from Alessandra's ink:

Greenberg declined to comment outside court, but another defense team lawyer seemed to contradict Brodsky, saying Peterson may want Greenberg, an accomplished appellate lawyer, on his team.

This is interesting, it seems Brodsky might have over played his hand, yet again. It sounds as if Peterson has had time to reconsider his next move since he plans an appeal and might be listening to other members of the Defense Team that think differently than Brosdsky.Since many Criminal Def Analyst think Brodsky exhibited "ineffective counsel" in putting the Divorce Attorney on the stand and is a reason for appeal, it seems Peterson might be listening to someone else besides Brodsky.

Authorities: New lawyer for Drew Peterson seeks to overturn conviction

Attorneys Joel Brodsky, left, in May 2012, and John Paul Carroll in October 2011. (Brodsky, Chicago Tribune; Carroll, Abel Uribe, Chicago Tribune)

By Stacy St. Clair

As Drew Petersonawaits sentencing for murder, a new attorney is seeking to overturn his conviction based upon possible mistakes made by his defense team leader, court records show.

Naperville attorney John Paul Carroll filed documents in Will County court today asserting that he now represents the former Bolingbrook police sergeant, who was convicted last month of killing his third wife, Kathleen Savio.

In the documents, Carroll accuses lead defense attorney Joel Brodsky of lying about his courtroom experience, forcing Peterson to engage in pre-trial publicity and ignoring his request for a speedy trial. He also claims that Brodsky threatened to share unspecified information about Peterson if he fired him.

Alessandra_Deux - LMAO~! Many of us saw this coming and Criminal Defense Analyst predicted it, but Brodsky is about to get his imo, a real moron. Though a real scumbag, always imo, Brodsky made endless media appearances and participated in obnoxious banter w/DP, they made a public joke of both Savio and Stacy causing finally a GAG order in the case.

I am curious as to how much money Brodsky has truthfully been paid over the years as DP's sidekick or if he did a lot of his work probono. imo, the most aggregious error on Brodsky's part was not to demand a speedy trial years ago, thank GOD for his ineptitude. Glad DP is rotting in prison, who's laughing now A HOLE, besides me!

Lawyer Showdown Looming in Drew Peterson Case

After Friday we may—or may not—find out who's really representing Drew Peterson.

By Joseph Hosey
October 10, 2012 | 5:54 pm

As many as a half-dozen lawyers might walk into a Joliet courtroom Friday, and it's anybody's guess which ones—if any—convicted wife-killer Drew Peterson will keep on his case.

Of the six attorneys who lost Drew Peterson's murder trial last month, one has quit and another was fired. Or maybe he wasn't.

Either way, that particular lawyer, Steve Greenberg, said he's not going to bother attending what is shaping up to be an explosive court hearing to determine who will be on Peterson's defense team going forward.

Sounds like DP (read that as DIPPY) is trying to dazzle the courts with his extreme popularity! Not impressed. -yawn-

He is a loser as he doesn't play by the very rules of society or those he supposedly advocated for.

WILL COUNTY, IL—

Convicted murderer Drew Peterson was back in court on Friday, and Joel Brodsky remains on his defense team. John Carroll and Michelle Gonzalez are out.

~Snipped~

When Peterson announced that he was sticking with Brodsky, Gonzalez says she was shocked. She said she met with him Friday morning and he said she and Carroll were his lawyers. She thinks Brodsky went in after she left and changed is mind. She says for some reason, Peterson feels a sense of loyalty to Brodsky.

Judge Ed Burmila says allegations for ineffective counsel were made and he cannot ignore them. He told Peterson to consider pursuing this, and not to seek Brodsky's advice since he is target of allegations.

"That would be a fatal error," Burmila said.

Julie - PLUS, I bet Brodsky hasn't been paid a dime in a long time. Brodsky should have said imo;

I am NOT an APPEALS Attorney, therefore, I am not qualified to do the appeal for DP.
I really am INCOMPETENT!

From a previous article I read, one of the women that wrote the Appeal Motion said they aren't interested in representing DP, they are only interested in doing the Appeal. I guess that DP would again have new lawyers if granted an appeal.

Federal agents and state cops searched through Hammel Woods forest preserve in Shorewood Monday looking for signs of missing mom Stacy Peterson.

A state police source confirmed that the operation—which included at least one helicopter and police dogs—was part of the search effort for the Bolingbrook mother, who disappeared in October 2007.

Weeks after Stacy vanished, state police officials named her husband, Drew Peterson, 58, as the sole suspect in the investigation the then-23-year-old's disappearance.

The FBI and the State Police searched a Will County forest preserve Monday afternoon — a search that attracted the attention of the sister of the missing Stacy Peterson, although authorities wouldn’t say what they were looking for.

