orders new psychiatric exam for James Holmes

James Holmes will undergo a second court-ordered psychiatric evaluation, after the judge overseeing the Aurora movie theater murder case ruled that the first exam was "incomplete and inadequate."

In an order issued Wednesday, Arapahoe County District Court Judge Carlos Samour agreed with prosecutors that the psychiatrist who performed the first exam, Dr. Jeffrey Metzner, didn't sufficiently explain how he reached his conclusions about Holmes' sanity on the night of the shooting.

"[A]lthough Dr. Metzner collected and documented a lot of factual information as part of his examination, he offered little rationale for some of his opinions and findings," Samour wrote. "... The bases for Dr. Metzner's opinion regarding the issue of sanity are just as important to the truth-finding process as the opinion itself."

However, Samour rejected the prosecution's request that the new evaluation be conducted by doctors hired by the prosecution. Instead, Samour ordered officials at the Colorado Mental Health Institute, who appointed Metzner to conduct the first evaluation, to pick a new independent doctor for the second evaluation.

While that makes it appear that Metzner's report was favorable to the defense, Denver attorney Karen Steinhauser said it may not ultimately be useful to the defense at trial since prosecutors were able to raise doubts about it.

"So it raises the question of how valuable Dr. Metzner's report will end up being," she said.

Metzner is one of the two forensic psychiatrists who testified for the prosecution.  Several media reporters, some lawyers, and also some mental health professionals who have been following the Colorado theater  trial were extremely surprised when Dr. Metzner was called to testify for the prosecution, especially after his findings about Holmes' sanity at the time of shooting were discredited by both, the judge and the prosecution.

I personally believe that Dr. Gur did what she needed to do for the defense, and that she stood her ground under a withering cross examination. It is hard to tell what effect (if any) her testimony could have on the outcome of the trial.

I honestly think that the defense made a poor choice by hiring her to testify on their client's behalf, I think she is very knowledgeable and that she was actually a good witness, but the defense would have done better by hiring a forensic psychiatrist, just like the prosecution did.

Attorneys asked about discussing instructions for the penalty phase.

If the jury decides Holmes was sane at the time of the shootings and is guilty on all counts, then the jury would be asked to decide if he should be sentenced to death.

Samour said he does not want to discuss anything about the penalty phase while the jury is deliberating.

"I just don't feel it's appropriate," he said.

But Nelson wants to argue that the defense is entitled to make an opening statement during the penalty phase. She believes they have a right to do so, and that Colorado case law supports it.

Orman wants to establish who will go first during penalty phase statements. He said the prosecution should go last, at least during the second phase.

"They've got one important expert witness they've said they're going to call," Orman said. "But we've got nothing, nothing on what that witness is going say."

Samour ruled that no one will get an opening during the first portion of the penalty phase. But both will get two minutes to open the second and third portions.

During the second piece, the defense will go first, followed by the prosecution. For the third portion, the prosecution goes first and the defense will be second.

The openings should be short, "road maps" of what will be presented, Samour said.

(One of the defense witnesses for the penalty phase (should they have a penalty phase) is doing a research on Monarch Butterflies and might be unavailable to testify. Apparently he knows Holmes since Holmes was a child.)

Re Day 47 vids:

JH being naked in the cell... Was it ever explained why he was naked?
Sometimes, clothing may be taken away to keep the individual from harming self.
Perhaps, he refused to put on the assigned uniform ?
The others appear to be "tackling " him in an attempt to dress him in the jail house clothing.

Did he have latrine facilities in his cell or was he told to defecate/urinate in a bucket in the cell?

The actions of beating a head against a wall or smearing of feces: These may have been the actions of a frustrated person who was limited in the forms of communication and self expression. I am sure the jail knew what they were wanting to report back to the prosecution...

I haven't even explored the possibility of drugs causing behavior that would appear to be deranged...

Colorado-

(1)The murder was especially heinous, atrocious, cruel, or depraved (or involved torture)

BTW, that red hair he supposedly dyed himself? Yeah.
I used to dye my hair in order to hide my grey.
Do you know how many times I chased the drippings on my forehead or the tips of my ears? And I had years and years of practice... monthly.

I do not believe he could have dyed his hair red without the dye dripping on his forehead, ears, neck, etc.. Yet, when I look at the photo, I see no red smears or "freckles" caused by the dye...

He must be a very talented artist....