Cassandra Cales arrived at the 400-acre Hammel Woods near Shorewood Monday afternoon after the search was completed.

She said she had heard about the search, but had not been called by authorities. Cales left a few minutes later without speaking to investigators.

FBI, police search Hammel Woods for Stacy Peterson

Updated at 06:06 PM today

Chuck Goudie

November 5, 2012 (SHOREWOOD, Ill.) (WLS) -- The day-long search in a Shorewood forest preserve by boat, by helicopter and by foot with dogs on Monday was for Drew Peterson's missing wife Stacy, according to law enforcement sources.

~Snipped~

The search in the Hammel Woods area is not related to any new leads, but is part of periodic searches held in the case, according to the source.

Stacy Peterson's cell phone showed activity in the Shorewood area around the time she disappeared. The search on Monday wrapped up around 4 p.m. Officials may be back on Tuesday.

Authorities searched Hammel Woods again Tuesday, but their reason for searching the forest preserve land near Shorewood remains uncertain.

Special agent Joan Hyde confirmed that the FBI is participating in a search of Hammel Woods with the Illinois State Police. Monique Bond, spokesperson for the Illinois State Police, said so far, nothing has been found and that the investigation is ongoing.

An FBI Mobile Command center truck was at the scene and an officer with a white-and-black spotted dog was searching the woods. Two people, a man and a woman, were seen standing on a walking path and holding shovels.

Intelligence Report: Drew Peterson son loses wrongful termination lawsuit against Oak Brook Police Department

Updated at 06:20 PM today

November 7, 2012 (CHICAGO) (WLS)

Stephen Peterson went looking for justice in federal court. He filed a $10 million lawsuit claiming wrongful termination. And, like his father, he has lost in court.

Stephen Peterson was terminated by the Oak Brook Police Department in February of 2011. The oldest son of convicted wife-killer Drew Peterson was fired after his testimony before a grand jury that was investigating the disappearance of Stacy Peterson.

Stephen Peterson testified that he had voluntarily accepted guns from his father so the guns wouldn't be confiscated by authorities.

But that's not always the case. My 21 y/o daughter was murdered by her estranged husband, and the jury only found him guilty of Man Slaughter. She had over 50 stab wounds, and 4 knives broken off in her body, big chunks of flesh bitten out of her arms and her nipples bitten off, and he only served 8 years of his 20 year sentence.

Oh, Sitemama, I'm so sorry for your loss. Just horrific what she must have suffered! That's despicable that he was only convicted of MS and only served 8 years. Was he charged with murder 1 or 2, and got convicted on the lesser charge? Or did they only charge him with MS? Sure sounds like her injuries should have been more than sufficient to prove murder, but of course I didn't see the trial. What is wrong with these juries? I just can't comprehend how this could have been just MS. Again, so sorry for what you've had to endure.

Charged with first degree, but his atty got it lowered to second because he did not carry a weapon into her house, when he broke in her front door after 12am. But the jury said since her boyfriend was there when he broke in, it was a crime of passion. It was no way a crime of passion as he was living with his girl friend for over 8 months and he knew Kim was seeing an old BF from high school. But since they saw it as such, their verdict was MS.

Peterson: Ex-attorney had 'smorgasbord of ethical violations'

Drew Peterson continued efforts to overturn his murder conviction Thursday as his lawyers filed a biting post-trial document that accuses his former lead attorney of botching the case and threatening to reveal harmful information about the retired Bolingbrook police officer.

A post-trial memorandum filed in Will County placed responsibility for the conviction squarely on the shoulders of Joel Brodsky, Peterson’s former lead attorney and colorful confidant.

“Attorney Brodsky expected that Drew Peterson would be his ticket to the legal elite,” the document states. “Regrettably, he was poorly equipped to try a case of this magnitude, resulting in hornbook errors and a smorgasbord of ethical violations. Individually and cumulatively Brodsky single handedly deprived Drew of his right to effective assistance of and conflict-free counsel.”

Drew Peterson Shouts, 'I Did Not Kill Kathleen!' - Then Gets 38-Year Sentence

By MATTHEW JAFFE (@matthewbjaffe)
CHICAGO, Feb. 21, 2013

Former Illinois cop Drew Peterson yelled, "I did not kill Kathleen!" during the sentencing phase of his trial today -- and then a judge sentenced him to 38 years in jail for killing her.

The sentence came after Will County Judge Edward Burmila denied Peterson a re-trial in the killing of his third wife, Kathleen Savio, in 2004.

Peterson had faced as many as 60 years in prison.

At his sentencing, after Peterson shouted that he did not kill his wife, someone in the courtroom yelled in reply, "Yes you did!" according to ABC News Chicago station WLS. Burmila then ordered that person to leave the courtroom.

Judge in murder trial refers ex-Peterson attorney's remarks to disciplinary body

Denies defense team's motions to reduce sentence and gag Joel Brodsky, but calls former lead lawyer's public statements shocking

By Steve Schmadeke, Chicago Tribune
reporter

8:42 p.m. CST, March 5, 2013

The judge who oversaw the Drew Peterson murder trial said in court Tuesday that he was shocked by some public statements made by Peterson's former lead attorney and would bring them to the attention of the state's disciplinary body for lawyers.

Judge Edward Burmila denied motions by Peterson's defense team to reduce his 38-year sentence to the minimum of 20 years and to silence former Peterson attorney Joel Brodsky regarding the case, said Charles Pelkie, a spokesman for the Will County state's attorney's office.

Although Burmila denied the motion on Brodsky, he ordered the court clerk to send a transcript of the hearing to the Illinois Attorney Registration and Disciplinary Commission, Pelkie said. The judge was concerned about statements Brodsky made on WGN-TV after the sentencing, Pelkie said.

Bolingbrook board hires expert to help determine whether Peterson should keep pension

Panel could revoke retirement payments if it finds that ex-police officer used training to commit murder

March 05, 2013|By Stacy St. Clair, Chicago Tribune reporter

Drew Peterson officially lost his freedom last month — and now he could lose his pension, too.

The Bolingbrook Police Pension Board has hired an outside attorney to help decide whether it should strip Peterson of his retirement pay following his murder conviction and sentencing. The move marks an ironic turn in the high-profile case, given that prosecutors argued that Peterson killed his third wife, Kathleen Savio, partially because he did not want to share his pension with her.

The five-member panel — which includes three current or former officers who worked on the force with Peterson — recently retained public pension expert Charles Atwell to review trial transcripts and determine whether the former police sergeant's conviction requires him to forfeit his $79,000-a-year pension.

Bolingbrook officials will figure out their next step, if any, after they receive Atwell's report, pension board attorney Richard Reimer said.

2 bickering attorneys thrown off case

Joel Brodsky and opposing lawyer in civil case cited for 'deplorable behavior'

Attorney Joel Brodsky, left, was one of two lawyers tossed off a civil case Wednesday because of bad behavior. (Alex Garcia, Chicago Tribune / April 24, 2013)

A Cook County judge Wednesday threw attorney Joel Brodsky and opposing counsel Michael Meschino off a civil case for what he said was "deplorable behavior."

In the latest controversy involving Brodsky, former lead attorney for convicted murderer Drew Peterson, Judge Raymond Mitchell wrote in an opinion and order that the attorneys had "proved impervious to reason and to a show of force," and that disqualifying them was necessary to ensure the parties' right to a fair trial.

(JOLIET) An attorney representing the family of Drew Peterson’s third wife, Kathleen Savio, in a wrongful death lawsuit against Peterson argued Thursday that a Will County judge should rule in the Savios’ favor without a trial, the Herald News is reporting.

Judge Michael Powers heard arguments Thursday morning regarding the Savios’ motion for a summary judgement.

Powers said he would issue a decision in 30 days.

Judge continues wrongful death suit vs. Peterson

By Janet Lundquist jlundquist@stmedianetwork.com September 30, 2013 7:40PM

A Will County judge has denied motions that could have closed the wrongful death lawsuit filed by the family of Kathleen Savio against imprisoned former Bolingbrook police sergeant Drew Peterson.

Circuit Court Judge Michael Powers denied the motions for summary judgement — which is a decision by the judge without a trial — that were filed by the attorney for the estate of Savio, Peterson’s third wife, and by Peterson’s attorney. Powers set an Oct. 24 status hearing on the lawsuit.

"...Stephen Peterson, 34, was fired from the Oak Brook Police Department in 2011 after officials ruled that he failed to disclose important information and demonstrated poor judgment during an Illinois State Police investigation into the disappearance of Stacy Peterson, his father's fourth wife.

In one instance, Stephen Peterson did not tell authorities that his father gave him checks totaling $236,800 shortly after Stacy disappeared or that Drew made his adult son promise to take care of his school-age siblings if anything happened to him.

Detectives say that knowing about that exchange could have benefited their investigation, but the younger Peterson insisted he didn't know that his father was a suspect at the time of that conversation.

The village police and fire commission also said Stephen Peterson took three weapons from his father to prevent them from being seized when law enforcement agents searched Drew Peterson's Bolingbrook home. ...."

Drew Peterson, expected to file appeal next month, has a lot to say

7:33 a.m. CST, December 26, 2013

Snipped:
-----
Drew Peterson is expected to formally challenge his conviction next month — and his attorneys apparently have plenty to say about it.

Peterson's lawyers recently submitted their third request for permission to exceed the 50-page limit imposed on appeal briefs in Illinois — only to be swiftly denied by the 3rd District Appellate Court for the third time.

In a motion filed this month, Peterson's attorneys said his case has generated more than 11,000 pages of court records, including 3,000 pages stemming from the landmark hearsay hearing held two years before his murder trial. The trial transcript contains more than 5,000 pages, according to the filing.

The 3rd District also prohibits defendants from using more than 15 pages to outline the facts of the case, a limit that Peterson's lawyers say is unfair given the history of the headline-grabbing legal drama.

Drew Peterson Lawyer Completes Appeal

CHICAGO January 14, 2014 (AP)

Snipped:
-----
Drew Peterson's lawyer argues in an appeal mailed Monday to a regional appellate court that a judge and a defense attorney made critical errors during the trial that ended with the former Chicago-area policeman being convicted of killing an ex-wife, denying him a fair trial.

... "The State did not present a single eyewitness, physical evidence linking Drew with Kathleen's body, forensic evidence linking Drew with Kathleen's body, or a confession from Drew," the 55-page appeal says. "And while it is true there is no magic formula for a murder conviction, at least one of these pieces of evidence is usually present where an appellate court upholds murder convictions."

Illinois passed a hearsay law in 2008 tailored to Drew Peterson's case, dubbed "Drew's Law," which assisted in making some of the evidence admissible.

The appeal was sent to the 3rd District Appellate Court in Ottawa, where it will be formally filed this week. Peterson attorney Steve Greenberg supplied a copy of the 55-page document to The Associated Press. The appeal asks the higher court to reverse the conviction and find Peterson not guilty — or, at least, order a new trial.

Ex-cop Drew Peterson accused of trying to hire hitman

CHICAGO - Drew Peterson, the former suburban Chicago police officer who is serving 38 years in prison for the murder of his third wife, is accused of trying to hire a hitman to kill a prosecutor who helped put him behind bars, reports CBS Chicago.

The 61-year-old Peterson is charged with solicitation of murder after he allegedly tried to put a hit out on Will County State's Attorney James Glasgow, who led the prosecution team in Peterson's 2012 murder trial.

Peterson is currently being held at a maximum-security prison in Randolph County, Ill., about 50 miles southeast of St. Louis., for the murder of his third wife, 40-year-old Kathleen Savio, who was found dead in a dry bathtub in March 2004 while the couple was in the midst of a divorce.

Drew Peterson's hit man charge echos 2012 rant against prosecutor

By Stacy St. Clair and Angela Caputo
Chicago Tribune

February 10, 2015, 6:06 AM

A bitter Drew Peterson stood in a courtroom two years ago and demanded that Will County State’s Attorney James Glasgow look him in the eye..

“Never forget my face,” Peterson said as his voice shook with rage. “Never forget what you've done here.”

At the time, it seemed just another dramatic moment in a murder case overflowing with them. But the words took on a more ominous tone after Peterson was charged Monday with soliciting a hit man to kill Glasgow.

Wearing his prison uniform and shackles, Peterson appeared briefly in a downstate court where he received a copy of the charges against him and asked for a public defender, officials said. Court documents offer few details about the alleged solicitation, except to say that Peterson offered to pay for an unnamed hit man in conversations that took place between September 2013 and December 2014.

Drew Peterson To Appear In Court Tuesday In Murder For Hire Plot

March 2, 2015 6:21 PM

(CBS) — The former Bolingbrook cop convicted of killing one wife and suspected in the disappearance of another heads back to court Tuesday, reports CBS 2’s Mike Puccinelli.

Drew Peterson is now accused of hiring a hit man to kill the Will County state’s attorney.

He is perhaps the states most infamous inmate. The 61-year-old is serving a 38 year sentence at Menard Correctional Facility for murdering his third wife. Now, if he’s convicted of trying to hire a hit man, he could have another 40 years tacked on to his sentence.

That would all but ensure that he’ll die Menard or in some other Illinois prison.

Drew Peterson asks for immediate trial on murder-for-hire charges

Mar. 3, 2015  2:56 PM

Drew Peterson has a new lawyer and, it seems, a new legal strategy.

The retired Bolingbrook police sergeant waived a preliminary hearing Tuesday in a surprise move that prevented prosecutors from publicly airing details of his alleged murder-for-hire plot.

His downstate attorney, Lucas Liefer, said it was a decision based on their desire to minimize interest in the case.

Instead, Peterson entered a plea of not guilty and asked to schedule his trial as soon as possible. A trial was tentatively set for late July.

...If convicted of the solicitation, Peterson could face 60 years in prison in addition to his 38-year sentence for killing Savio.

He is scheduled to be paroled in May 2047, when he would be 93 years old.
